    I am a little worried now...
    My Birth Certificate is the one my Mother gave me when I left home. It was issued in 1989 and the stamp on the back was faded...
    I did make a copy of both the front and back, but the number on the back was not completely legible...
    I put the certificate # on the I129-F along with the Issuing office.
    I guess the worst they can do is RFE for a better copy huh?

    I want to add that there were no newly discovered reasons, I was there for the last interview, I waited outside the embassy for almost 3 hours and when he emerged with a pamphlet on how to make an appointment to file a waiver I was flabbergasted. We had an appointment, I spent over a year putting together the waiver, he had it in his hand to submit. So I went into the embassy and requested to speak with the consular. I was told to come back in an hour when the US Citizen section was open. We did so, and we spent another almost 5 hours there, talked to several people all up to the Visa Chief, who is the one that told me my husband was never eligible for a waiver in the first place. We did not leave the embassy until after closing that night, and all I got was an apology on behalf of the embassy for the misinformation given to me about the eligibility for a waiver once we were married.
    I understand the law perfectly, and I think it is wrong. I want to petition to change it.
    If you have any suggestion on how the petition should be written I am all ears.
    If you would lend your support and sign it once it is written I would be eternally grateful, and more over, I think it is the right thing to do.
    I do not believe what my husband did warrants the treatment he has been given by our government. He is a good and honest man, and his family needs him.
    I am not asking for preferential treatment, I think this should be changed for all people in this kind of situation to be eligible to apply for a waiver.
    That we be given the opportunity to have our case reviewed.
    His rehabilitation & my hardship be weighed against the severity of the crime, and then let the decision be made.
    The whole thing makes me sick to my stomach, truly.

    I am so tired of Kingston doing this to legitimate couples!!!!!
    I know of one member that e-mailed the embassy the same day telling them she would be there next week and that she would bring whatever they needed for proof. They scheduled another appointment and he got through. Please try this! E-mail KingstonNIVemergency@state.gov
    I will try to contact her and see if she has any details about what she said, or try to find that thread for you.
    Call your congressman ASAP! Today, Now. Go to their website and print out the release form under constituent services and send it to them.
    Catch it before it leaves Kingston or you are in for a long road

    It was thrown out of a federal court in Oregon in 2011 siting the "Doctrine of Consular Non-reviewability" <~~ Google that if you really want your head to hurt but it basically says there is no recourse against the consular's decision. No legal action can be taken against them.
    They have filed an appeal and oral arguments were heard last week.

    I have an UPDATE. My fiance was contacted by the embassy by phone around 4pm. They called him, blocked number, it was a man. He said that he was sorry about today and they are going to generate a new interview date for him to come back in. The "system" will print it off and it will be mailed to him, he should receive his new appointment date letter within 2 weeks. He said that he will need to return with more proof and bring more pictures. Make sure to write the dates on them. He said just bring pictures and it does not necessarily have to be pictures of us together, it could be ones of me alone at my house that I send to him. He does not have to do any of the forms or fees again; only pictures or proof. I do not understand and I do not get it, but hey, at this point, we will take anything they want to give us. So now, more waiting...

    I dont nor have I ever smoked. However, I do know people who have. I wont debate the rights and the wrongs. No one here knows exactly how long it stays in the system. I have read several different reports that say different things. But it has to do with many different things. I love him and that is what I will stand on. Ive asked for help in finding out what our options are...and many are helpful. But most want to harp on the marijuana use. Well that part is what it is. It happened. Now where do we go from here.

