I feel sorry for the girl. It's always hard to move to another country. The last thing you want is to have an old illiterate dude (a.k.a. husband) with a lot of personal complexes who doesn't give a dime about your cultural shock and homesickness. Looks like you brought another "exotic" toy to brag about among your friends (and even here on forum) and to your surprise figured out that she is a person with her own feelings and dreams.
I absolutely sympathise Dave&Rosa's approach where the husband actually cares about his wife and is opened to talk about the situation, and support her. But I guess he didn't bring a "hot chick" or "exotic bartender" but his beloved wife instead.
I also do hope that the girl will stay in the US and build a good family with someone who admirers and loves her for who she is.

You could also just wait until you are back in the country. There is nothing saying that you must file on the soonest date possible.

it depends how did you entered the states,
i couldn't see your time line to learn more about your history,
but I was guessing you are the beneficiary applying thorough your USC spouse,
when I interviewed for my naturalization,I was asked to provide at least 4 evidence for ongoing relationship between me and my USC spouse,
I had 3 things that time after I passed the test the officer asked me to mail him more.

No.. I don't know how you worded the above wrong, you're quite clear that you amended returns to show you're married 2 years before you are. This is tax fraud.

I suggest you amend your previous tax years status if you did file as married when you were not. You more than likely got a bigger refund as a result of filing as married, which would mean you need to pay the difference back (which may include additional interest and penalties). Whether you take my suggestion or not is up to you, but that's what I would do if I were in your shoe (I also would hold off spending the fund from the refund check).

The OP lives in a Western country, not China. She's an adult and can legally move out on her own. If she chooses to live in someone else' house, then she needs to realize that she needs to live by someone else' rules.
When you can afford to pay your own bills (read: RESPONSIBILITY), then you can set up your own rules and play in whatever way you want.
When you don't have the guts and the means to do the above, then you're NOT ready for love. Period.
Because what comes after love is having children and that requires lots and lots and lots of responsibility and a heavy dose of reality.

Actually USICIS suggests not to wait for rejection or RFE, but to collect all supporting documents and send it with a copy of your NOA on top. It will save a lot of time and hassle. Wait for the NOA and send everything to them. While your case will be waiting for the review, the officer will find your file and add your new documents to it.

What?? No that's not what its about at all..... She got very lucky.. OP: This easily could have been a case of uprooting someone who changed their life to come be with you in a new country only to have you say "sorry, I made a mistake.. I led you and myself on for 8+months.. I'm bailing so it sucks to be you" ..... you did wait three whole days.. You could have ended up ruining someones life, instead you got lucky because your choice turned out to be dog who deserved it so it saved you having guilt.

Thats a little harsh to say you doubt he will get the visa that is not very nice. Further more the OP asked one simple question and everyone has offered good advice or good opinions but the OP asked if and when he is granted the visa can he divorce once he gets here and marry someone else? To answer your question Slumdog YES if you do get the visa and you arrive in the USA you in fact can divorce and marry someone else...The OP did not ask for everyone to judge him seriously people sometimes the unsolicited advice here can be a bit much.....Goodluck to you slumdog!

By the way, received my evaluated diploma from ECE the other day. "The US equivalence of Master's in Aviation engineering with specialization in Air Traffic Control". Just have to figure out what to do with it now
