I just received an RFE for a bunch of paperwork. Some of it has to be brought from Russia. Hopefully I will be able to mail it to USCIS by the end of April (they gave me time until end of May).
So I do not expect the petition to be approved until June or so, even if they are satisfied with my RFE response.

Thanks bro. Maybe you could follow up your status with them? It's already past the 5 month mark.
It's sis:) My husband's account, but he hasn't used it since I got here.
I've done this many times in the past 10 years. Five month mark does not mean a thing. My mother waited almost 9 months for an approval in 2013. I waited 3. My dad five. So it's all over the place. Anyway, the PD won't be current until 2016, so no rush, really

DS-230? It has been obsolete for some time now and replaced by DS-260.
But in any case, contact NVC and ask them to make corrections. You can email them or call. Have the case number handy.

Guys, just want to ask if any of you have already check with NVC if they already have our case?
It takes at least a month for the case to be entered into NVC system.
BTW, no approval here yet.

No NOA-2 yet.

No. Five months and 9 days as of today.
But from what I've heard sometimes you don't get NOA-2 until the PD becomes current. No rush, I guess...

September 2014.
BTW, a question.
When do we submit documents to NVC? Right after I-130 is approved and then wait for PD to become current for the interview, or wait for current PD first and then do NVC?
-
DS230 is obsolete.
Its replaced by the online DS260.
Thanks!
I guess they better remove it as to not confuse people like me:)

I did this last year for my mother and I can't remember a thing:(
DS-230 is not on the list of the supporting documents to send to NVC. Well, it's not a supporting document anyway.
So when does it have to be submitted? I have the supporting documents packet for my dad sitting on the desk waiting to be mailed, and I suddenly realized there was DS-230 to deal with at some point.
Or does DS-260 completely replace DS-230?
Thank you.

My PD is September 15 2014. Nothing yet. It's been 5 months and 3 days.

Ok then I guess we will file her taxes. I was wondering if there will be physical residence requirement in the forms like for dependents. If not, then we can file.
-
She may not owe taxes but she may be wise to file them.
From memory you mentioned she lives most of the year in Russia, she has no income
She can't file them if she only lives here 2-3 months out of the year, can she?
She is retired and receives a pension from the Russian government.

So a letter with explanation might do the trick? Thank you.

Here's a question for y'all.
My mom filed I-130 for her minor son (he's turning 8 this year). Due to that fact that she's his only relative back in Russia, she has to spend most of the year there with him. Babysitters are an option for only very brief time, because he has a physical disability and pretty much nobody wants to deal with it. She lives in the US less than 6 month out of the year and has no income here. She does not file taxes here, and I cannot include her in my taxes as dependent due to the fact that she lives with me less than 6 months. Her actual income or lack thereof does not matter in this case, since there is a joint sponsor. The question is, what does she send to NVC with the AoS packet in lieu of tax forms? Is this going to be a big issue?
While I understand that my situation is fairly rare, I do not believe it's unique. I'd appreciate reasonable advice.

I seem to remember a long thread on this subject and you know you are playing with fire.
If you mean me, then do tell me how to avoid that.

My mother can only stay in the US a few weeks at a time until my 8-year-old disabled brother gets his visa. He has no other relatives there. She got a re-entry permit. She was here in Sept-Oct and is coming back for the month of April, after that probably October or November. Re-entry permit ( and a serious reason) should take care of that.

our i 130 was approved last 1/16/15 but haven't received noa2 yet.should we call nvc now?????
It usually takes about 2 months from the I-130 approval to NVC putting your case in the system. Happened to me twice already. So NVC wouldn't know anything about your case yet.
-
Yes you certainly can. You are going to need proof of legal custody and at least two years of physical custody (court order, custody order, which should say that the children resided with you; if not - some proof that they resided at the same address). Also proof that the biological parents let go of their parental rights (should be in the court order or a separate document). The rest is regular immigration packet for children of a green card holder I-130.
I filed the custody order (which was granted several months prior to the adoption) and the court order. All copies. You'll need the originals for NVC.
If you have any other questions, go ahead. I'll try to help.

Just got the approval letter. It took a little over 4 months. Now the permit will be sent to the consulate. That's another few weeks.
-
You can do it yourself. Attach an affidavit stating that you are fluent in both languages and the translation is full and complete.

Hello!
My mother IR5, not received green card after 5 weeks. But how can we fill I-130 for her son when she not have green card, so what do she fill in the blank require number of green card ? Please show me how to do it , thank you so much for it .
Best regards.
She does not require to physically have the green card to file for her child's immigration. The stamp in her passport that says she was admitted as a LPR serves as proof. Nowhere on the form do they ask for the green card number, only for the Alien Registration Number. And that should have been given to her at the interview, or, probably, at POE.

I am well aware of that. I usually research the subject before I act, and research some more before I ask a question on a forum.
I will, however, explain. She is planning on coming back in April, but we do not know for sure whether she will be able to. She might not be able to come until her son gets his visa, since 24/7/several weeks baby sitters are very hard to come by.

Has anyone applied for a re-entry permit for their relatives recently? Especially at Nebraska SC.
The timelines say 3 months. My mom applied for one in September, and still no word. It is supposed to be sent to the US consulate in Moscow, since she had to leave before she could receive it here.
I wonder if they only let you know when the permit arrives at the consulate... The status still says "fee accepted" as of September 15. She did biometrics on October 15. She needs it before she comes back in April. They might or might not ask for it, but since she only spent two months here before she left for 5 months, it won't hurt to have it on her.
Before you ask why she left - she has a 7-year-old disabled son in Russia with no other relatives. We are in the process of his immigration.

Just got a checklist for joint sponsor affidavit of support. I did mail it to the NVC with the rest of the paperwork. I guess I'm gonna have to do it again...
