Yes. Example: If someone leaves the country before their AP is approved, it is subsequently approved and mailed to them abroad, they attempt to use it to return to the US, they will find themselves in a bad situation.
You, on the other hand, should stop worrying. AP is used by millions of people annually without a problem. CBP and the airlines expect it.

Best is a tax transcript. You can order them free from the IRS online, and they'll mail it to you within a week or two.

    1) "Parolee". You will not be admitted to the US but will be paroled in.
    2) No.

AFAIK you're correct on all counts.
While you would probably get away with traveling on the expired GC + extension letter, it's better to get an I-551 stamp in your passport via InfoPass.

It's generally unwise to assume that an immigration officer is giving you good advice, or even telling the truth. Furthermore, any issues you have on entering the country will be in the department of CBP, which is quite separate from USCIS. It might be good to consult your own immigration attorney (not the company's); if so you should try to find one who has *tried* an abandonment case.
That said: I think you understand the situation correctly, to the best of my knowledge.

If you file at least 3 weeks before you leave the US, you should receive the biometrics appointment letter in time to do an early "walk-in", thus negating the risk of missing your biometrics appointment while you're away.

hmh33 reacted to Lainie B in Advance parole- what is "out of status" ?
You are not currently out of status. When you filed for AOS you were automatically put into a period of authorised stay. You can use your AP to visit family, and it is valid for multiple trips. It doesn't have to be an emergency. You shouldn't have any issues returning with your AP.

It is really, really, rare for I-751 waiver applications to be denied. There can be RFEs and interviews but it's almost certain to ultimately be approved as long as the marriage was genuine, even if the evidence is scant.

Much of that is unnecessary and/or irrelevant. You don't want to confuse USCIS.
Marriage certificate and passport are unnecessary, they already know you're married and what country you're from.
W-2s are irrelevant, they care that you filed taxes as married (evidenced by the transcript), not how much you earned.
All the university stuff C,D,E is irrelevant.
Copies of USCIS letters mailed to you? Are you serious?
Shared cellphone bill is good. There's not a lot of point in the bills where only one spouse is listed, except as proof of address, for which you already have other evidence.
    Jewelry store receipt proves nothing.
Make sure the joint bank account statements cover the whole duration of your marriage (e.g. one statement for every 6 months)
Are you and your spouse on the same health or auto insurance? Are you each other's beneficiary on life insurance or retirement accounts? If so, include evidence of that.

Dude. You got all this information in February. It's 3 months later and you still haven't replied to the RFE?
You must respond to the RFE in a timely manner which usually is 30 days.
Go get a competent attorney. You are wasting time and money doing it yourself. Immigration is not always a DIY job. Sometimes you need someone who will actually do the work correctly.

You're eligible for either route. Adjustment of status seems like a good choice to me. There's nothing suspicious at all about this case, it will be just fine.
Adjustment of status typically takes 4 months. He will be stuck in the US for the first ~2 months until his Advance Parole is approved. All times are variable.

Expanding on "Your basic premise is wrong":
A green card holder will NOT be sent back on the next flight by CBP merely for suspicion of abandonment. They will either be:
    * Admitted (most likely, with an absence of 6 to 12 months and no pattern of long absences beforehand)
    * Paroled in with an appointment for deferred inspection or an immigration court hearing
    * Persuaded to file an abandonment of permanent residency form (I-407) and paroled in or admitted under the visa waiver program

No, certain employers (chiefly military or aerospace-related) require a green card or citizenship as that makes the employee a "US person" under the ITAR. They technically *could* employ someone with an EAD, but they would have to apply for a license from the state department which costs thousands of dollars and takes several months, so they're usually reluctant to do that.

They won't ask, and even if you were to volunteer the information, they're not allowed to consider it in their decision. That's what is meant by "automatically forgiven".

Most states will require the EAD (or green card) before they'll renew your driving license, but some might be willing to do it just based on your receipt notice.
If your employer doesn't notice that your status is expiring, and you continue to work, that period of unauthorized employment would be automatically 'forgiven' upon your adjustment of status.

Also, pending loss of a job due to expiration of work permission is a valid reason to apply for expedited EAD. I think the timeline you present is too tight to not have any gap, though.
