I am just wondering ... what did you do that was so immoral they wouldn't let you in the USA.
The USCIS has a long list of visa ineligibilities. Crimes involving moral turpitude are on that list, along with many others. The majority are "waivable" based on a qualifying relationship. The only reason the OP needs a lawyer is because the Montreal consulate doesn't understand that fiances ARE qualifying relatives and that they were indeed qualified to file a waiver.

In my opinion Montreal sucks as a consulate. They are confused about laws and answers vary from person to person. There are some mean spirted people working there and I wish I was going through another consulate like London. I've been trying to argue my case with them from 3 months and the more I press the uglier they get. I understand where Ron and Sharon are coming from and now babytiger. It's unimmaginable the misery the consulate puts people through. While I understand why one needs a waiver I don't understand why one has to pay for an action that was committed years ago. Boggles the mind- at least my mind.

Nope- less than a 180 days. I worked on my TN visa and didn't change it for almost 6 months. Jan 18 was when I switched jobs and I went to the border to renew my new TN on July 7th. My math could be off( usually is) but that is less than 180 days/6 months.

If the ban is over and you already interviewed, you should not need to wait for the waiver. But I would assume that MTL is not keeping track of the timing on your case so I would contact them for further direction. At this point, all you need is a "visa pick-up" appointment where you would show new medical results (more than one year has passed), and updated documentation to prove support, etc.
See I tried telling them that and got blown off and I managed to piss off two ladies at the consulate. There's my problem. I don't know how to get them to listen to reason with out pissing them off. It's so damn frustrating!!!!

KitKat, I should start off by saying that I have been blessed with the ability to confuse people easily with my written word. I'm hoping this little blurb helps clear the confusion I caused earlier. So here goes- I had an inital I-130 approved in June of 2005 which got me an interview in Montreal in 2006. When we went for the interview we were denied due to my overstay of less than 180 days, resulting in a 3 year bar. After March of 2006, whenever I checked the status of my I-130 is always said pending, never approved. We had many problems getting our waiver off, but Montreal finally accepted it and forwarded to Vermont. So now, as of July 8th of this year my 3 year bar is over, and I'm thinking that I don't need to wait for the waiver approval. At the begining of July, when I checked the status of my three CIS cases, the only one that ever showed approval was the I-129f.(which was abandoned in favour of the I-130) Than on August 2nd I noticed that our I-130 finally said approved-not case pending. The only case which remains in pending status is the waiver. (I'm not talking to my current lawyer while I seek legal representation from someone else). So I'm not sure if I have to wait for my waiver to be approved in Vermont or if it can be abandoned. The waiver in my opinion is a moot point because my 3 year bar ended. We filed the waiver so I could get into the States before my three year ban ended-which didn't happen. Hopeful, I am making sense now

Ron, firstly I wanted to say I'm sorry about your denial. It's never easy finding out your immigration journey has hit a road block, but I do believe with that with sound advice from members of this forum and from a competent lawyer you should be able to get past the denial.
Secondly, I wanted to say that the advice that KitKat had written is right on, and her recommendation of seeking sound legal advice will help you in the long run. With research into the particulars of your case and sound legal help from someone who knows what they're talking about, should help you immensely. The unfortunate thing about the Montreal Consulate, is all waivers are sent to Vermont and there is no processing time on them.(Meaning they can take as long as they want to process any one waiver). I hope you get assistance from the congressperson in your wife's State, and hopefully they can help you. Not sure if they really can do much in speeding up waiver approval. Best of Luck.

