    I have a follow up question for these Affidavit of Support issues. I'm interviewing for a job tomorrow and there is a possibility that I might get to start right away. Is it ok to use a job for current income if you've just started a few days prior? Or would they look down upon that? I'd figure I'd do some type of combination between savings and current income if I get the job that is. :whistle:

    Get SSN (but if your I-94 is about to expired then wait for the GC or EAD, then you can make the SSN)SSN will not accept your application of SSN if your I-94 is expring in somedays.

    Get married

    Register it (asap)

    Go to the doc (listed on USCIS website) and done with ur vaccination. If you have done it already, transcribed it by USCIS registered doctors. If not then search for any local USCIS registered doctor and get your madical done, As I know, these days these doctors are now in competition to do USCIS medical so they have manimize their rates. you can easily find one in your area. (If need more help with medical, you can text me)

    In the meanwhile you would have plenty of time to arrange the documents you would need in your AOS application.

    Here's is an extensive list of what would u need in order to ready your packet. But again this list can be changed according to the situation you could have. Normally this is what I have followed. CERDIT GOES TO NichNick (Fellow VJ member)for the compilation of this list.

    And a check for $1010 made out to the Department of Homeland Security

    That's 3 separate applications with supporting evidence all mailed together in one envelope with one check. They will get processed in different places, so that's why the duplication of evidence. You don't have to do all three, but the second two are free if sent with the AOS and will get you authorized to work or travel sooner than waiting for the green card to arrive in most cases. Green card could take 6 months. Work and travel 60-90 days.

    Do not work until the I-765 is approved and you have the EAD card

    Do not leave the US until the I-131 is approved (K1s) and you get the travel documents or you will not be allowed back in. Once you have a green card, then no problem.

    Statement of circumstances that warrant issuance of advance parole.

    I wish to apply for advance parole and obtain the necessary permission to travel to my home country prior to receipt of permanent residency status in the event of emergency or family illness. I do not have any specific plans to travel at this time.

    When your packet is ready to shoot, then you would have to find the correct address on which you need to send the packet. It varies according to the location you are living at. Go to the website mentioned below to find out the USCIS office, that deals your area.

    If you ever have to move to the new address, after filling of the AOS application, you need to inform USCIS by submitting AR-11 Form. You can do that online on this website

    US citizen doesn't have to fill out AR-11 form but the other one USCIS has on its website.

    I'm getting ready to submit the AOS package, just have few questions:

    We're k-1 applying for AP document, therefore, there is no need to fill out part 4, 5, and 6. However, we do need to include a letter of explanation per part 7 requirement, correct?

    How difficult would it be to re-schedule the AOS interview date?

    The $1,010 filing fee covers AOS, EAD, and AP document, correct?

    All 3 abovementioned forms should be sent to the same Chicago address, correct?

    To me unless you have some very good reason for ignoring filing the AOS since 10 months, the USCIS will be screening your AOS very closly and probably this will raise RED Flags because ignoring any step in the entire process to me is a RED Flag that needs further investigation.     it might be to you but actually there is very little evidence to support what you said other than the alien is subject to deportation until the I-485 is filed

  4. If you can't find updated form on USCIS website then you can't find it anywhere unless USCIS uploads the new one. As you are filling the form after its expiry date then you are OK to use it. Becuase there isn't new version of the required form available on USCIS website.

    This is my opinion and shouldn't be taken as expert advice.

    I recently filled out the g-325a form for me and my fiance. I just realized it had an expiration date of 5/31/09. I went to the website AGAIN to download a new one, seeing as it is June 4, and the form they have to download is the one I used, expired 5-31-09. It was last revised 7/14/06, so I doubt it will have any updates, just eventually a new expiration. I called and they told me to use the expired form, that you can ignore the expiration date as they only go by the revised date. I know if I use this form, it will come back to haunt me. I don't want to just sit around and wait for the government to update the form on the website. I do now have the phone log that I did call, and also the email I sent with only and auto generated out of office response. Anyone else send in expired forms?

    If you get married within 90 Days and apply for AOS with expired I-94 It will be fine. With ICE, they can take you to the Immi dept if found you are out of status and didn't apply For AOS, but they can't deport you without Judge decision. and if she or he likely to go before the judge and show their NOA, their case will be dropped right away. There is %O chances of deportation unless you do any severe crime or you become a risk for national security

    There are some ppl here on VJ who had the same case but they are now in process of AOS gettin' approved.

