  1. CSC responded to the inquiry made by my congress rep with:

    The processing of the case has been delayed. A check of our records establishes that the case is not yet ready for a decision, as the required investigation into the background remains open. Until the background investigation is completed, we cannot move forward on the case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 90 days of this letter, you may contact us.

    Is there a way I can check into the background investigation to see where it's hung up at or any way to check on it at all? Is there anyone that knows or somewhere on the net that actually shows all the things they check when doing a K1 visa? I know there isn't much I can do but I just wanted to see where it's hung up or even try to understand what part of the process is causing the delay. I mean, for all I know, CSC could have just sent it off and now they are throwing it on the people that do the background check saying they are delaying the process.

    After my senator inquired into the case, they sent me a follow up email that said exactly the same thing. EXACTLY.

    Our case was approved the next day. Hopefully the inquiry will speed things up.

    i need big time HELP... send my I-129F on March-03-2009 and got my I-129F NOA1 back on March-16-2009.

    still waiting for I-129F NOA2.. looking at the time line posted here today its saying March-21-2009 are being processed and person who file 3 days b4 me got his NOA2 10 to 12 days back.. so i dont know what can i do? or do i need to do anything?

    on USCIS web page still saying "Current Status: Case received and pending."

    No, dont just wait. Do something. It is past the deadline of 5 months and that means two things.

    On USCIS website they have a, "what to do if outside the posted processing times section."

    AND you need to have contacted a congress person or senators office to have them look into your case.

    Two days after my senator called. I was approved.

    Dont just sit there!

    Go get em tiger!!

  3. well it's been a week since i got my noa2 notice..and i called NVC they sill dont have my case yet. The guy told me can take 2-4 weeks to get it..that i don't understand. since it's only california and vermont who process them and they send them to nvc which is in new hampshire..4 weeks for snail mail is unreal?

    sigh lol i just wanna get to the stage the rest of you are at since all my paperwork is already filled out etc :)

    You and me both Kimbear. I called yesterday as well and they have yet to receive it.

    I'll be sure to let you know when they get mine, as you will probably be the day after or the same day.

    I bet they sent ours together. lol

    before we get married my husband wanted me to apply for a student visa so we can live together as quick as we can , but i didnt get it !! now im affraid if they'll put me in AP !!!

    There they tons of questions that the interviews asked.

    NO. In fact the agent told us that when her status was up, the computer alarm went off, but when he showed up at my house,

    which was a really nice place on a golf course for a couple of college kids, HE was even shocked. He said, "Why are you on my list, I go after drug dealers and thugs."

    So he had no idea either. But he did go on to explain that it was a computer generated list and when her visa was up, and she wasn't registered full time......

    Here they came.

    Plus it was in a small state, so not too many peeps im sure.

    Homeland Security AND immigration showed up at my door and took her to jail.

    She told the DHS agent the truth, that she stayed to graduate and walk across the stage, and he pulled some strings and

    extended her legal stay until after graduation. She then left on her own accord.

    The question....

    Will this now affect our K1 that is currently in NVC?

    It has us both worried.

    When does the overstay clock start ticking?

    She finished school on Dec 15th 2007

    The F1 has as a 60 day grace period meaning she should have left by Feb. 15th, 2008.

    DHS showed up on April 19th, 2008. They let her out of jail on April 21st 2008.

    Graduation was May 10th 2008.

    She left on May 12th 2008 (With DHS watching at the airport, lol.)

    Talking to our lawyer, he seemed to think that it wouldnt affect us, but the Moroccan consulate in

    Casablanca is a stickler and LOVES to deny people.

    Any input would be greatly appreciated.

    The clock starts ticking immediately after the grace period, however you say they "extended her legal stay" and if that is the case she had no overstay. 180 days overstay seems to be the "do not pass" line.

    That said...Casa Blanca is a sitckler and loves to deny people. Good luck

    Sounds like no. Depotation is a legal procedure involving a court and a deportation order, there is no question what is and what is not a "deportation" and this sound like it not.

    So even if the consulate views it differently, then the overstay starts after the grace period. Thats even better for us cause that only means she overstayed by about 60 some odd days.

    No....

    See that's the thing, we have been in contact with the guy that originally arrested her ever since. He seems to think that we wont have a problem at all.

    However, nothing was stamped in her passport, but she was given a piece of paper in a sealed envelope that she gave an immigration officer when she left.

    The guy at DHS has been a godsend. We have talked with him ever since, and he always responds to us the next day with any questions.

    We asked him about form DS 156 and there are two questions she has to answer yes on.

    1. Have you been arrested.

    2. Have you ever violated the terms of a visa.

    The consulate in Casa scares the living daylights out of me, and it seems they make up their mind before the beneficiary even gets to speak.

    So we are SOOOO nervous about them looking at those two questions and being like.....ooOOOPPPsssidaisy.

    NOOO

    ARGH!!!

  9. My petition was approved on AUG 6th just got a copy of NOA2 on Monday :dance: . I come to find out my fiancee is moving to different address in same city in India. I like to change the address before my petition goes to Consulate. One way to do this call NVC. But there is no way to find out if NVC has my petition or not unless I call them everyday. I have called twice already but they still do not have my file in their hand.

    What should I do?

    Well, I hate to say it, but call everyday. I am in almost the EXACT same situation. I am going to wait a week though from my NOA2 to start calling.

  10. Not sure if I am in the right place for this but I am giving it a try. We received our NOA2 today and wanted to post it so maybe to help others with hope in there timelines. We received our NOA1 on march 19, 09 and got our NOA2 today Aug 11, 09. waited 145 days. We filed with the Vermont Service Center. Hope this can help with others that are waiting. Visa Journey is a great place with many great people Thanks so much, never posted before so forgive me but I read and read here everyday!!! Thanks to all!

