    Wrong! Yes you can travel on a different pasport once y ou leave the usa.... however You MUST enter the USA on a USA passport if you are a citizen....

    Did you send in the letter of employment and pay stubs that show how much your spouse gets paid? If the income exceeds the amount, I would contact NVC and verify what documents they need and send them.

    My husband is from Italy and there too, it is common for women to keep their family surname. I am also a photographer and my name is my business and my reputation is built on my name. So all that combined, I did not change my name. We have been married for over 6 years and I have not had any issues. When we have children, they will take my husbands last name, but for myself, it does not affect anything. I think it is a personal decision and if it is not an issue for you, the husband nor her, the wife, then it is whatever you wish. For legal reasons there is no issue except that I have found at customs, since we have different last names, they want a customs declaration from each of us....

    But part of moving on is also taking responsibility for your part in decisions... It takes TWO people to get pregnant... It is not just a case of HE got you pregnant... Pregnancy takes two people, if YOU did not want to have a child, then precautions should have been taken, therefore, it is also your responsibility to take ownership of of your decision. Sorry, but this is a sensitive subject when I hear women blaming HiM for,getting THEM pregnant. Unless it was a forced sexual encounter, then you BOTH had a part in it... Just as your tolerance to his cheating and forgiving him time and time again has put you in an terrible position... When you take ownership of decisions, you can learn and progress.. And make better ones. I am not meaning to be harsh, but you see the man for who he is now, divorce and move forward... Be strong... Learn from the mistakes you made, not from the ones he made...

    To the OP... Many VJ users will put forward the concept of "lifetime bans" "not fair to others" "hurt others chances of tourist visa" "you have to prove not intent" as well as other arguments to scare you and deter you from this decision. Bottom line, the law exists that allows for couples to spontaneously marry and adjust status or to AOS from other visa categories... What cannot be done is to enter as a tourist with the INTENT to AOS and circumvent immigration laws... Some see this as not fair since they are doing the correct way, but life is unfortunately not fair for all, but not fair and illegial are different animals and based on your info, what you are thinking of is legal and in many cases the route suggested by uscis (when you call them for info they give this advice to many) and attorneys every day... Good luck on your journey...

    No, buying health insurance or subsidy is not considered a public charge. Pit obamacare or ACA in the search tool here on VJ and there are several topics which address this and detail how it works (and doesn't work) with regards to immigrants.

    Getti g insurance is going to be difficult and expensive.... My mother has ESRD and is on dialysis... Prior to ACA (Obamacare) she had no insurance options... Just basic Medicare, she is much older than your MIL, but we were looking at $3000 a month with $25 per dialysis deductible... Look into the insurance options before you get too far in the process or get anyone's hopes up.

    Unfortunately, there are soooo many cases where a mother "visits" the USA to see the grand baby and ends up never going back. The evaluation process is partially based in the actions of others and PHL has a hi rate of family members who do not return and decide to stay n the USA. This is factored in to the decision. Sorry

    Livi g together can create an issue... Your should never be alone with her as there are many cases of false claims of abuse in order to file VAWA... Once she finds put you are filing for divorce and that she has NO other options to get GC, desperate people do desperate things... Protect yourself... Leave the house, file for divorce...

    If it does get brought up and he is like "huh" who's that? It WILL raise red flags to USCIS and eventually it WILL come to light... You did not choose your name, YOU did not choose your relatives so I don't really see the big secret... He will probably be a bit hurt that you waited this long to tell him, and he will will probably think hiding was silly... But get through it... Don't start your lives on lies and secrets...

    Being a jerk of a guy is not the same as being fraud.... He can file for removal of conditions without you based on good faith marriage so no reason to pull the VAWA abusive spouse thing... Send his daughter back, divorce and change the locks if it is your house... As I can see, it is more if a case of him being an a$$h0le not fraudster... Sorry but time to pick up,the pieces and start fresh.

Why would I give advice on a process that he did not even say he wanted to pursue? So my advice is not incorrect... Now IF he were to ask how to file for AOS, the. The response would have been different... But he seems to have an idea in place and want to do things the traditional way with her processing from her own country and I gave home the appropriate info... Others seem to be pushing him to "change his mind" and try for AOS ... Which I happen to think at this point could be a risk for him.

    Thanks! Much easier... welcome to the forum... When you say December, I hope you are not thinking December of this year? As that is not a realistic timeline... As a general rule, the k1s take 7-9 months from filing to visa issuance... Sometimes you get lucky with a quick uscis approval, but then the rest takes another 4 months minimum... You will interview in your home country... I would say a more realistic timeline if you are able to get all your paperwork in by the end of September is April-June timeframe...
    Read up on the K1 visa guides at the top of the page to familiarize yourself with the process..
    Any he is now your Fiancé not boyfriend as there is no boyfriend visa... Good luck

    It also helps if your name does not match anyone on a watch list or that is common to many others... It also helps if the country you come from keeps consistent records that are easily researched and accessed to make security checks faster...

    Your post indicated you wanted to know if people think it is marriage fraud (asking for opinions), many here have ansewered that based on your timeline and things you wrote that it does not seem like straight up marriage fraud and you have attacked everyone who did not agree with your view that it was premeditated fraud. Was he a bad and possibly dangerous man and husband and abhorrent father, yes of course.. Did he hide his true nature and put only his best foot forward... Yes,. But proving fraud to uscis is another matter entirely and based on evidence you presented, it will be difficult to prove that. And it is my firm belief that there are signs in people and gut feelings that many times are ignored or overlooked... But To not look within ourselves when something like this happens and to just write it off as a calculated fraudster that we were helpless to recognize is an easy excuse for not learning and growing.
    If you wanted only to hear "oh yes girl, he was fraudster and you had no way of ever knowing" then perhaps you should have titled your topic "Marriage Fraud, need people who agree with me, " not asking for opinions, cause you might just get different opinions that don't agree with you.
    I do hope that you are able to get and keep safe, move forward with your life, help that young lady with hers and not be overwhelmed by revenge or hatred and find real love... We always learn more about ourselves when a relationship ends than we ever do about the other person...
    So flame away cause I did not agree with you... But I still wish you luck...

    This sounds like a very stick situation an a waiver/waivers are most definetly needed... I would definetly get a lawyer... And my opinion for anyone else reading this... That allowing your significant other and mother/father of your children to risk being detained, deported and not allowed back to visit is irresponsible at the very least... Protect your family and children from undue stress and hassle by making sure you don't leave them vulnerable... I do wish you Good luck and with proper representation, I hope you can straighten this out...