    She could be deported - ICE doesn't care if you got married.

    anyway - file for the AOS ASAP - like start today. You should also update your/hers address - use the I-865 and the AR-11 (both on uscis.gov)

    That's the thing. They didn't file for the AOS, they do not have the NOA, so they are not safe from ICE. Key words here are "could be".

    Yes, they would have to go through all the hoops if they get caught up by ICE, bail, time spent proving, etc, and they do have a slight chance of getting deported. I wouldn't say it's zero (0) percent. Everyones case is different.

    So, again, file the AOS asap and then your "legally safe", prior to that, out of status, your at the mercy of the IJ/ICE. Do you really want to chance it?

  6. Sir, pardon me, but you gave reason to pointed out this issue. YOu were here to ask a simple question and there is no link of masters degree with USCIS approval notice of GC. You should be wise enough to understand, they are writing you letter to inform that Your application has be approved and USCIS must have mentioned in the letter as well you will be getting GC in a seperate mail.

    I am not being hater nor making any issue, but ppl make always fun out of you when you give them any reason. Noone calls anyone stupid unless he does any stupidity.

  7. Masters degree doesn't have to do anything to understand the situation you have. So don't need to mention it anyways..

    But USCIS when approves an application, they first notify by mail then sends out the green card. Have a nice cup of coffe, sit back and wait for the GC.

    I just got an email from CRIS that., approval notice sent on 06/02/2009. Does this mean that my GREEN CARD has been sent? USCIS is getting me confused; making a fool out of a Master degree holder. As you guys may well know that:

    1. I filed on 08/17/2008

    2. Approved on 04/16/2009

    3. Approval letter in the mail on 04/18/2009

    4. Card production ordered 2x; 05/20/2009 and 05/28/2009

    5. And, yesterday 06/02/2009, approval notice sent.

    Again, is approval notice the same thing as GREEN CARD? Please help! I am an illitrate for the moment. Thank you all.

    USCIS doesn't have problem having either one check or two. But the amount they are asking should be exact. $1010 could be written in one check or two.

    :thumbs: Or three, or four for that matter. It doesn't matter what the denominations of the individual checks are either. All that matters is that the total is exact, to the penny and that the payee is precisely what they ask for ("U.S. Department of Homeland Security" - U.S. in initials, DHS spelt out in full). The instructions are very specific about what is required and acceptable.

    I sent money orders myself, one for $1000.00 and another for $10.00. There was no problem.

    hi all we just got married may 26,2009..can we file aos now??or we need to wait for the marriage certificate...we only have the marriage license....and if the answer is yes...what forms and documents are needed??

    AT first, i wanna know why she wants to come and settled down with you in US while your fiance visa is in process. I am wondering why she can't stay in CAnada and wait for the paperwork to arrived so that she could go to US without any trouble. False statements to Border Immi office would put her on lifetime banned and I am sure you dont wanna see that (God forbid). From the time I-129 approves it takes more or less 3.5months to get the visa. She is canadian so it would be more faster than anyone's case. My best Advice

    She can come to Visit but shouldn't have intention to overstayed. Wait for some more time (3 months) to actually get the Fiance Visa.

    You dont' need to risk your case for the sake of living together asap. You have waited long so why not some more times. You better off having advices from your so called Immi officers who may be charging you but digging youself into the deep ######. I dun know about CAnada, but in US, once u red flagged you won't be a normal person for a long time in the eyes of USCIS.

    DONT TAKE RISK. BE PREPARED FOR THE FIANCE VISA INTERVIEW. HER TIME IS NEAR TO HAVE THE FIANCE VISA.

