    Doesn't seem like a threat tome. He is just informing her of what he will do. He is financially responsible for her, but if she did not have her green card and was still adjusting status, then he could revoke her support affidavit. If she was fighting going back home, which she should since she is not a legal permanent resident with a green card, then he has the right to inform her of his intentions to contact immigrations to have her deported. Once he revokes his support affidavit, then the AOS petition is dead in the water unless he fails to do it and they decide she doesn't need an interview and they produce the card which seems as what they have already done. She won't need a VAWA waiver once she has her green card in hand, she simply needs to get a divorce and file for removal of conditions. She will then have to appear at USCIS for an interview as it takes her and her petitioner to remove conditions. Once she is divorced she will have to file a waiver for the removal and appear at USCIS when they schedule her for an interview. Stop trying to pin anything on the husband without knowing all of the facts. The OP could have posted what she wanted to make the husband look bad. No one knows the complete story or the truth.

    I found this. Telling her to leave to me is not considered abuse, but if he threatened her to gain control over her or intimidate her then it may be considered abuse. I guess she will try to file a VAWA waiver. It doesn't mean it will be approved. I guess we should know more about her story then taking her for face value. There is always two sides to a story. Why all of a sudden does he want her to leave? Maybe her attitude or demeanor changed once she married him an assumed that once she had her adjustment of status filed, her true nature could be revealed. I am not saying this is how it could have happened, but it could be a possibility. If her green card is in production and she receives it then her husband is out of luck and can not tell her to leave the country. He can't tell her to leave even if she did not receive her green card, but if he stopped it in time, he could report her to USCIS for deportation unless as you say she can prove a case for a VAWA waiver. I just think it is odd that her husband would spend all of the time, money and effort to get a wife here only to change his mind after filing AOS. Something a lot deeper than you and I know is going on. Only her and her husband know. There are a lot of Filipinas that use their petitioners for a green card only and the good ones stay married for what they were petitioned for and that is to be a good wife and starting a family. Well it is their problem to sort out.

    The letter is to her c/o me, so it really pertains to her and I will just leave it alone. They didn't have an issue approving her K1 VISA and EAD. If they want it then I can go an get it. Since it is so old and was not a felony, it may already be out of the system. Thanks.

    There was a policy change recently, maybe June 2013 and all waiver interview cases for K1 AOS are being sent from NBC to local field offices, at least according to my congressmans office who contacted our local field office. We have been waiting since August 27, 2012. It sucks. We could have went through an interview at the local field office April 2013, but the NBC just sat on it and then transferred it to the local field office on June 28, 2013. South incompetence in the USCIS. We are doing things legally and they let our country get invaded by boarder jumpers and then they get our benefits. Where is the justice.

    I also forgot to mention that I am ex-Air Force and lived in the Philippines for 4 years and have visitied several times since then. I am well aware of the cultural differences and I accept the Filipino culture and I am very comfortable with it. I do the mano po for my fiancee's parents and elders, eat balut and love the Philippines. I just got a bad one who was materailistic, selfish, immature and had a hidden agenda as I stated. She left the month she made me wait, which was almost a year to have a baby and she agreed to have one with me as soon as we were married, in comes the meddling Brother-In-Law and now I had to wait a year. When the month came to have a baby she started an argument, left the house and went to her friends house and 3 days later she left Indianapolis, Indiana and went to Redwood City, CA. Perfect timing for her to be there when the Brother-In-Law and sister were due to return to Makati City, so she could take care of his sick mother. I also obtained pictures of her with another man in his arms and very affectionate less than 3 weeks of leaving me and we were still married. I confronted the Brother-In-Law and he said it was his best friend and she could do whatever she wanted. My current fiancee is totally opposite, doesn't wear 6 inch heals and try to look sexy and Plastic/fake. Her father is a Police Officer in Dumaguete and I get along with him and his entire family, as I was a Police Officer when I was in the Air Force and stationed at Clark Air Base. I go the real deal now not one of the many bad Filipinas that are just looking for a green card. Hope this clarifies things for you. Ingat!

    I take it you are a FIlipina by the way it sounds and if you are you had better get the A.K.A. for your NBI or the Consular Officer will send you back to get it. Any names that you have used, especially if they are a matter of record will require the A.K.A. Don't listen ti tthe BS that the NBI people will tell you. You just tell them that the US Embassy requires it becasue you have used the name and they should add it on the NBI clearance as an A.K.A., Thaey typ it on the bottom of the form and use your real name, birth name, as the main name on it. Hope this helps you. Believe me, don't le NBI tell you you don't need it, you tell them you need it and if they refuse speak to a superior at the NBI. I would also get Cenomars with the different names also. Good luck.

    Thank. I was freaking after the first comment talking about photo copying the sealed packet. Jovi is probably on her way to Cebu to get the stamp. I haven't heard from her and I am freaking out a little. She can send a fb message from her phone. She knows she has to get it today. I just hope she read my email with the requirements. No room or error. She wanted to fly out Saturday and the ticket is non- refundable. If something came up and she missed the flight I don't know if Delta would work me and charge me only a change fee. I will have to waitbto hear from my BabyGirl. Excited about picking her up at Indianapolis Airport Sunday.
