    Your circumstances have changed since you entered the USA. The burden is upon the USCIS to prove that you committed fraud, not up to you to prove that you didn't. You may adjust your status if it is now your wish to stay in the USA.
    Everyone else that says you cannot AOS, is wrong. Boiler is quite correct. Nor do you need to be here for XX days to do so. Circumstances could change the day after you entered the USA and you want to stay. The point is the CBP let you in, you truthfully can say you did not intend to stay in the USA, and you can AOS to your hearts content as soon as possible if that is your wish.

    She can't file VAWA because She didn't get married. She does not qualify to file U visa,because in order to have a U visa approved she must submit a CERTIFICATION signed by the police or prosecutor stating she was a victim or witness of a substantial crime and helped Law enforcement with the case .

    1- The overwhelming majority of applicants are approved.
    2- Even if something does go wrong, you'll have a green card that allows you to live here permanently, and Canadian passport that lets you visit most of the world. That's a lot better than most people in the world!
    So don't stress about this too much.

    The US government has a "file" on everyone in the US, everyone who has visited the US, everyone who thought about the US, and a lot of other people. Remember the issue when WikiLeaks released files and we found out the State Department had been instructed to obtain all information including passwords, credit card numbers, etc. on UN members.
    There is no way the US government is going to send you all the information they have about you. First it would involve hours of searching due to different agencies having information. Second there is no way you will ever know if they have disclosed everything. By requesting a copy of the information they will not destroy it they will make a copy of it and mail it to you thus creating more opportunities for your information to be stolen. But the US government will always retain a copy of your information.
    The confusion comes about when you say you are requesting information about yourself so you can destroy it. There is no sense in that statement. If I have my social security card and make 10 copies of it then destroy the 10 copies there is still the original in existence. I can make 10 more copies and destroy them but the original still exists yet again. Requesting the information will not destroy the original files.

    OP I am sorry to say but your original question was not very clear. It sounded like your wanted to request info for the mere purpose of destroying it. As a result the people responding were mildly shocked because we all know, having been through the immigration process ourselves, or for our loved ones, that the US government keeps information about you forever, literally from the moment you applied to US for the first time and through to you becoming a US citizen. The immigration record will never be destroyed, closed, or cleared in any way.
    Yes you are absolutely allowed to do a FOIA request, I am glad you have been provided witht he appropriate venue to seek out that information, sorry I am kind of coming here after the fact. Just FYI it may take anywhere from 4-6 months to received the actual info. Speaking from personal experience

    Why don't you keep one or two ilegal in your home and feed them and while doing that please call their parents and grand parent, uncle, aunt and take care them as well.
    Houston alone has 4000 ilegal in school system this year. Do you understand the implication of that?
    Nothing is free in this word my friend and When you handout someone something it has to come from somewhere either from your pocket or mine. Obama or any goverment do not produce anything.
    They are just facilitator.

    How about the fact that these illegals are being treated as priorities, and will likely be so treated throughout their application processes (inevitably, they will use different forms, easily identified at intake)...do you really think our visas, greencards and citizenship won't be bumped or affected in some negative way? Who is going to hire and train these new people that USCIS has to hire...generally that is done by existing staff.
    The opposition is that preferential treatment is being given to those that violated the system rather than following it, and that the illegal immigrant population has more voice than the citizens trying to legally bring in their families. It will do very little (at least in anything like the foreseeable future) to improve service standards for those of us that followed the rules.

    Apparently..Only people who are here illegally miss their families and loved ones.
    Those who wait for years doing it legally and see their loved ones arrive as adults after having left them behind as babies and children should be understanding..cause they cant walk across the seas like those who can simply walk across the border. And if they wait so long doing it legally and they pass away as is the case with elder family members all too often...who is their to take care of them, console them and make them feel better, and give their family members work,assistance, and financial aide? For those long term VJ members who have read their posts..they are the forgotten. My prayers go out to them because they "Had" to follow the law..seems as though law only applies to those who cant walk acrosss an invisible line called the "Border".
    Best Wishes To My Friends and those here on VJ Doing It Legally Even Now..and who have been waiting for months, years, and in some cases Decades..I only wish your loved ones could walk on water..Bless You All.

    There are only three ways this is possible:
    1- she derived her citizenship from another relative whom you are not aware of (an American mother or father).
    2- her husband is doing "special" work for the U.S. government that you are not aware of (not necessarily military).
    3- she has done something to assist the US in terms of national security.
    The race of the husband is irrelevant.
    The nationality of the wife may be a factor... there are certain expedited classifications for people who have played a role in assisting the US in countries like Iraq.

    With a k1 you have to commit to marry within 90 days which moves you out of the boyfriend category.
    Otherwise it seems that there is nothing particular about the case which would cause problems.

