    Somebody with first hand experience will surely reply to your post, but I wanted to share my knowledge on the matter. You can legally travel outside of the US with an expired GC and letter of extention as the extension letter itself validates your stay by another year. This means that when you re-enter the US, the authorities will and must accept it. The issue is the country you are traveling to. Whether they will accept the extension letter while the GC is expired, is another question. Usually, foreign countries tend to be suspecious towards such documents as its difficult for them to verify such documents. But in general, people have traveled with less or no difficulty(based on their shared experience on VJ). Hope this was helpful. Good Luck!

    Hi Everyone,
    We just returned from a one week trip to Scotland to visit my family. My Greencard expired on Feb 8th and I have the extension letter allowing me to work and travel for a further year. We flew from Boston to London Heathrow then on to Edinburgh. Leaving the US I was never asked for my Greencard. When we checked in at Edinburgh Airport with British Airways the woman at the desk asked for my Greencard. She scanned it in the system and it told her it was expired. I told her about the extension letter and she asked to see it. She then manually changed the expiry date of my Greencard to 2013 and checked us in. When we arrived back in Boston I gave the CBP Officer my passport, Greencard and extension letter. He immediately handed me the extension letter back and scanned my Greencard. Obviously the extension is in the system and they don't need the letter.
    So basically there was no issues at all traveling with an expired Greencard and extension letter. They don't seem to require the letter in the US but make sure you take it with you in case they ask for it in the country you are traveling to when you return.

    Ok, I have had an experience with Abu Dhabi pre-clearance as i traveled through Etihad and wasn't aware of the pre-clearance setup. For some reason they treated me like a convict even though I am a US citizen. To answer your question, you book all your luggage for your final destination. All you carry is your hand luggage. You are NOT required to have all your luggage with you during pre-clearance as its not possible during transfers. I will never travel through a country that has similar arrangements. I have rights here in the US and cant be treated the way they treat me in these arab countries. Good Luck.

    Hi,
    Today I received an email/Text that my I-130 petition for my mother has been approved. I should be expecting a Notice in the mail within a few days. What should I be expecting besides that. I know that there are more steps to it before the case gets referred to the embassy in my mothers country of residence and would like some guidance as to what I should be doing now and what kind of documents I should start gathering.
    Also, Whats the time frame I am looking at in terms of my mothers visa being stamped since the I-130 approval.
    I appreciate your input and advice.

    Here is what I would do, if I was in your position. Get her out of my life as SOON AS POSSIBLE. This is not a healthy relationship. Certainly not a faithful one either. Donot even attempt to sponsor her. If her 2 year card has expired, count your blessings. Keep all record of the mails and facebook messages. Should things get worse or you get accussed by her at a later on stage, this stuff might be handy for you to get her removed from the US. Good Luck and sorry to know that there is a child involved that will eventually suffer from this break up.

    No he can't. Because the OP has mentioned both his marriages were held in his country of origin. I fail to understand why he is being asked to provide marriage ceritificates as he has not applied based on marriage. Maybe the IO made a mistake or there is more to the situation than we know. I would advise, that the applicant explains to the IO makes an infopass and explains to the IO of his situation. I am sure if his dwelling was damaged due to Sandy, he will have proof to show it and can request a decision based on hardship. Also, it would be best to explain his position in writing. If he can provide the documents at a later on date, he can request for more time.

    Thank you avatar. In my opinion I am very lucky as NY is really dragging the cases. Honestly, I wasn't expecting the interview this soon, looking at the other averages, in Atlanta, Chicago and NY. As long as I am done with it, I'll offer shukrana Nafal and move one:) I pray for your speedy decicion and wish you luck for your upcoming waiting ordeal.

    I would be mad too, if I was that tier 2 office . Its only been three days. I have received mail as late as 10 days from USCIS. Wait until Tuesday. Oaths are usually atleast 3-4 weeks ahead.

    Your reading and writing. The IO will make you read a sentence and then ask you to write an answer to that sentence, which the IO will read out to you.

    You need six correct answers to pass the test. If you have answered the first six correctly, the interviewer will stop at that and move on to other parts of the interview.

    If you have been a resident for 5 years, I would suggest to file under the 5 year rule and leave the 3 year rule based on marriage out of it. It will be less paper work on your part and more easier. Good Luck!

    I would like to know of any one office that can claim they settle "ALL" cases within 5 months. You have two options. Call the USCIS # and talk to a Tier two officer who would have knowledge of your actual case. Or, schedule another infopass and hope to get an officer who would sincerely make an effort to help you.     Interviews can be and do get conducted even if the 3 year or 5 year mark has not been reached. But in order for the Citizenship process to be completed, an applicant has yet to take the oath and that is only scheduled by USCIS once you have achieved your 3 or 5 year anniversary. I applied 3 months prior to my 3 year anniverary, and am hoping for a interview way before the 3 year mark is reached. The oath is what I am not expecting sooner.

    You did the right thing. In order for your N-400 to be processed, your I-751 has to be decided and since you were eligible to file for N-400 and did so, USCIS will be forced to adjudicate your I-751 along with your N-400 application. Whatever was holding your ROC application will have to be addressed by USCIS during your N-400 process. Good Luck!

    As Stated by above members, it will not be held against you for not applying for citizenship sooner. Since you qualify under both conditions, you can choose to apply under the 3 year or five year blanket. But as mentioned, it will be easier to apply under the 5 year rule as you will have lesser evidence to provide. Good Luck!

    I am sure its a computer glitch. I had a similar problem when I had applied for AOS. After completing my biometrics, I received a second letter within a week, for a second appointment. Since the ASC wasn't far away, I decided to go and not risk it. Didn't even mention to them that I already had em. Just showed up. Did my Bio the second time and left. Challenging or finding faults with USCIS only complicates things....

    On a scale of of 1-10, I would say their importance is .1
    I never submitted any and have no intention of wasting my time over these things in the future as well. If they are "family" or "Friends", ofcourse they'll lie to save your skin. I don't know why even USCIS accepts it in the first place.

    Your NOA receipt is your extension for another year. Keep that and your expired GC with you while traveling. If you want to feel more secure, then schedule an appointment and see if your local office will stamp your passport for you. Good Luck!

    Just_Bob: The same goes for all other evidences as well. You file joint returns to get the Green Card. You show co-mingling of assets to get a green card. You own a dog together to get a green card...the list is endless.
    Heres what it is.
    Amongst the list of a bonafide relationship, The baby is on the top of the list. There is no argument to that fact. Other than that, you can show them all kinds of garbage.
    In my experience, during our AOS from a tourist visa that is, The IO when saw my wife 8 months pregnant had nothing concrete to ask me. That is a fact. And to all those readers here. Don't just go by what you read here. I am a proof of some of the toughest situations one could encounter and yet came through. Ofcourse, the relationship has to be legitimate.

    Not necessarily. Each case is weighed and viewed differently. It depends on what you submitted as proof as well. Also if there are any red flags that are raising alert, you might be called for an interview. But, in most straight forward cases, the ROC is decided without an interview.

    I thought, you have to show that taxes have been filed for as long as you have been an LPR and copies of Last three years of filed taxes are to be attached with the application. I am sure, if a company is being maintained, Taxes have to be paid. Regardless of making profits of losses. If you are maintaining Bank accounts and stocks, then you are earning something. I even had to show an interest of $26 on my tax returns that I had accrued on my savings account for the year. I may be wrong, but I thought I'd share my two cents with you. Best you confirm. My wife and I both are not working anymore, and we are still looking forward to filing our taxes next year, regardless of our employment status. Good Luck
