    Concerning the labor-certification rationale for a family visa refusal, a consular officer in Guangzhou wrote:

    Visa Officer Marc Cook: 212(a)(5)(A) is a proper ground of refusal for IV applicants who are determined not to be eligible for the IV category under which they have applied. For example, it is used to refuse family-based IV applicants when it is determined that the requisite family relationship does not exist (e.g., a marriage to circumvent immigration law, or DNA tests establish lack of paternity/maternity). A 212(a)(5)(A) refusal is appropriate in these cases because, once the alien no longer falls within a family-based IV category, the alien is no longer exempt from the labor certification requirement that would otherwise normally apply to immigrant applicants.
    So DOS uses 212(a)(5)(A) as a ground to refuse a family or K1 visa. It doesn't seem logical. But make a note
    of it and save it for future reference. In my experience, these are not fatal. They are somewhat analogous to 221(g)
    refusals and they can eventually be overcome.

    Stay on top of your case during your stay in NVC so you catch an RFE as soon as it pops up.
    IF YOU ARE NOT SURE THAT YOU HAVE AN RFE, USE CAUTION. The RFE advice below is under review. A VJ member has reported that they know of instances where sending in RFE information has delayed cases. We are waiting for specific information on these instances, and until such time we caution all users of the guide to use their best judgement in responding to a "possible RFE".
    If you review your packages, you might even find an RFE before NVC does, and can send the correction at anytime.
    When reviewing your package, it's helpful to know some common RFE as linked here as well as searching the forums.
    If you are issued an RFE, send the required documents.
    IF YOU CONFIRM WITH NVC THAT YOU HAVE AN RFE, DISREGARD THE WARNING ABOVE.
    BARCODED cover sheet you printed from the website, but when addressing your package, change the Attention line from "ATTN: CMR" to "ATTN: DR"
    Your own Cover Sheet listing the documents you're sending and reason.
    Include the documents missing or corrected based on operator suggestion and your own common sense.

    In 2004, had Kerry gotten 60,000 more votes in Ohio, he would be president, even though Bush got 3,000,000 more votes than him. It goes both ways and it serves a purpose, to prevent 20 large cities from deciding what happens to the rest of the country. I think the US should never determine elections by popular vote alone. I'm not saying I'm completely opposed to changes, but if anything gets done, I think it should just be so that more states are not winner takes all, maybe be more like Maine. Otherwise, I like the idea of states voting for president and not people when you're talking such a big country. You can't determine an election result based on such narrow margins with the popular vote, where for all you know some intoxicated college kids in an uber liberal large city like LA could tip the results in favor of one or the other.

    Im a Democrat and im ashamed of all the riots And protest burning flags....this is insane.
    If people had issues with the electoral college they should have dealt with it before not now.
    Now if they wanna change it now for future elections thats great.

    Bad idea. Things are grim now, but I just don't want to think about what would happen if Trump was cheated out of becoming President.

    You didn't quote anyone so not sure who you disagree with exactly. Assuming you disagree with me;
    It's not complacency. It's accepting our country and our "democratic" process. Unless you want to protest and argue that he won illegally, just arguing that he "isn't your president" because you didn't vote for him is wrong. That is not how a democracy works. You don't vote and then only respect the outcome when you voted for it.
    As I said, if they want to protest some of things he wants to do, that is perfectly fine as long as it isn't violent. The #notmypresident hashtag though is basically a bunch of people saying that while they love that they live in a democracy, they only like it when they agree with the outcome.

    Hillary denouncing them is pointless since they aren't her "supporters" anymore. She isn't running for anything so she has no "supporters".
    They really do need to stop though. Honestly I voted Clinton and I don't like a lot of what Trump said he was planning to do, but protesting and claiming he's "Not my President" is a pointless endeavour, and disrespectful to our political process and our country as a whole. He is "your" President (or will be). That is how democracy works. Protest the policies, but don't protest his election.

    Im 36 born in NYC to illegal Dominican parents....lol
    I don't stand for racism or anything but I support Trump...why because he was elected.
    I voted for Hilary because quiet frankly there was no one else. I almost went trump at the polls but i'm in a blue state wouldn't have mattered it seems.
    I honestly began to think hey maybe he is what we need someone who will call BS to your face with a smile.
    I want to see these cabinet members trying to tell trump what to do and where to go....

    Im democrat today on the drive to work i was thinking....how dumb did Clintons campaign think we were....reason...why is it just as he runs for office all these scandals come out??

    These are the same people that as kids we stopped keeping score at AYSO games, everybody got a gold star, and we stopped giving letter grades. Coddling these snowflakes leads them to believe that there is only one way and they are entitled to get it. They also believe in free speech as long it agrees with what they believe. As far as I can recall, one side was always unhappy at the outcome of an election. Just don't recall people protesting for days and days. And on Saturday night I saw on the news that when they got to City Hall in L.A., they unfurled a huge Mexican flag. Those are the kind of antics that got Trump elected.

    I think 90%of the rioters didnt even vote they are the crowd that complains when stuff isnt done for them....
    BTW I voted with my party democrat but im CONTENT on having Trump as my President.

    Obama has been clear regarding the peaceful transition of power and made efforts to assist the incoming Trump administration. The violent protesters represent themselves only, not the Obama administration, Hillary Clinton, nor the Democratic Party.

    There you go. Well I think, if I'm following your rationale correctly, Hillary has condemned violence against Trump previously, and she has spoke out about violence in general, so does she really have to do it for the millionth time. Amirite?

    I don't think Hilary wants to be in the media, for her it's over. She conceded. Just because these protesters think that they'll change anything doesn't mean that her concession will be overturned and she'll be eligible for presidency again at the snap of some fingers.

    That and would you want to admit that the people who had your support are really just as volatile as the support of the opponent?

    I don't think they'd listen to her now, in her concession speech she said "This loss hurts, but please never stop believing that fighting for what's right is worth it.
    It is, it is worth it. [Cheers and applause]
    And so we need — we need you to keep up these fights now and for the rest of your lives. "
    One of the big things I've seen a lot of people saying, is that they're simply fighting for their rights, fighting for what's right, keeping up the fight. I've even seen one person call anyone that DIDN'T vote for Hilary, an enemy that everyone should fight, even if they're your friends or family. When you say the word fight, you're going to really need to hope the listener is smart enough to know how to fight constructively.


    I know here in Texas, there was a 12 year old boy was beaten up simply for voting Trump in a MOCK election at school, then some mom in Houston I think kicked her own young son out of the house because he voted Trump in a MOCK election. The boy was little, CPS stepped in, the mom said it was meant to be a "joke" and she was absolved from any wrong doing.

    Not saying all Hilary supporters are ragers, or that all trump supporters are, but there are definitely enough radical ones on each side that are putting a pretty rough stereotype onto supporters on each end right now.
