In some the child is seen as belonging solely to the woman, in some only to the man and in most it is a combination of the birth parents . Even in the US severing the foreign parents right may be harder than you think. Children don't have much a say in their parents until they are in their teens. Has he signed the permission for them to leave the country ?

Have you considered cancelling this petition and letting things go where they will go ? The ticking clock of the running K1 may cause you to make decisions that really need time and lord knows this relationship needs some time. Cancel the K1 and then without that ticking in your ear let your hear what your head and heart really want to say. As a woman with reproductive issues I can tell you it took lots of attempts to have my last child so I personally wouldn't buy it was only one night. There are however people that seem to be addicted to act of sex and need it with or without love involved.

Second K1's do work. ( we are proof ) the consulate can get away with stupid reasons for denying the first K1 but the second one they really have to show proof of being right about denying it. Second petitions for the same partner have high success rates as either a K1 or Cr1. Getting married does not prove you have a legit relationship. Most fraudsters use CR1 thinking marriage in itself is proof.

The system is to file am I130 and wait for an interview in your home country. Coming to the US with all the required documents in hand and just by chance deciding to file to stay is a hairs breath away from immigration fraud and a life time ban. You have choosen to roll the dice and see if you come out the winner or a huge loser in the immigration game. With so much at stake I wouldn't trust my future to a group of caring but untrained people on an internet site. You need a VERY well qualified legal professional.

With the drug trafficking tag you will never get any visa to the US. If you were only tagged as a user you might in the future come after you could show rehabilitation but the trafficker tag is a lifetime ban with no waiver under current immigration laws.

Probably the worse case is our family , 21 siblings ( yes that is siblings ) get them all married off and average 4 kids a piece and you get over 100 people just in round 1, then the spouses start round 2 , and the children when they are adult can start round 3 , we could have the entire village here. The issue is so bad the petitions have to go to the most skilled siblings first and then the other so the doctors and engineers can help with the affidavit of supports .

You need to "show" that you are effectively ( your wife ) the only parent in the child's life. Back in the day to travel with my son I showed the court order that specifically gave me the right to keep the child from his bio donor. ( at the time the child was under a false name by court order )