    Well, since you asked...I have cards and letters. He presented all of that. On my second visit he wrote a note on a napkin to me. I carry that napkin in my wallet and on each visit, he writes something special on that napkin. The napkin is full now with little love notes. He even took a copy of that to the interview. The problem may have been in his answers to some questions...Have you met her children? He responded by telling them that he speaks with them on the phone and they chat online. But he has never met them as they have not been to Jamaica. They asked if he knows about my exhusband and he stated that he does know what I have told him but he doesnt know any more than that... Then on the Western Union printout they noticed that I has sent money to his daughter and wanted to know why. He told them that I had sent her money for her birthday. And one other time which he got upset about. He told me that I shouldnt give them things without his approval because he doesnt want them to think that its that easy. They asked if he knew that I had filed chapter 13 in the past. Well, that wasnt important. So I dont know if we talked about that. As that filing was a result of the divorce and it has been discharged.
    My cousin met him when she visited Jamaica. My mother speaks with him on the phone. He and my eldest daughter text and chat often. My younger boys were excited about him coming. He talks with my sister and other family members. My dad's ex wife has a dentist office in Kingston and she knows him. I am close with his family here and there. His sister is a doctor in Atlanta Georgia. His mom is a citizen. He didnt need me to get him to America.
    As far as being desperate...Well, I am a quite attractive woman if I do say so myself. I have no self esteem issues. I own my own business ( for 12 years ) and I am a homeowner. I have 99 problems and a man isnt 1...lol. I have read many statuses on here where women have traveled several times over to see their men... Not out of desperation...But likely because they truly do love them. When you are in love, you dont want to be apart. So maybe I should question those who find it easy to only see the one they say they love twice a year. Not only have I read those statuses about the visits...But I have read those of people who have known each other for less time than Ive known my fiance.
    So once again...I dont take anything you have said as a negative. I do understand what you are saying. And I will take it all into consideration. Thank you again. Miracles, love and blessings to you and yours.

    Dear Sis Johnson,
    First of all I am sorry that you are in this position. I am here as a VJ fam and friend. I really never respond to these types of post but I felt compelled. There is somethings I want you to ponder when making a decision. I have been going to Jamaican for years. There are things I have learned about the culture. Cheating is the norm. Many times some of these Jamaican men prey on the foriegn women as vehicle and maintenance of their lifestyles. You may have even meet the women he has cheated on you with but you think it is a family member or friend. Many of the Jamaican women understand that you are their meal ticket and opportunity and will not cause drama. THAT IS THE NORM. Another thing is that appearance is a big thing in Jamaica. He wants to seem like he got all the latest and the best things. It appears to me from my experience that he is maybe using you to boast. I understand that you are married and willing to spend money for your man but are many of things your buying for survival or showing off??? How many times have you sacrificed your well being for this man??? He has shown you that he is would not make the same sacrifice for you. I can tell you that I am also married to a Jamacian man and have a house in Jamaica. When I am there we live as a married couple. We make budgets, goals, and future plans. We have credit cards in both names in Jamaica and the USA. He is interested to know where the many is coming from and what sacrifices I am making for him. Many times when I send my husband money it is for survival and not wants. My husband has sent me money from Jamaica to pay our household bills in the US. I have recieved hand-made birthday cards and gifts when our funds are low. We fuss and fight and I have even threatened divorce but we work hard at it to make it work. I am not trying to show off... The example I am trying to show is that both parties are invested in this relationship. We are not really talking about the money you spent but the pattern of him being absent and unavailable in your relationship. All relationships are a process. It is not one side or for the glamour....yeah your right he cares for you but that does not equate to a husband. We as women need to be realistic with ourselves to end the cycle of bad relationships. Do not allow yourself to continue to be used by this young man. If he really wanted your marriage to work it would start in Jamaica. Marriage is a state of mind and not based on geographics. It seems that the writing is on the wall. Dust yourself off and keep it moving. You are also a young but do not allow a man to set your standard. You set the standard and how you would like to be treated. I am here to support you in any decision you make and if you decide you want to continue this relationship I will support that as well. When we are connected to a man it is like a drug whether good or bad. For a spiritual answer remain still and in prayer. The decision will come to you. Do not make threats or fight. REMAIN CALM. Although you are in the immigration process, you are not in any race. When you get your NOA2 you can take up to a year at NVC. You will remain in my prayers for mental clarity and strenghth.

    Greetings sister,
    First thanks for sharing such raw details of your personal life so that we may support you and help. First, you gave enough reason for anyone to walk away with out any guilt. It seems you made up your mind with lots of help from him. Your marriage can be salvage through therapy and commitment but I feel you sometimes a person know when to fold and walk away. You mention you have a child. A young child. I feel this would be a toxic situation for your child to have to go through. Children may not know how to verbalize whats going on ,but they see and feel it all. Plus they need to know Moma will always provide a loving and sercure home for them. Finally, be patieint and true to your intuition and emotions.. You only have one life, don't be guilted into anything. Pray and pay attention to how and when God answers.

