SSA policy on name changes doesn't mention the DHS.

No, never ever do that. If you want to change o your spouse's name the that's  the name you use on your AOS application. Changing the name on the greencard later on will cost over $500.

You always use your legal name. If you want to use your spouse's name after the wedding, then that's your legal name no matter if it's  on the actually marriage certificate or not.

    Hello,
We got married in Florida and my certificate states my maiden name also. I filed all my forms with my married name, as I intend to take my husband name. I wanted all my official documents to have my married name. Also I’ve heard changing after is  costly.

The forms ask you to write any previous names you have been associated with, so that’s when you can write your maiden name.

Good luck with it all !!

It is the same thing in New Jersey . Our marriage certificate has my wife's maiden name written on it . She was able to use my last name on her SS card, DMV, IRS but when we filed for forms I 485, I 751 and eventually N400 my wife used her maiden name since we thought we had to follow what was written on the marriage certificate and her Phil passport.   If we had known at that time that it was OK to use my last name we would have  avoided the hassle that we are facing right now.  My wife recently passed both I 751 and N400 interviews.  On our N400 form we requested  a change of name (i.e. my wife to use my last name) . However we were told by the interviewing IO,  in Santa Clara county , Ca, they don't have any judicial oath taking so if my wife wants to take up my last name on her nat cert we have to go thru  the local court first then re apply for a new naturalization certificate ($$$) . She still can use my last name on the other legal documents per the IO . However  for  her naturalization certificate it will have to be whatever is written on the marriage certificate as this is the document that USCIS will follow.

The marriage license is the document that is enough to show the name change.

The marriage certificate plus using/claiming the name is sufficient. I know it may sound a bit strange that you just start using a new name without any documents showing it yet, but that's the way it is.
Additional evidence of the name change (state ID or driver's license, Social Security card, an EAD, a green card, bank accounts, credit card accounts, insurance cards, etc.) will come over time as you are able to change them.

Yes that’s my understanding. Once you have green card then change your name with social security Administration, drivers license etc. I can’t think of a single thing, need or necessity that you can’t get, obtain or accomplished being married but still use your birth name for the short time period during filing AOS and greencard.

VanDerFran reacted to geowrian in Married or Single Last Name on AOS forms?
You complete all forms with your current name. There is no "single name" and "married name". If you alter your name via marriage, that new name is now your current name. The marriage certificate is a legal name change document.

Whatever name you put on the I-485 is the name they will issue the green card in. Changing the green card name afterwards is performed via an I-90, which is an unnecessary several hundred dollar cost and added wait here.
Same for AP and EAD - they will issue it using the name on the I-131 and I-765 respectively.

PA does the same - it does not list any name changes. The certificate is still valid evidence of a legal name change, and was recognized by USCIS just fine.
There are limits on the allowable name changes via an MC (i.e. you can't change your name to anything you want...check state laws for specifics but the common changes like adoption of a surname are fine).

I just sent all my wife’s forms for K1 AOS , EAD etc and all with her birth name...your going to find wait until green card to change names atleast it’s my opinion, why worry with something not matching? I live in Florida and our marriage certificate has her birth name

A number of states does this as well at least I know NC does it. When my asawa and I got married then filed for AOS we used the married name on everything for her. Just go with the married name and you will be fine.

The cos processes 221g in there non scheduled window time.  It all depends on how many are on the cos desk in front of you.   Typically weeks not months.

AP is a black hole to say the least it could be days, weeks, months, years....all you can do is wait it out, and there is nothing that can be done to move it faster.

    Good luck.

Of course .. that is the job of the CO - interview the applicant, make a decision.    The case file is reviewed again after the interview - which is when everyone experiences AP for a time.   But the CO for the interview is the almighty OZ..

The interview is 3-5 minutes long, which is why I also believe the pre-screen'er plays an important part in the process.

Scarrry!! Does that mean the k1 visa approval relies on the hand of the CO we'll be assigned to? Are the interviewees randomly called? Whew 😲

Sounds like having the petitioner present during the interview helps a lot, especially if the one being petitioned is the nervous type.

Love and caring are not visa requirements.

The officer might have wondered about how much do you really know you fiancée - with so little facetime, they might have found something in the background check that you don't know.  Next time, I suggest you be present at her interview to show your support and that this relationship is important to you.

Maybe it was my other two wives I'm still married with and the dead body's I keep in the basement or that my fiancé is a chaterbate star that has done human trafficking in her spare time lol
Kind of funny the conspires theories, I kind of wish their was something so then I would deep down get why.

This was the perfect sinaro that they had no reason to deny we just got a on a bad day and thats the process.
Anyone ever been to the DMV in the US and were treated unfairly or rudely, of course you have, what did you do wrong?
did you steal from your teacher in the 3rd grade? they don't need a reason they are marginal workers with a little power over you that day.

She is 22 and I'm 48, so? that not a requirement, to be closer in age.
She was never married and has no kids, she has a job in a law office doing IT. I had her stay working so it would show thats she is not a scammer and supports her family because she does that ( and she has 2 older brothers and parents that she is the main support and a young age she started that).
They didn't even listen to our story and show her respect to pay attention. This fat pregnant sat with a coffee in one hand looking away and kept cutting her off when she was trying to talk about love and caring.( you know those the real visa requirements)

It's so ### backwards, they should have a review of 3 people if the CO wants to reject, this is years ago peoples lives and a lot of money to just dismiss it like it was a ###### learners permit at the DMV.

I was marred and divorced with an other K1 visa relationship from the Dominican republic we got divorced, it happens we are still friendly and life goes on but no rule or condition was not met or exceeded on this case. it was 100% by the book and we got reject for no good reason.

He can get an idea the reason of denial if he know the exact question that the officer ask and what answer given by his fiancee. Basically for this case, the officer doesn't believe their relationship is real. So, the only way to overcome it is by having more face time and provide more relationship evidence next time.

    Cyberbro,

I know it is hard to get the clear info from her, after the denial, but have her calm down, and help her remember all questions and how she did answer.

You described a perfect scenario for a successful K1 visa, but again, what is the age gap, is your ex a pinay also, and related to your fiance, did you meet other girls on the 3 trips, does she or you have other K1 denied/withdraw before,  who file for your divorce and why, any accusation of abuse, any court order/restriction. etc...

Please dont take personal or offended, those are just questions that came to my head,  knowing what was, will help you help you better prepare for the next step.

Dont give up... it is just a bump in the road... you both will be here and happy.
