Hi guys i had my biometric last january and couple weeks later they sent me RFE and i sent it to them back, everytime when i check my case online it doesnt alow me to do it i dont know why is everybody had this issue with it? when i put the biometric reciept it says your case is pending the same when i check it before!! and when i put the other number what i got in my RFE it says we cannot found this case online call coustomer service bla bla, anybody can answer my question? thanks.

  2. If you mean the writing that is 'pursuant to 8.CFR' etc etc, yes it's normal. You can be sure that you got a 'template' letter, and these always have a little 'threat' in there to make sure you take care to do what they say in the timeframe they want it done. Don't take it personally, just comply with the instructions :D

    NOTE: YOU ARE GIVEN THIS DATE... IN WICH TO SUBMIT THE REQUESTED INFORMATION TO THE ADRESS AT THE BOTTOM OF THIS NOTIC.

    pursuant to 8 C.F.R. 103.2((11) failure to submit all evidence requested at one tome may result in the denial of your application. is that normal what they usually send on RFE they call it I-797E, notice of action ? please anybody help me with any idea i appreciate that.

    Yes it is called I-797E! Just follow and provide what they asked you and send it before the given date.Don't forget to return the notice too. Best of luck..

  5. Cool. Well, I mailed it USPS on Friday last week.. Paid $17.50 for that pleasure. Wasn't meant to arrive until Monday, but they got it on Saturday! Hopefully this goes fast, and in my favor :dance:

    Was looking for response time to an RFE, not overall processing time, thanks. :thumbs:

    California Service center is taking about 6 months or less if you look at this thread CSC I-751 Processing Times and the info on the USCIS website.

    I wouldn't anticipate it taking longer than 2-3 more months. They are getting out cases faster than VSC. :ranting:

  6. Just resubmit what you've sent and add more if there's more to submit. The RFE usually states what they needed from you.Mine was filed with a waiver and I received an rfe too asking for detailed statement which I submitted.Best of luck!!

Hi guys my lawyer filed back in December of 2008 throgh Divorce based on waiver, and today i got the letter from USIS that need more evidance and i had submit a lot like Mortgage for the house , and car loan together, another lesse where we lived before we bought house, tax return jointly 2006 and 2007 and bank statement, wedding pics and the pics when we were still dating, and letters, bills, proprety taxes,pics with friends , travel pics.... i dont know what is that mean? i fell like confuse and is this things normal ? can anybody help me please and get back to me i appreciate that thanks guys.

    just resend all that evidence from new and add something new

    i think it's normal and many people got it although they sent a lot of evidence too

    Hi there, this is my time line, i sent i-751 on Decmeber 15 of 2008 , and December25 i got extention letter, and Junuary 15 i did my biometric and i got the RFE today? thank you .

    I haven't posted in a while, but now that my immigration saga is over I felt like sharing a thing or two with you - I'm sure there are people here who can benefit from what I have learned.

    Long story short - my marriage is over. It almost cost me my life, so the fact that it's over is a good thing.

    For those of you who don't know me, here's the background:

    Came to the US in 2005 as a student (F-1 status). Met the ex the same year. Married Jan 06, filed AOS in Sep 06, interviewed Jan 07, conditional GC approved 1/4/07. Separated March 08, divorced Nov 08. Divorce took forever - I had to do it myself without a lawyer and I had a hard time getting the paperwork right. I filed my I-751 waiver in October 08, when I wasn't yet divorced, and I checked box "e" - battered and subject to extreme cruelty. This kind of waiver you can file if you are still married and living together, separated or divorced - it doesn't matter. Here's my timeline:

    10/14/08 - mailed I-751 abuse waiver to CSC

    10/16/08 - package received at CSC

    10/17/08 - check cashed

    10/23/08 - extension letter in the mail (NOA date - 10/16/08)

    11/22/08 - biometrics (I got a bio notice about a week before, can't recall the date)

    11/24/08 - touched

    11/25/08 - touched

    1/29/09 - approved. Card production ordered.

    That was it. No interview. If someone's interested in my evidence list, I can post it if I find it on my computer. I had about 700 pages - bona fide marriage and abuse, all over a 2.5 year period. I had things like restraining orders, police reports, shelter records, ex's numerous emails with threats and name calling, letters from 3 therapists that I saw during this nightmare of a marriage etc.

    One thing you should remember - do not stay in an abusive relationship. Your life will be a lot better once you get out and start anew.

    Hi there i was reading your experiance with immigration congratulations , i filed last December of 2008 based on waiver, and i got my extention and then i did my biometric , its been 3 weeks now and i didnt heard anything yet, how long it take normaly to get touch ? i sent a lot of evidance like Mortgage together, we bought car together, 2006 and 2007 tax jointly, bills, traveling, pics, email, another lease for appartment ect..... so i hope i will hear something pretty soon thanks, i appreciate that.