    Despite the divorce, he is still entitle to apply for the Adjustment of Status on his own since he came on K1 visa. I disagreed with the people that posted that he would not be entitled to adjust status. The case of Choin and Mukasey is an eye opener for every applicant that came on K1 Visa. Please view this site and look for an immigration Attorney that will work with you through out the entire process. http://www.visapro.com/Immigration-Articles/?a=1169&z=36. Please before you post anything as an advice to any applicant that needs help, always search for the recent immigration amendments in such cases to avoid misleading the applicant. US Immigration Laws is changing everyday, If he can demostrate that he enters the marriage in good faith, his permanent residence is certain without any hinderance.

    I would like to add that even tho the I-864 only requires the last year tax information, Kingston is notorious for requesting to see the last 3 years. Better to be safe and have 09,10, and 11 tax transcripts.

    i'd guess it would probably be fairly active, more so than a few other regional forums (i.e. europe, australia/nz, and certainly more than the india forum).
    also, the current forum is loaded with topics in spanish - the yardies and other countries that don't speak spanish probably have a difficult time finding their country specific threads due to the heavy activity lately by the spanish speaking members of that forum.
    eta: in short, i support this idea.

    Sure. Since you have already petitioned and submitted letters of your intent to marry after she enters into the US with the K-1, you are in effect committing visa fraud. If you DO do this, then you can quickly send a notarized letter to both the USCIS and the Embassy asking for the K-1 to be cancelled. Once you recieve official notification that it has been cancelled, takes a few weeks, then you can begin the CR-1 visa for your new spouse to enter the US......with more money being sent for that petition and a longer time period to wait for that to be approved than for the K-1.
    Basically a not a smart idea but some have done it.
    If you try to pretend you are not married and can get the K-1 and then she enters the US, when you go to AOS, your fraud will be vetted out and most likely the AOS will be denied, deportion proceedings will most likely begin and she could be permanantly banned from ever entering the US. That is a really not smart idea.

    Hello Mods,
    I am requesting for a Caribbean sub-forum under Regional Discussion. I would like for it to be removed from sharing as "Latin & South America & Mexico & Caribbean" title and have the Caribbean as its own sub-forum.
    Reasons:
    1. It is very hard to pass through the threads to find a Caribbean post.
    2. The Caribbean is a big enough region with many islands & countries to get its own sub forum.
    3. Latin & South America & Mexico are large enough to have their own sub-forum.
    4. Eliminate all language barrier issues.
    5. Makes easier viewing and VJ experience.
    Please let me know if this is possible.

    I havn't been on this website in so long. When I can remember going on this site mutiple times a day for a year while going through the k-1 process. I'm very thankful my husband Nattoy made it to this country and has been a better man for me than I could have ever imagined. He got a great job and mine is ok for now. We started out living with friends and now have our own apartment and continue to build our lives together. Things are not always easy as I had to be patient with him as he relied on me to show him the ropes. Sometimes I would get upset that he didn't know something. LOL Which is why I learned to be patient and understanding to someone in America for the first time. He is very smart and has come a long way. We even argued quit a bit after about 8 months of him being here, married life is a whole different ball game, but learning and growing in our relationship has brought us to a point where we treat each other respectfully for the most part. We have both givin each other many lessons and a richer life. I feel the love he has for me and am very greatful. Without this website I wouldn't have beable to do it. We will be married a year April 30th. I feel I've found a diamond in the rough:) Maybe some kids in a few years :)
    For anyone affraid in the process,if your willing to do the work, and your motives are good and right, God will take care of the rest.

    The foreign fiancee is NOT in AP. That's just a fantasy of the OP. This is a hard denial (white slip denial), where the case is being sent back to USCIS with a recommendation they revoke the approval of the petition. The OP is simply in a state of denial, as to the facts. She asked, "What does this mean?" then gave a description of a scenario that never happens. Later she clarified after being read the actual wording of the notice. She misinterpreted even that, to rationalize that it was something other than a denial but those of us experienced with these notices, know what they mean.
    Her question has been answered accurately several times by several people. She can accept it or not.
