  1. it is not a big deal but it isn't required.... just a waste of money in my opinion.... that is what the 80 dollars is for... to pay for the fingerprints and passport pictures...

    if they already have been sent with the package, then there really isn't anything you can do I guess...

    yep thats true i dont know why she asked me for it , should i tell her why , beacuse i will do my beometric and they will take pic for me ? thats confusing hahahah , thanks for ur advice .

    Those who reside overseas pursuant to military or government orders, including conditional resident dependents residing overseas and listed under Part 5 of the form, must submit the following items with Form I-751: Two passport-style photos for applicants and dependents, regardless of age. and Two completed fingerprint cards (Form FD-258) for applicants and dependents between the ages of 14 and 79.

    lawyers sometimes don't know everything ..lol I had to correct our lawyer a lot of times...

  4. passport photos are only required if you are not in the US. Those in the US will get a biometrics appointment where they will take your photograph and do your fingerprints.

    oh, yes! that too! sorry, was just assuming that you are in the USA.

    Hi Guys i think the passport photos are required , cuz i just took my 2 pics last night , my lawyer told me they attach 1 with form i-751 , i know the pic will be taken in the biometrics , its like confusing i dont know why she asked me for it ? thanks.

    Just wanted to share with all of you my interview experience which I had on 08/06/08 at 7 am (I have started posting on this site very recently, im more active on boards.immigration.com but thought this information might be useful for some of you.

    My case was I-751 removal of conditions, I was filing separately based on divorce (you can see my timeline in the signature). Prior to the interview my attorney and I had met a few times to make sure that we had all of the supporting documentation ready such as (joint taxes, water and power bills, health and dental insurance, car insurance, pictures, affidavits, etc).

    We arrived early around 6:30 am and surprisingly there was no line, those in Miami would know that there is always a mile long line outside. We came in and sat down in the assigned waiting room where a lot of people were already waiting. My attorney placed the interview notice in the bin and sat down (please note that my interview notice came on July 25 giving me only about 2 weeks notice which I found odd as they usually give about a month notice, anyways). So we waited for approximately 10 minutes and my name was called by the officer. He escorted us to his office. Once we settled in, he made me raise my right hand and swear to tell only truth, i did. Then he asked my attorney to show him her bar card and ID which she provided to him immediately.

    After that, he pulled out a huge, and I mean huge folder, which had my name on it and I was shocked how much paper was gathered on my file, WoW. The officer asked me to provide him with my passport and the conditional GC. Then he asked me several questions verifying my DOB, address, date of divorce and marriage, etc. I was a little bit nervous but managed to answer all of his questions in a calm manner. After that he asked one question if I was ever arrested, to which I replied that I was not but mentioned that I had DUI. Of course, he asked for the court certified documents and the deposition regarding that DUI. My attorney had these documents and provided him right away. Then he asked my attorney to provide supporting documentation that was not submitted with the original I-751 application. My attorney went through the list of the documents that we had and he only picked health/dental insurance papers, affidavits and car insurance!!! The officer quickly glanced through these documents and then, along with my huge file, he left the office telling us that he will be back.

    He returned in approximately 3 minutes with a fingerprint card and without saying a word told me to look at the wall and give him my index finger which he fingerprinted on his card twice. Then he pulled out a large stamp from his drawer (at that moment my attorney gave me a congratulatory kick under the table ), the officer stamped my passport which says "upon endorsement, serves as temporary I-551 evidencing permanent residency for one year and Employment Authorized." I wanted to jump up and hug everyone but controlled my emotions. The officer congratulated me, advised that the permanent GC will be in my mailbox in approx 2 months, shook my hand and politely asked us to leave.

    Please note that the entire interview took no longer than 10 minutes although it sounded like it was long. It was very quick and as you can see very few questions were asked. I was very pleased and happy, given that my journey to this started in 2003 and it was over 5 years until I finally came to this happy ending

    Now I can breathe easy because I dont have to gather any more documents and remain in constant waiting mode for my interview.