    I-134 is not legal binding.
    She and her son will be out of status once I-94 expires.
    If you do not wish to marry her, then offering her and son tickets back to Philippines will be a gesture of goodwill.
    If they choose to stay in US after I-94 expires (without marrying), it is out of your control.
    They can only get green card through AOS with the original petitioner which is you.
    Probably you wouldn't want them to stay with you together, to prevent false abuse allegations.

    why should they be fired? They were doing what they are paid to do, weed out fake relationships. I attended my husband;s interview with him and we were both questioned in depth, neither one of us had a problem with it, it;s part of the immigration process and if your relationship is real there is no reason to be nervous. Pakistan is a high fraud country, not only is it a high fraud country, it;s also crawling with terrorists who would do just about anything to get to the US. As a US citizen you should be happy that the consulate is doing it's job. Would you rather have them not question people and hand out visas to people just because they ask? The fact of the matter is this couple has a non traditional relationship that goes against cultural norms in Pakistan, that is why she was questioned so much. The CO's job is to make sure scammers don't worm their way into the country, and I for one, have no problem with that.

    A couple of incorrect things posted in this thread.
    The USC petitioner/sponsor is NOT included in the household size of the joint sponsor unless the joint sponsor claimed them as a dependent on their most recent tax return. The joint sponsor is signing to support the immigrant, not the USC. A USC does not need a sponsor.
    Also, assets for a joint sponsor need to be 5 times, not 3 times. 3 times is only if the immigrant you are sponsoring is a spouse or minor child of yours. Everyone else needs 5 times.
    You fill out your own I-864 as the USC petitioner/sponsor. Your household size is 2, you and your foreign spouse. Have one parent fill out their own separate I-864 as the joint sponsor and the other parent fill out an I-864A as the household member to go along with their spouse's I-864. Their incomes and assets will be combined in that case. The household size will be 3, the parents plus your foreign spouse.
    Info about how to count household size and use of assets can be found in the I-864 form instructions.

    Then you have a big problem. You NEED to have the other parent notarize a letter allowing the child to permanently immigrate to the US and to revisit to the old country and then return to the US.
    Or, you need to have a local judge grant full guardianship to the mother if the father has vanished.
    Either of these MUST be in place before the child will be given a visa.

    To sum up:
    Option 1: Get married now, in the US (nothing illegal about that) - stay here and apply for Adjustment of Status. This is the quickest process. You'd probably get the green card within 6 months. You can apply for an Employment Authorization Document at the same time, which is usually approved within 90 days. You can also apply for Advance Parole at the same time, which allows you to leave the country and come back (you need this permission, otherwise any time you leave while your adjustment of status is pending, they will count you as having "abandoned" your application). Upside: No time apart - overall a quick process. Downside: you're not going to have this permission in time to travel for Christmas, so basically you'd be stuck here.

    Option 2: Get married now, in the US (nothing illegal about that) - leave and go back to Canada. Start the process to get a CR-1 spousal visa. You can visit while all that paperwork is processing, but you won't have the actual visa for over a year most likely. Upside: you're a green card holder upon entry after getting the visa - no need to adjust status after you arrive - you can get to work and travel right away. Downside: takes a long time.

    Option 3: Become engaged. Go home to Canada. Star the process to get a K-1 Fiance visa. You can visit while all that paperwork is processing, but could still be nearly a year before you get the visa. The visa is a one-time-use thing - you enter the US and have 90 days to get married. Then you have to file for Adjustment of Status in order the get the green card. With this too you can apply for Employment Authorization Document and Advance Parole. About 6 months to get the green card, but would likely get the EAD/AP within 90 days. Upside: Usually quicker than the CR-1. You won't be spending your first year of "marriage" apart (this matters to some people - it would have mattered to me, personally) - you'll just be engaged the whole time. Downside: still takes a long time, and those first few months in the US being unable to work or travel while you wait for EAD/AP can be very tough on people.

    If I were you I'd take Option 1. If you entered the US without planning on getting married and staying, then you haven't broken the law. Lots of people object to this "back door" being available, when they've followed the conventional route and are waiting months to be together, but that doesn't change the fact that the option IS open and IS legal. But it's up to you if you're willing/able to spend the next few months unable to leave the US while waiting for Advance Parole.

    This is reckless advice. In the face of a Stokes interview, there is everything to worry about. "Real" couples have no immunity against the CO's absolute power.
    To the OP: Germany is not known as a high-fraud consulate. However, if a Stokes interview is demanded, the beneficiary might be given a 221g at her interview, and your presence can be demanded at a second one (the Stokes).
    There are no drawbacks whatsoever to the petitioner's being on the consular premises (or within physical shouting distance of them) when the beneficiary is being interviewed.

    Welcome to the internet.
    It's not exactly hard to work out that sympathy is going to be low for a man that was deported for trafficking drugs. I sympathise with his wife and kids but wanting someone like that back in the US is a bit much.
