    It looks to me that the petitioner/sponsor's income is not enough to meet the 125% poverty line requirement.
    Is this correct?
    Did you submit evidence of assets that can overcome this shortage? Keep in mind that assets must be 3 times the shortage amount.
    So if the sponsor's income is short by $1000, you must show bank statement with $3000 in it.
    The rest of the wording on the assets list just sounds like they want it presented a particular way.
    My guess is this is to ensure them that you didn't suddenly 'temporarily borrow' the amount just so it would appear in your statement.
    A 12 months-worth of statement is a more convincing evidence that, on average, you do have the funds you claim to have.

    Our interview notice definitely said:
    Your birth certificate
    Your petitioner's birth certificate and your petitioner's evidence of United States Citizenship or Lawful Permanent Resident Status.
    Why no birth certificate? Not even a copy?
    I do think that proof your wife's citizenship is more important for the interview.
    Not sure when the interview is scheduled and whether you have anytime to remedy this prior to the interview.
    Maybe just explain to the IO during?
    I had a few things missing, original I-94 (had replacement with me) and previous EAD (just long gone don't know where it is), original passport I entered with (also long gone).
    Our IO was very understanding
    Sometimes things are lost and you just don't have it.

    Yes you can print and use the transcripts you get from the online service. That's what I did. Super convenient and No issues at all. Good luck

    Yup, me! I checked no on the form even though I had two speeding tickets. I called the DMV and was told anything older than 3 years is no longer kept in their records. So at the interview I started to ask if I should have disclosed it and the IO smiled and simply said he didn't want to know about my speeding tickets. That was that. Just be honest and explain. I don't think it will be an issue. Good luck on Monday!!!

    I'm just throwing this out there (because it's been grinding my gears from most of your posts I see) that although you are giving the OP correct information, your tone and wording, in most threads, is really unnecessary and almost condescending. Many people might not know all the facts, thus why they're asking for clarification, there is no reason to tell people to "stop trying to circumvent the system just because you want to be together faster" when they are clearly looking for answers and the correct and legal way to proceed. Half that paragraph could have been cut to avoid your personal remarks and just include the facts.
    In addition, it seems like any thread who has someone who is AOSing fro a tourist visa you have a bitter attitude with. Myself, and various other people adjust from a B2 visa who had no pre-conceived intent to want to immigrate, just solely because we didn't have to go through consulate processing isn't a reason to make assumptions or speculate one's case. Life happens, circumstances do change, doesn't mean "fraud" needs to be screamed at every opportunity. Leave the judgement for the USCIS.

    I will add: The reason I say old is that it shows when you entered the US legally. Showing that is a requirement for AOS.
    As far as I know, a U status can be given to be who entered illegally, so it doesn't show what you need to show for AOS.
    Showing both and explaining what you are showing is the best approach, either way.

    One one shot in a series is needed when filing for AOS. If you wait until after March, the flu shot will no longer be required. You can send a copy of the DS-3025 and hope for no RFE for vaccinations. If you choose to go ahead and see a civil surgeon, then I would again wait until after March when the flu shot will no longer be required. Get the follow up dosage and have the vaccinations transcribed onto an I-693.     Check with your state's DMV. You can probably get a license with the I-94, but it would expire when the I-94 does. Typically you need at least the EAD to get a license or state ID.

    No, you don't need fingerprinting yet that comes after you mail your i-751 to remove the conditions on her green card.

    Fill out the form carefully, go passport photos taken, pull all your documentation of bonafide marriage and co-mingling of finances together
    You still have time to pull everything together before it's considered late.
    As soon as you have the whole package together, mail it priority or express or overnight - the faster the better, just to be safe.
    Once your application is accepted they will mail you a notice of action. The letter will also extend her status for one year. Then she should be OK
    If you are confused about anything while you prepare the pacakge, ask!

    If your ducks are in a row, you should have no trouble getting a prompt decision on your case.
    March 28 start date is going to be pretty close for getting the actual card in hand though. You can take a look a my timeline in my signature. I was approved and told that I'm officially a resident at then end of my interview and my card arrived in the mail just under 2 weeks later.

    I got this same RFE letter requesting evidence of legal entry or to file the supplement A.
    You don't want to file the supplement because then you would be admiting EWI which is not true in your case.
    In my case, apparently I forgot to include the i-94 copy in my initial package.
    In response to the RFE I sent the i-94 copy
    But I also sent the passport page with my visa on it, the passport page that was stamped, my i-20 (also stamped), and my boarding pass which they also stamped.
    Does she still have the passport she used to enter?
    Does it have a page with the entry stamp on it?
    If yes, I would send a copy of this page.
    Send a copy of the passport page with the visa if she has that as well.
    Yes, I would translate the i-444 to English and re-send the copy of it with the translation.
    It is possible that they want it translated.
    Because the i-485 instructions state that if you send any document in a foreign language, it must be accompanied with a translation.
    But I would still try to send everything else she might have to prove legal entry.

    I moved to the US in order to marry and live with my husband. I also moved my 10 year old daughter. I sold all my worldly belongings, gave up my job and am starting to retrain to get US-based qualifications.
    If, heaven forbid, anything should happen to our relationship I would be livid if I had to move back to the UK. We made a decision to start our lives here and I made a commitment to that decision by giving up everything back in England.
    To the OP, I'm sorry to read that your marriage has failed, whatever the reason. I can also empathize with wanting to make as clean a break imaginable with a measure of revenge thrown in. But she is human too. You cited age and cultural differences, and you're probably right. Had you married a US citizen, no matter how difficult she was going to make your life post-divorce, you wouldn't have any such 'get rid of' process. I'm sure you didn't enter the marriage with the thought of 'oh well, if it doesn't work out, I'll just try and get her deported' so don't enter into divorce with that attitude.
    Change the locks, change your number, advise security at work, get a restraining order against her if she starts being malicious but please don't sink to the low level of objectifying her through attempted deportation.

    If the greencard is a 2-year greencard, the person is a conditional resident, and must file I-751 to remove the conditions in order to obtain a 10 year greencard. This is based on being married for less than 2 years at the time of gaining resident status. Once the person has a ten year greencard, then the I-90 must be used to renew. In your case it is the I-751

    I would just try not to get baited to pile on.
    When I read a thread and towards the end it's a bunch of posts piling on about one miniscule aspect of a term someone said, be it the OP or someone else, I just move on my merry way.
    I don't even bother replying to a thread where someone's questions are already addressed. Sometimes I give thumbs up to a particularly informative reply.
    I'm here to better understand immigration processes because it interests me.
    And every now and then someone has a question that I feel I can answer or OP may benefit from my similar experience that I can share.
    If I have nothing valuable to add, I have nothing to add
    Beyond that, the rest is just reading material to me
