It is actually the first crime that will have you in more hot water. Sale of drugs is something that immigration doesn't forgive. Ranks right up there with false claim to US citizenship. The normal standard is one crime more than five years ago. So it may another few years and you will need to hire a good lawyer. DO NOT try to slip in under a different passport, you will only kill any chance you have. Your finger prints will give you away along with your personal data. You committed the crime you will need police reports from all places you lived for more than a year. ( sometimes 6 months )

You focus on the wrong person in your post. Immigrations couldn't care less if your husband was starving in a ditch covering with oozing sores. He is a foreigner and as such they don't care. You letter has to concentrate on the negative effects this is having on you ( USC) and your children (USC) Gather things about the hardships of living there. Maybe it has to deal with safety , maybe your child will be at risk. If the travel.state.gov site has nasty things to say about the country reference that. If the world health organization says nasty thing reference it.

Entering the US with a non immigrant visa with the intent of immigrating is fraud. When you arrive tell the officers that you are coming to stay in the US via filing AOS with you wife and see how quickly you will be on the next plane home. You need to file for the I130 which takes about a year and continue to use your p1 to enter and leave during that year.

NigeriaorBust got a reaction from Markip1 in Should I call ICE About My Roommate's Sham Marriage?
I think that entry to the US should be reserved for those that follow the laws , all the laws not just the ones that are easy, I think there should be no immigration reform, all illegals should be deported with a lifetime ban, no forgiveness of overstay, no waivers for criminals( which would automatically include illegals) . I also think that welfare should be done away with and there should be no minimum wage let supply and demand control wages. Also end bankruptcy and make debtors pay off the debt they incurred. Teach only English in schools and only issue high school diplomas to those that can pass a standardized test in English, math and science. There probably isn't one bleeding heart on here that agrees but I feel that is why the US is turning into a dump of lazy fools with their hands out for a free ride.

NigeriaorBust got a reaction from Dashinka in Repercussions for marriage fraud for US citizen
Marriage fraud is common in the US even between citizens.  People marry without love to share health care benefits or housing.  Being from I high fraud country I have met people that have done all sorts of fraud just to come to the US and it has gotten worse since this country is no longer in the DV lottery.  Federal courts are tied up with a lot of more important cases and they will take little notice of the USC that pockets a bit of money to marry for a bit. Unless they are doing this in a repeatable pattern it would be hard to prove it wasn't just a marriage gone bad after the non US partner simply sent their money to the US through their spouse.   At the state level there is little about marriage fraud on the books and it is not a crime they chase after as it is hard to prove.  Are there scary sounding penalties against this , yes. Do they actually go after anyone under that statue. not often.

NigeriaorBust got a reaction from Mike E in Minor Passport- fATHER REFUSED TO SIGN CONSENT
The requirement for both parents to agree to a minor's passport is a law that is designed to prevent a parent from getting one and leaving to a country that is resistant to shared parenting.   You are actually supposed to have written permission to take a minor child that isn't travelling with both parents.  Full custody will not remove the passport requirement.  You can either get the father to agree or get a court order specifically dealing with the passport issue.

At this point there is no undoing your lie.   You will be extremely lucky if your record doesn't get you a permanent bar to getting any visa to the US.  You didn't bother to adopt the child when the father died and make things right.

The dates that count is from when the petition get accept and when it is approved.   The time between these 2 dates is how much time you take away from the age of the kids when the priority date is current.  Using round numbers if you submit today and it is approved in 10 years and goes to storage.  If the priority date ( today) become current in 15 years  each child removes 10 years from their age on that day to see if they are "under 21"

Overstays are different than illegal entry.  She snuck in so there is no forgiving that.  She has been out of the US for the length of her ban so there is no ban.