    Hi i was reading ur experiance with I-751 through divorce , iam going in the same boat i hired an attorney and she will file for me next month , i got divorced last October , and i this is my evidance 3 affidvit letter from 1 from my brother and 2 from my friends , and we have mortgage house and car laon together , tax jointly , bilss , pics , trip....., how long it take to get approved ? can u share me with ur expiriance i appreciate thanks.

Hi guys i have some questions , i would like somebody help me , iam removing condition through divorce and i have a lot of evidance , my question when i will file how long it take ? and i will get 1 year extention right ? do i have to go to the immigration place to get stamp or they will mail me automaticly 1 year ? thank you guys i appreciate .

    Well it depends. Sometimes it'll be less than 6 months or it'll take longer, nobody knows. you'll receive the same NOA's like the "regular" filers and will go through the same routine, file, bio's, wait etc...you don't need to get stamp as long as u have the extension and have filed accordingly. some of us including me got RFE for more evidence...Best of luck.

    Just like you said you have lots of evidence you could provide. Since you are hiring an Attorney he/she will help you all the way. Just submit what you have and take it from there. Read again the 751-I instructions especially on the evidences you need to submit. I submit a personal letter explaining what happened to my marriage - as to why I had to file on a waiver...

    Well it depends.     You can file anytime after you are granted your conditional residency if applying through divorce. You will get your NOA1 - extension letter a few days after to a week - once application is receive...usually a week after...Your extension letter is good enough - you don't need to have a 1551 stamp unless you wanted to...

    Hi Bulanglang , thanks for ur reply i do appreciate ur advice , how long it take to get aproved for the 10 years green card ? cuz i hired a lawyer will file for me , and i got a lot of evidence , we bought a house and vehicle together and have join taxes 2006 and 2007 , bills , wedding pics , vacation pics , do u think i have enough evidence ? and the top of that why i divorced her she like to go to the bars and drink a lot and she said that she cheated on me . i cant live with somebody liar . thanks.

  9. Waivers are somewhat different for the removal of conditions. There is a section on the bottom of the form that you check off stating that you are applying jointly or if not jointly, you are requesting a waiver from the joint filing condition because of - a),b ),c), etc. You check off the appropriate reason, the most common one being that the individuals are now divorced so cannot file jointly. This is different than the type of waivers discussed over on immigrate2us. The waiver requested is from the condition of having to file the form jointly - the OP filed singly.

    Where did you file your I-751? If it was Virginia (or Texas), then you have a good 11 to 12 months or longer wait. You can check the status list of other VJers who have filed here: http://www.visajourney.com/forums/index.ph...5&start=915

    Hi Guys i have some questions i will apply for my I-751 in January to remove condition with waiver , my lawyer asked me to bring evidance like tax return , and i have all that stuff , Mortgage for the house and Vehicle together , pics , emails etc.... , i want to know when my lawyer will file for me , is the USCIS will give me the extention so i can still be working ? and how long it take for processing to get the 10 years green card ? thanks i appreciate that.

  10. If you can prove you were married in good faith, you will be fine without the lawyer. In your case, I would bombard them with as much evidence as you can find.

    You can file the I-751 anytime after your divorce was filed. Looks like you can file now as you are supposed to file within the 90 day period before GC expires.

    Main thing is you having evidence you married in "good faith" and not just to get into the US. Besides the evidence of joint accounts trips etc. Get affidavits from a few friends stating you guys marriage was "real".

  13. As topic. I've filed for my petition to remove my conditions on residence and got the extension for a year letter on Dec 4, 2007. My extension is only good for another month and I still hear nothing from USCIS after I went for my biometrics appointment on Feb 08.

    At the meantime I'm applying for going back to school and the school just sent me email to show them my green card. I am so anxious since my green card is already expires and my extension letter is only good for another month.

    What should I do now? I heard I can make an appointment for the local USCIS office to have my passpart stamp but I don't know what is the process. Can I just drop in the local office ( but I'm sure I can't!!!! because the guard is asking for appointment letter everytime I went there )? Or if I need to make appointment how can I do it?!

    I need help pls!