  12. I've posted on here a few times before with questions about what happens if you and your green card sponsor separate after filing for the removal of conditions. Well here is my experience (and good news!):

    Timeline:

    11/30/2007 NOA for I-751 received

    03/01/2008 New Biometrics taken

    09/08/2008 Request for evidence received

    10/16/2008 Responded to request for evidence

    12/15/2008 Notice of interview for conditions removal

    01/27/2009 Date of interview, petition (unoffically) approved

    My husband and I separated just after I filed the I-751 in 2007. I did not notify the USCIS about this since I really didn't know what I was supposed to do. In September of 2008 I received a request for evidence, which specifically states that if you have since separated you must give details. So I sent in as much evidence as possible of the good faith of the marriage (even things I had already sent in case they got lost) and explained about the separation. We had also just filed for divorce, but it was not (and still is not) final so it wasn't possible for me to re-file with a divorce waiver. Anyway, I was then called for an interview. My husband very graciously agreed to attend it with me even though it was a long drive for him and we are not on the best of terms. We had a long wait at the USCIS (because they lost my appointment letter after I handed it in at the front desk!), but finally the interview itself was very straight forward. The interviewer was very nice, and even said he couldn't really see why they'd sent my case up for an interview in the first place. He told me my petition would be approved and stamped my passport with a temporary year-long green card so that I can travel while my case is being officially approved and the new card ordered. (He said that whole process could take up to 3 - 4 months! I've got no idea why.)

    So, it's all over. After all that worry and stress it finally seems to be done (although I will be very glad to see the real 10-yr greencard when it comes!).

    Best of luck to everyone else, and if anyone has questions about filing while separated please feel free to ask. It really should not be an issue if you have good evidence that your marriage was real. If you do have a divorce finalized AT ANY TIME while your case is pending (even if it's the day before your interview or something), or before you file the first time, it is necessary that you file or re-file with a divorce waiver, or else you can have big problems further down the line.

    Hi Nadi32 i was reading your experiance and i was wondering if you can help me in my situation ? my lawyer had filed for me last December of 2008 and after that i recieved my extention and then i did my biometric 3 weeks ago and i havent heard anything or touch ? i sent a lot of evidence mortgage in our names , cra loan in both names, join taxes 2006 and 2007 pics , affidavit from friends, bills , traveling together, proprety taxes, another less for the old appartment we use live , bank statment, ect.. do u think this is enough ? how long CSC take to procces the case thanks.

  13. Finally after almost 6 months of waiting - my son and I are going to received our green card soon! Thank you Jesus! I would like thank everyone here in this site - for your committment and effort to keep this website helpful, friendly, and very informative.

    To all of you who are still waiting and in the process - keep on and don't give up. Read the instructions and just follow through. CSC is doing really a good job! :thumbs:

    Hi mooninlove congratulations to you guys approval, did u submilt a lot of evidence ? because i did filed with waiver last December of 2008 and after that within 10 days i did my biometric, so now iam still waiting and i sent a lot of evidence... how long it will take me to hear something ? thank you very much .

  14. You are being processed in California. Right now California is processing applications as quickly as 2 months and as long as 6 or 7 months. 4 to 5 months since filing date seems to be pretty average. You can check the CSC Status list in this forum and you will see when the people who are getting approved right now filed and that will give you a good idea of what to expect. Good luck.

    I haven't been approved or denied. I had biometrics done on 10/25/08.

    I've also not hear of anyone filing with a waiver taking 1+ years. Where have you seen that info?

    See attached file from an excel spreadsheet that I made to get an idea of best / worst case scenario's for approval after biometrics date.

    look across all the boards you will find that most of 751 good faith waivers take one year plus with either an RFE or interview, sometimes both.

    your spread sheet is valid for normal joint petition cases

    Hi 3600rs it doesnt take that long for waiver its the same i think , i have a friend and i habe been seen many people here in visa journey it took them 5 to 8 months or last then that , it could be if u file in Vermont yes but California its pretty fast , one guy here got an approvall without interview he is from England u can look it up his time line.

    alawai and mza : please give ur detailed timeline etc, I think many I 751 waiver guys are waiting for one years plus.

  16. it is not a big deal but it isn't required.... just a waste of money in my opinion.... that is what the 80 dollars is for... to pay for the fingerprints and passport pictures...

    if they already have been sent with the package, then there really isn't anything you can do I guess...

    yep thats true i dont know why she asked me for it , should i tell her why , beacuse i will do my beometric and they will take pic for me ? thats confusing hahahah , thanks for ur advice .

    yeah just explain it to your lawyer..... I think passport photos used to be required.. maybe that is where she is confused...

    ok i will tell her that , but the lawyer has experiance she know what she is doing , if its not required why she asked me to take photo passport ? i will talk to her about this point see what she will say ....thanks.
