  1. Thanks for subscribing. We wd keep this thread going till we get our Green Card. I presume everyone wd agree and we wd help each other in troubles (if any).   4. we just did our interview yesterday, my husband was on a tourist visa and we did an AOS from that... no probs whatsoever (it does help that he was never out of status and has been using his tourist visa heavily the past 3 years)

    anyway, the interviewer didnt even ask a single question about the tourist visa, mostly just about our marriage.

    Had our interview today. We were verbally approved!! The interviewer asked to see our Id's, birth certs, and marriage cert. Wanted to see my 2008 W2's. Showed her our photo album. She meticulously examined the photos.

    She asked how we met and about our families. Pretty painless actually. Just waiting for the GC in next few weeks.

    Did not stamp passport, but did take I-94 and EAD.

  5. Thanks, guys. I had a class today, so I didn't get in til just now. Anyway, here are the intricate details: We got there at about 12- we left home early, lol and hung out in the car for a bit. I needed to use the restgroom, so we decided to go in about 40 mins early. The security guards told us we need to wait til at least 12:30 before we could go in. Anyway, I got to use the restroom and we went back to the car. When we returned, they did the whole X-raying and stuff and sent us to the reception counter (there are two lines- one for Infopass, another for interview).They scanned the interview letter and sent us in to the waiting room. There were quite a few couples there waiting, along with people waiting for Info[####. In any event, we waited for about 30 minutes-with my husband keeping me entertained as usual, lol, though I did laugh a little loudly a few times, :rofl: .

    We finally heard my name and both my names were actually pronounced correctly, :hehe: . We had a female IO and first she stopped at the copy machine in the hallway and asked for our driver licenses to make a copy. We then proceeded to her office- yes, an office- not a cubicle, like some places. She asked us for proof of citizenship, my social security card and birth certificate and just verified the originals of all the stuff we had submitted. She also asked for Hubby's W2s for 2007 which we didn't have, so I offered our 2008 tax return, W2 and pay stubs for the past three months. While she's punching all this stuff and adding it to our file, she asked me how we met. She also asked about the type of visa I came on, my internship and the place I did it. She also asked if I had completed the two yr requirement- I gave her the waiver approval (which she kept).

    We were then asked for proof of shared life. We gave her all copies of our joint stuff- bank statementS, health and car insurance, etc, lease, bills. Which she didn't look at, just punched it and put it in the file. She asked if either of us had been previously married, any children other than the one we are currently expecting and all the yes/no questions from the I-485.

    Then she asked to see pictures and I asked what kind did she want to see. She asked what kind we have and hubby says "well, we have three albums". We gave her all three and she looked at a few wedding pics. Her reaction was "Oh, a real wedding. All we see is courthouse weddings." :lol: So she looked at probably three pages and asked if I had copies. I told her there were already copies in the file, but we had a couple loose ones, which we offered. She pointed to a pic with both of us and my aunt and asked whose mom that was, and I said, that's my aunt. She also asked Hubby to show her his family in the pics. She also asked where we honeymooned.

    After that she verified our address and compared it to what she had in her system and asked to which did we want the card sent :lol: . Then it was housekeeping- she gave me the approval letter and the letter saying we had been notified about removing conditions, which we both signed.And that was it, :lol: As an aside, when we were putting back the albums in the bag, I had to remove all the letters and cards we had brought to make room. When she saw that she was like "Wow, you certainly brought a lot of documents. You were well prepared- one of the few." So, anyone with upcoming interviews- it's better to be over-prepared.

    Yes, since they didn't approve the AOS, since you came here as a visitor. I take it you were not married prior to getting here? Or were married, but didn't acknowledge that when you entered the POE? Which was it?

    According to the rules, your not suppose to attempt to change your status from visitor, and if you do so, you will need to prove your intent was not to get married/immigrate, but to visit.

    It seems you cannot prove that, so they are allowing you to continue it back home to get the correct visa for your situation.

    You should consider yourself lucky, some people get bans for doing this.

    You do have an opportunity to contest this though, by contacting the USCIS, but I would contact a lawyer if you go that route.

    You were not denied!!! Did you send in form I-485 with your I-130.

    Dont pay any attention to what Umet posted, she doesn't know what she is talking about.

    Describe what forms you sent in and elaborate on your case. You can write in portuguese if you want. Eu falo portugues.

    Thank you for your reply. The link you sent is pretty vague about the circumstances of the case.

    I am not too worried about the interview. My wife still has strong ties back in her home country and did not intend to immigrate. We married over 4 months after she arrived here and we have plenty of evidence to prove Bona Fide marriage.

    Evidence I visited her in her home country 10 times

    Evidnce she visited me in USA 7 times

    Postcards to each other.

    Flight receipts

    Do you think that is enough?
