    He cannot marry someone else after arriving on a K1 and stay. You can report him to USCIS and ICE for visa fraud if you choose. Or you can forget him and move on with your life, thankful that you did not marry him or apply for his adjustment of status. I suggest unfriending or blocking this person on facebook. Getting reminders of things like this is just painful and there's no reason to cause yourself pain.

    Time was that Vermont was faster...then a time was Cali was....Texas is new to the mix....there is no rythme or reason. Stop trying to think about it. It will take what it takes.....figure about 5 months, don't be surprised if is happens sooner or later. 10 months is not outside the realm of possibility.

    it is illegal to enter the US on a non-immigrant visa with the intent to immigrate.
    People do it all the time, however, and many do not know it is wrong.
    Once in the US, if allowed entry, then intent to immigrate upon entry is not a reason to deny an AOS.
    If the person lies to gain entry to the US then they will be banned for life for misrepresentation.

    Use a website if you need one for family. (We used one so family and friends who hadn't met our significant other would have a clue as to what's going on, given the whole "living on separate continents" thing.)
    We didn't use our website for VISA purposes, but we did use things on Facebook and Twitter as supplementary; people responding to engagement news, etc.
    IMO (and please note that the "my opinion" part there is the important part), it's not a good idea to set up things for immigration, but to let your proof of relationship to immigration be a natural outgrowth of your relationship and the needs of that relationship, within all appropriate cultural contexts.

    Here are the three main requirements for an I-129F petition >
    1) Both are free to marry at the time the petition is filed.
    2) You have met in person, face-to-face at least once within the 2 years prior to filing the petition.
    3) You both have the intent to marry in the US within 90 days of the foreign fiance(e) entering with a K-1 visa.
    Your problem is #2. You were not together in person within the 2 years prior to filing. It does not matter how long you have known each other. You have no way to supply the evidence they are asking you for. You should have waited to file until after your visit in person in Dec. 2013. As stated by belinda63, you can withdraw your petition and refile using your latest visit to meet that requirement. Or, you can wait to be denied.

    Need more details. You file for a K-1, correct? And the date of your filing was? WOuld seem to be Nov 11, 2013, Is that correct?
    If the above is correct (the filing date) and you did not meet in person in the 2 years immediately preceeding filing then you did not meet the requirements and you will be denied.

    @Medtav: I would bring all the ####### including utility bills and what have you....better be over prepared than not having something an overachiever IO might ask for. I doubt you'll need any of them, but you know....and ALL THE BEST!!!

    Your interviewer is not the IRS. He isn't really going to be going over your tax returns. He probably doesn't understand them anymore than you do. I doubt your husband knew he was doing anything wrong. You filed. You paid taxes to the best of your knowledge. Be at peace. Forget the IRS and go to your interview. If the IRS should decide to audit your very old return, then pay them what they bill you. I doubt if you ever hear from them. They don't have the resources to go after nickel and dime mistakes. And they don't know you earned foreign interest anyway, so how would they flag your account as a mistake?

    Do not withdraw it. When you go to the interview, explain the mistake. All you have to say is that your husband found out the mistake and that he fixed it as soon as he knew and that your bill with IRS is paid. Get copies of the amendments of all returns you did. All copies of all payments (even statement from the bank to show that the IRS got the money). and you will receive a receipt from IRS use that as well. There is no reason for you to overreact and withdraw your application, that was an honest mistake.

    apply based the 5 years, it's easier, less paper work, and might be easier at the interview. if you apply based on the marriage, you still need to show that you still live with your us spouse etc..

    It is extremely unusual to be able to add a Parent to a work insurance, not impossible but pretty close. So make absolutely sure that is available.
    Also the reason work insurance is 'cheap' is if the Employer heavily subsidies it, which is why it would be so unusual.
    Also you do not need a SSN to be insured, SSN is obviously pretty irrelevant in this case. Usually that is mentioned because the person you spoke to knows no better. That is what they normally use.

    Her obtaining a green card won't solve the insurance issue. She won't be eligible for Medicare or Medicaid. How do you intend to pay for her medical care if she obtains a green card?

    you just filed two months ago. People have been waiting for a year or more to get a NOA2. Sorry, but you have several more months to wait given the backlog of approximately 500,000 petitions sitting at the USCIS right now. Sit back and relax for now.

    Why are her choices live with parents or be homeless? She is 23, she can move anywhere in the lovely country of Canada and get a job in the meantime. Or get a part time job and continue school and find her own place. There has to be student housing in Toronto since so many universities are there. Room shares, things like that. Time to grow up
