    The plan of travelling outside while I-485 is pending is not good.

    I appreciate the responses from everyone. I kinda figured there wasn't any way to expedite but thought it was at least worth asking. Hopefully this conflict settles down soon. Her and I have been through the COVID pandemic together and are now facing another major challenge... crazy times.

    It's not a DCF rule.  If the USC  has already relocated to the USA, and is simply on a business trip abroad, there is NO PROBLEM.  We don't know the actual circumstances though.

    I don't see the misunderstanding.
     
    The context in which it is understood that the USC must fly in with or before the intending immigrant is exactly as referenced by myself and others in this thread: when the couple or family have been living overseas together, and are now flying home.  The immigrant uses that one-time CR/IR visa at POE, and receives the 551 LPR stamp.  This process cannot happen if the USC spouse is still living overseas, or is planning to arrive to the US later.  
     
    If indeed the OP's spouse has been living in the US and is simply away on business when he is due to arrive, that's a different scenario.

    I think this is the most important distinction being made here.
     
    The intent behind the rule that the USC sponsor must be in the US or accompany the beneficiary is that the visa is issued for USC to reunify with their non-USC spouse or to avoid separation from their non-USC spouse. When the USC lives abroad, but the beneficiary moves to US it defeats the purpose of the visa.
     
    In this situation the USC is residing (established domicile) in the US and the beneficiary is moving from Hong Kong to join them. It just so happens that the USC is temporarily out of the country.
     
    Not 100% certain, but I think in this case OP might be just fine going straight to the US while his wife is temporarily detained elsewhere.

    Why would you call ICE? This is a USCIS issue.

    Airline passengers have certain rights with situations beyond their control.  These rights have been beefed up during the pandemic.  I suggest you ask the airline to reschedule, as they will probably be held accountable anyway if they fly you to the USA without an actionable VISA.  They may reschedule the flight for you for at very low cost or no cost.   I would also call the USCIS directly at your intended entry airport and explain the situation to them and see what they say.   They may accept proof that your spouse is in transit to the USA as good enough.

    How did she miss the flight if you guys were together?
     
    If I were you, I would go talk to the airline supervisor/ manager at the airport and explain. Tell them that though you wish to be on this flight, you cannot join because of the nature of your visa. Tell them when exactly your wife will catch up or when she will be atleast ahead of you in another flight (supposes he opts for another airline). I believe the airline will work with you. There is always at least one seat empty in an international flight.
     
    With the above statement, you help yourself three ways:
    You do not have to pay reschedule fees. You wife catches up If your luggage was already board on the earlier leg, the manager will communicate and have it held for you at the final destination. In those airports, you can stay there for more than 24 hours while on transit. Just sit next to your departure lounge or go walk around BUT do not leave the terminal. My mom had a similar story in Dubai in 2020. She missed her connection flight because she was sleeping at the original gate but unsurprisingly, the gates were changed while she was in siesta. We had to pay reschedule on her part because it was not the airline's fault. However, she stayed at the terminal for 24 hours till the next flight. That is what I was telling you.
     
    You do not have to go back to HK.

    No need to exit.  Once she files a proper I-485, she will be granted authorized stay in the US.

    Based on the RFE request it appears the petition was pretty deficient when initially submitted.  Any discussion here is just conjecture until you get the denial in the mail and you can understand the specifics

    Important: Did the embassy ask you anything further? Even more important, did the CBP agent ask you anything further, at your port of entry? If so, what did you say?
    Do you intend to overstay your B2 visa? (Correct answer: No, and I won't!)

    This is primarily a DIY site, so you're going to get most people telling you it's not necessary to get an attorney. I would recommend reading the guides available several times and then deciding if you still need an attorney to fill it out for you.

    Rule #1 when dealing with the USCIS is to only pay your fees with a personal check, that way you have positive proof they accepted your fee money and the date they cashed it.
    Rule #2, make a complete duplicate copy of everything you sent in, so if they lose it, don't have to go through all that again.
    Actually not a new rule with the USCIS, an old rule when dealing with the IRS or any other governmental agency for that matter. When dealing with these agencies, the burden of proof is always on your shoulders. With that information, can e-mail that to your senators office and get aid.

    Here is the phone number for the National Visa Center: 202-663-1225 You can call and check status anytime you want. All you need is your number from one of your NOA notices.
    I don't know about the waiting times, but they should be able to tell you if the bill has been mailed or the exact status of your case.
