The visa you applied for is for a couple to be together, yet you are no longer a couple. You have posted on a public board monitored by immigration and you are destined for AP where they will look at things closer. Is your soon to be ex still willing to sponsor you ? Does she know that she is on the hook for the affidavit of support long after you will be lying in the arms of another woman. If you sign divorce papers right after getting to the US you will be trying to remove conditions with no proof of have a valid relationship. Getting to the US is not the end of the battle and you are almost sure to lose your green card if you get it in the first place. If you want to do the right thing , which I doubt you do , you would call off the current interview, divorce the current wife and start a fresh and honest immigration process with your new love. If not you are no better than the 419 boys that Nigeria is known for. It is the type that scam their way through life that gives Nigeria a name good Nigerians hate. When you extended your stay from 2 weeks to 3 months that was a major flag that you provided misinformation. Did your ex bf telepathically sense that you were coming to the states and the day/ time to be at the airport. And of all places to "visit", you just happened to pick a city near him. Stop it!

Instead of worrying about something that is currently out of your control, start preparing for the post-NOA2 activity. Get your tax transcript ordered, line up the letter from your employer, put together the ongoing relationship information if that's required of the embassy...

It sucks for her but I'll be honest and say a MONTH in and she has somewhere to live and a job lined up??? Something isn't right. How many of us new immigrants were able to financially support ourselves a month after arriving? I was planning the wedding and getting settled in... I wouldn't have WANTED to stay after a month either if my relationship failed. That said I was/am here for Tony and not the GC and living in the US was NEVER in my plans before meeting him... some people can't wait to escape their country, I just wasn't one of them but maybe the OP's friend is... you never know.

In relation to your status. Had he passed prior to filing you would have filed with a waiver. As you have already filed I would make an INFOPASS appointment and let them know he has passed and that you need to change it to a waiver filing. You should be RFE'd for the death certificate and have 86 days to supply it. The reason for letting them know is as with divorce if you are divorced while the ROC is processing then you have to change it to a waiver filing and if you don't and the card gets approved on a joint filing when it should have been waiver you can encounter problems later (like with USC).
I would book and INFOPASS and try and speak with the people who produce the death certificates to get it sped up for immigration purposes. Hopefully they understand.

No, you're not correct using the word "should". You SHOULD apply before your GC expires, you CAN apply 90 days earlier.

1. Filing for EAD on K-1 is worthless as if you apply on the day you land you'd receive it about 2 weeks before your I-94 expires and the EAD would expire with the I-94.
2. There is no "Temporary Work Approval when you enter the country" on a K-1.
If she's working it's illegal, period.