    I have a difficult situation,

    Okay so my fiance and I are doing the fiance visa process. Instead of waiting for it to go through, she is coming down to be with me for 6 months while its in the processing stage. She is coming down with her father in his transport truck, and will not have a return ticket home, however she will have the money for one in her bank account. Our original plan was to tell border patrol that we are engaged and are working on the visa, so we are doing it the valid way. When ( and IF ) it gets to NOA2 status while shes down here she is just going to fly home and finish the process there. However my mother has spoken to two immigration lawyers and they have said to tell border patrol that she is just coming down to visit friends. The problem is if they search the truck, they will find a lot of her possessions and she will most likely immediately get turned away. But the immigration lawyers are saying that if she says she is my fiance, they will red flag her and turn her away anyway. We wanted to get some opinions as of what to go with. She will be bringing down a copy of the I-129F packet as well as proof that she can pay for her own way down here as far as meals go. We want to be as honest as possible but we also want to be able to get her through the border.

    Also, we know she is able to be in the US for up to 180 days, but we are wondering if it renews in the new year, Jan 2010? So if she comes down in June, can she stay until mid-November, go back home for a few weeks, come down for Christmas and stay in the country, and be able to stay until June? Or is it that you cannot come back until 6 months after you leave? Like is it a rolling year where when she comes down in June she couldnt come back until June 2010? We are curious as to how this part of the system works.

  12. Get the letter from the hospital stating that UR FATHER IS IN CRITICAL SITUATION. Go to local office or have infopass. USCIS is based on human. They will definitly release you from the pain of gettin stuck in here when your father needs u. I am sure, If you walk in. They will give you urgent AP paper.

    I applied for AOS on April 6th. I received CRIS update last week that my AP application was approved. The notice was sent on May 22nd. In the meantime my dad who has been very ill for some time now, suddenly ended up in the Intensive Care Unit and his state is considered very serious. I would like to fly back home ASAP so I can see him. My question is: how soon after the AP approval notice, does the actual travel document arrive? Please, let me know about your experience. I am not sure if it even makes sense to request the emergency AP if the original application got approved and all that is missing is the travel document.

    Has anyone applied for the emergency AP and received it on the the same day or shortly after? I am not sure what to do.... Every day I wait for the mail, I risk not being able to see my dad again. Please, advise.

I am agreed with you, that's illegal behaviour and she/he should stop working Illegaly. But Noone has right to show up angry behaviour.

    I have a question .My friend already sent her package ..for the uscis..she already did the biometric..and is wating for the interview letter .She works as a nanny ..but they pay her cash and she doesnt use her ssn ..Its any chance that the imigration find about it ???

    I'm sure INS cant find out if she gets paid cash. i wouldnt worry about it.

    They have access to government records, when do they do background checks. Her SSN will show up.

    If she was filing in taxes - it will be in the IRS DB.

    (oh - that should be "know" not "no" - stupid spellcheck :))

    She never filed taxes, she just pay's taxes from each paycheck. The company uses her SSN, but she doesnt actually file taxes every year.

    Will that still be a problem?

    And if it will be a problem, how will stopping working now change anything?

  14. It is fine to apply for SSN even on the second day when you land on US soil. I agree that SS dept takes sometimes to check the status of applicant but it doesn't take more than 4 weeks. I did the same thing and got ssn within 4 weeks. In normal cases if you apply for SSN. It takes 2 to 3 weeks. So what's a big deal if you apply right away when you arrive or after sometimes.

    You have been asking a LOT of questions, have you first :guides: ???

    SSA requires.

    Foreign BS + English translation for DOB

    Passport for photo ID

    I-94 card in passport to confirm legal presence.

    K-1 visa to base SSN on.

    K-1 can only get SSN within 75 days or so after entry to the USA, after that an they will need EAD or Green-card to get SSN.

    Note: do not attempt to apply for SSN with in the first 2 weeks after entry to the USA, attempting to do so will run into a problem, it takes USCIS at least 2 weeks to update database used by SSA to confirm immigrations status.

    Do not leave the US until the I-131 is approved (K1s) and you get the travel documents or you will not be allowed back in. Once you have a green card, then no problem.

    If you ever have to move, after u filed for AOS, you need to inform USCIS by submitting AR-11 Form. You can do that online on this website

    US citizen doesn't have to fill out AR-11 form but the other one USCIS has on its website.

  17. NichNick is right! You have to do your medical again. USCIS might lost the ur phily Medical record. These days Almost all authorized USCIS doctors are charding less to do your immi medical in full. Mine was done in 160$ (full medical with transcribed). They were like no matter if you are here just for shots or full medical the price is same so i decided to go for full one, this way my medical is again valid for one year :D