    Congrats on your NOA2, things should move quickly now.

    You should look at posting in your appropriate forum. Under the K1 visa processing, there should be a MARCH FILERS group that is for the Vermont Service Center.

    Is your fiance going to interview at the Casa consulate?

  11. Congratulations Jomegard and Kimbear!!! I'm really happy for you guys!

    I'm a little disappointed, I'm 10 days close to the 5 month mark and nothing yet. I'm definitely looking into contacting the congressman. How did you guys do it? Phone, email, letter? Should I wait for the 5 months or should I go ahead and contact them now?

    Also, my fiance is military and has moved around the US and overseas a lot, so that's why this probably takes so long... Do you think calling the Military help line would help more than inquiring at USCIS?

    You have done enough waiting. Contact them immediately.

    I contacted mine through a letter and then they called me as soon as they got it.

    I am from a VERY unpopulated state though so that helped a lot.

    I would call.

    Often, until you get the help you need.

  12. there is no certainty really..the cbp officers have 100% discretion on whether to let someone into the usa or not. take a look at me.. i went down to chicago to see my faince in september for a week. went back in october stayed for 2 months..tried to go back for xmas and was denied at two diff poe's. reasons given were "insuficient ties to canada" i even have a copy of the refusal paper that i had to give to the CDN guards to let me cross back into canda.

    if you do not have a job or an apartment / lease / house/ kids that stay behind when you visit they can deny you entry. they did it to me.. i even brought back proof with me the 2nd time i tried to cross and they still refused me. i was treated like a criminal my fiance and i were interogated for hours while my dogs sat in a car in december, and i was photographed and fingerprinted. they even took the keys to his car..and then had the nerve to give me ###### for not leaving the window open on the car...and i got really ticked off at that point and wanted to punch the jerks, since there was no way i knew i was going to be in there that long, and coudln't even go to my car cuz i was not allowed to leave, let alone they had my freaking keys !

    anyways..you can always go to their site for more info..www.cbp.gov. or google search. chances are you can find a bunch of ppl on this very site who have experience the same thing.

    maybe mine was a worst case scenario..who knows..but it was on my bday..the day i will remember as it was the day i was forced to be separated from my love until i see him again when i get my visa.

  13. Maybe an Amerikano or Filipina that can type clearly to where i can understand it, and that has already gone through this stuff, could give me some info that will clarify this sh*t in my brain. Everything has kind of gotten jumbled together and if there are some shortcuts to getting all this done i'm all ears.

Okay so i had canceled my Fiance's visa because i broke up with him and he didnt go get his visa. and now were back together hes in india and im in america. and so they told me i have to refile my petition and i came across this on the instructions: if you have filed two or more K-! visa petitions at any time in the past or previously had a K-1 visa petition approved within two years prior to the filing of this petition, you must apply for a waiver. To request a waiver you must submit a written request with this petition accompanied by documentation of your claim to the waiver. okay so now i have no idea what this waiver is and how to go about doing this? someone help!!

    I think your fine and dont need a waiver. You just refile.

    Read it slowly.

    If you HAVE filed two or more.

    That means in the past I believe.

    You need to get a waiver. From the sound of things, this is your second visa petition. From what I understand, that means your third attempt at this needs a waiver.

    Not the second.

  15. I came to America Fall 2007 to spend a High School Year and left the states Summer 2008.

    I went back to the States Winter 09 and had problems getting in the country (they did not tell my why. they just kept asking

    a) did you start school late B) did you overstay c) did you leave early d) did you change schools?)

    While I was in the US (Visa Waiver) a college told me I could just apply for a change of status, get my F1 in the States and start going to school there.

    (I would have gone back in March and applied for a F1 in my homecountry)

    So I applied and -of course- got it denied, since I did not even qualify for a change of status.

    I went back after 139 days (USCIS had told me to stay til the decision) and applied for a F1 visa in G.

    They denied it.

    Reasons were the high-school-year.overstay (which never happened!!!!), the second overstay (which was not an overstay, USCIS told me to stay!) and just not enough ties.

    Now me and my fiancè are planning on getting married and we are wondering if my "past" could affect the CR1 and what we can do to avoid probelms?

    Well first of all, if they are telling you that you overstayed. Then you probably did. Now we are going through the K1 process and my fiancee stayed a tab bit longer than she should have. Homeland security found her and told her to leave. When we applied for the k1 visa I asked my lawyer the same question as you. The simple answer was, my fiancee overstayed by 120 some odd days. The definition of an overstay is somewhere around 160. Find out from USCIS what dates they are considering your overstay. If its more than 160....then you are out of luck and will not be able to enter the US for a period of 10 years.

    Sorry to be the bearer of bad news, but you NEED to know those dates ASAP.

    AND GOT APPROVED!!!!!

  17. Well... I lied. I just checked the website after complaining about no touches. Finally got one. FRICK!!!

    After all this, the call to the senator, the emails to the lawyer, and the complaining on VJ, the date FINALLY CHANGED! lol.

    I dont even care what it was, I SEE something now.

    Funny though, they told my senator that they started on July 31st and the touch came on Wed Aug 5th. The next day, the 6th was when my Senator called back.

  18. I feel you Kimbear. Its a gut wrenching process, but hang in there.

    So, you have seen touches on the website? I haven't seen anything. No touches nothing.

    We did get pretty detailed info. We even got a follow up email from USCIS documenting the phone call and the contents.

    I hope it ends soon. If you get approved soon, hopefully now you can have a marriage in Jan 10'

    I hate all of this, but she (for me) he (for you lol) is worth it!