An approved I-130 does not equal an approved visa. It means you will now have the privilege of interviewing for a spousal visa at your consulate. If you have a visa ineligiblity that requires a waiver, your visa will be denied and you will be told if you are eligible to file a waiver. Then you wait for waiver adjudication. If and when approved, a visa is issued.
But that's the thing KitKat. The first time we went for our interview, we were denied and had to submit a waiver for an overstay. The overstay bar has ended. It was over july 7th 2007. So that should mean we're free and clear now and don't have to worry about the waiver. We filed to waiver for the overstay and now that I longer have that bar, I was thinking I should be granted the visa.
Ah, didn't realize the ban was over. But if you already interviewed, you would have had an approved I-130 in order to get the first interview, then been denied. If your waiver was approved, you will be granted the visa. (maybe you're talking about the old I-130 that got to you to the interview in the first place? Also, why did you go through the waiver process if you only had a 3 year ban that was ending so soon? I'm confused!)
I don't have it to show it cause the USCIS site has now changed, but my I-130 never said that it was approved. I'll pull the old documents and try scanning them. I believe that my situation might be a bit different-we interviewed on the 130 but for the last two years when you checked the status of the I-130 it always said pending. Never approved. One of the big things I had to do was argue with the Embassy about was my previous work Visa'a. It was one of the biggest reason the Embassy wouldn't accept our waiver at the time of our interview. It took them over 4 weeks to receive the documents. I was really hoping to find the posts from I believe someone butterfly. I think she was in a similar situation. They wouldn't approve her waiver and they waited out the ban. Anyways, my husband and I have to call the congressman and talk to him again about our case. Something is not adding up. Trying to argue my case about the waiver but no-one seems to be listening.

CONGRATS! WE HAVE OUR INTERVIEW ON AUGUST 9TH!
TALKED TO OUR OLD LAWYER AND SAID THAT HE WILL BE ABLE TO HELP US AT A DISCOUNTED RATE. HE SAID WE NOW HAVE A EXTREME HARDSHIP CASE.
WE FOUND OUT OUR BABY HAS A HEART DEFECT AND PROBABLY DOWN SYNDROME
- HE IS DUE NOV 28TH! WE PRAY THAT HE WILL BE OKAY THOUGH!

Hello again. It's been a while since I've visited this thread but I'm coming with good new's. Our I-130 was approved finally after I've served out my 3 year ban. Still waiting on waiver notice.

I'm the same way when Daisy, my little shih tzu, is sleeping. It's all I can do to leave her laying there. I just want to pick her up and squeeze her to death.
She's just so darn cute!
At least when one is talking about one's pet it's safer, no tongue biting needed.
I love my new pup BUT hate it when she finds cat pop. Yuk. How an animal that is suppose to be somewhat intelligent can eat that is gross, really gross. I know that in my next life, I never want to come back as a dog.
Fortunately neither of my dogs has ever done this. My brother used to have several dogs that ate out of the cat box. He called them kitty crunchies. I thought it was hilarious. My dogs, however, do eat rabbit poop. Daisy thinks it's some kind of special treat when she gets to go out in the yard and scope out all the rabbit poopie. Disgusting! Absolutely disgusting!
I have a hard time letting my pup sleep too. She's so cute. I got a border collie pup. It's amazing watching her grow.
Well my puppie loves kitty crunchies very much. We were over at a friend's and she found their bathroom box. There's nothing worst than pulling that stuff out of her mouth. She even digs for it.

It seems there are lots of us that are biting our tongues. Interesting. I thought people just said what they wanted to on a message board. I think it's cool to learn at least some of us are conscious of our actions.

one more time: THE EXPIRATION DATE ON YOUR TN VISA DOES NOT EQUAL YOUR AUTHORIZED DURATION OF STAY.
You need to know the date on the I-94 in order to know if you overstayed.

KitKat, as far as I know, all one year TN visa's issued to Canadian workers are valid for one year from the date that they are issued. Therefore, Suttons TN was valid until Feb 6 2007. So she had an unexpired TN but for the wrong company when she worked for AA for those two months I believe.
Could be - I don't know all the rules for TNs - I just read the regulations on the travel.state.gov site. I have no idea if overstay is going to be an issue or not, but it sure seems working for another company is a clear violation.
Well my situation sure proves that it is a violation. I'm still waiting.....

You guys are lucky. At least you get to know of a time line. When I call Vermont to check on the status of my waiver, I am told that there is no priority date. MEANING it can take any where from a few weeks to a few months to get an info on the waiver. I have no idea where they are at in the process. It really sucks cause I can't even make any plans. There's no date to look forward too. I've been waiting since last year but got and RFE in March. I wuish they'd hurry it up.
