LoveMyTico got a reaction from Kader96 in Background Security Checks on i130 Petition
Once they told me I was undergoing "additional" background checks it took about a month maybe a little less for them to clear me and send to an officer. It is such BS because they held my file for 10.5 months before doing anything with it. And I don't believe for one second that it was additional checks... I think it was them just starting from scratch but ran out of excuses. They are lucky I got an approval last night because today I was planning on making tons of phone calls about the new posted processing times. 5 Months at TSC is a slap in the face after I waited 11 months. I learned that they do more lying than anything else. Every time I was told something, it ended up being the complete opposite and obvious they run a super disorganized business.

There really isn't a current thread for progress updates for the I-601 waivers. I wanted to start a thread where everyone can just post their progress. If everyone could create a timeline and put it in their signature it would really be helpful. It doesn't matter when you filed. Any reported progress really helps everyone along the journey !!

You don't need to pay for an expedite. Mine was completely free and informal. My lawyer old me it was a waste of time so I did it myself.
My reason : that my employment was ending I wanted my husband here to help pay the bills. That's it.
We filed I601 waiver end of Aug. Expedite approved mid Oct. Husband entered U.S. January 18th.

LoveMyTico got a reaction from mupsyc in Form I-601 For religious objection to vaccines
You asked questions and you are getting answers;. It seems you do not like the answers that are being given,
With that I will tell you a little story that happened just this past week at my daughter's school. I got a call and a letter from the school stating that a student has been diagnosed with Pertussis ( whooping cough) highly contagious. Most likely from a kid who was not properly vaccinated or from a child who's parents are against vaccinations. As a parent, I feel that every child should be vaccinated. It protects the health of not only that child but everyone the child comes in contact with. IMO it is irresponsible to put others at risk and I would imagine the USA feels the same way. The letter I received explains what the symptoms are and to take your child to the doctor immediately if those symptoms show up. Also that if the child is infected, they have to take antibiotics, And the entire family should take the antibiotics too even if they show no symptoms. They also highly recommend getting revaccinated So for me, its not worth the stress.
You are free to practice any religion you wish ( yay USA) and to request a waiver. You stated that he just decided not to get any more vaccinations when he was 19. I am not sure his personal preference would be enough to get the waiver.. The USA has a right to say who enters just the same as your husband has the right to say what goes in his body

Experience....my husband just arrived in the US 2 months ago. I also have a friend who works for the dept of state. I asked her about the updates and she told me the date changes when somebody updates a field. It does not update if somebody is just viewing the screens..you'll hear something soon.

He cannot come on a family-based or immediate relative visa if he is no longer married to your friend. If his ban is over then maybe he can apply to visit. If not, your friend will be taking the children to visit him
if she wants them to spend time with their father.

If they are no longer married, he does not have an avenue for a visa until his children are 21 and they file for him.  She can send the kids to him for visits if they want to see him.

LoveMyTico got a reaction from Ma🇺🇬 in I-601 waivers ask to file in ciudad juarez by interview agent.
And was she only unlawfully present? No crime other than that?
I found this . hopefully it will explain who the qualifying relative is. I don't believe a child can be the qualifying relative for a simple overstay. SEE BELOW
What is an Application for Waiver of Grounds of Inadmissibility and Who Is a Qualifying Relative?
An Application for Waiver of Grounds of Inadmissibility is filed by an alien in the event that an alien has been denied admission to the United States. Different sections of INA § 212 allow for the application of a waiver of inadmissibility. Waivers must establish that a qualifying relative will suffer "extreme hardship" if the alien is not admitted. So who is the qualifying relative? It depends on the ground of inadmissibility. A waiver for prior unlawful presence (INA 212(a)(9)(B)(v)) or misrepresentation (INA 212(i)) requires it to be established that "the refusal of admission to such immigrant alien would result in extreme hardship to the citizen or lawfully resident spouse or parent of such alien," whereas a waiver for criminal history (INA 212(h)) requires it to be established "that the alien's denial of admission would result in extreme hardship to the United States citizen or lawfully resident spouse, parent, son, or daughter of such alien." A US citizen fiancé(e) may also be a qualifying relative [9 FAM 41.81 N9.3(a) and 8 CFR 212.7(a)(1)(i)]. For the purposes of this memo the Application for Waiver of Grounds of Inadmissibility will be referred to as an I-601.

LoveMyTico got a reaction from LinG2018 in CEAC Status Updated Date
A friend of mine works for the fraud dept at the DOS. I asked her about updates. She said the only way the date changes is if someone adds or updates your file. It does not change if someone is just viewing your case. It could be the USCIS is communicating with the DOS about your case. I used to stalk the ceac a thousand times a day. Ours updated daily there for a while. It was comforting to know somebody was actually working on our case.

Being here illegally is ILLEGAL. I'm not sure why people think its not. 10 years, 20 years or 2 years...if you entered illegally, that is deportable.  Read the immigrating laws. Its very plain.
The new administration is vowing to prosecute anyone who enters illegally.  I would not doubt the fact that the DOJ is now following the laws already on the books, that there will many more deportations.  They aren't playing anymore. It has nothing to do with nice or mean people...it has to do with the rule of law and respecting the laws in the United States.
The sooner your husband leaves, the sooner you'll know if he will be granted a visa.  Its not up to Mexico, its up to the Dept of State at the U.S. embassy in Mexico.
BTW, I recently knew a guy from Costa Rica who was here 20 years..had to go back to Costa Rica and finish the process... He waited 15 months..and he wasn't deported. That's just how long it takes.  Consider all the backlog in Mexico...you need to plan for a long stay. Its a definite possibility.

The excuse they use is further security checks...our I130 took 11 months. The last5 months they gave us the additional security check excuse. I had the senators office checking once a week the last 6 weeks.
The state dept only took 30 days because I followed the guide on this site. The waiver only took 4 months..I got sick of these people and asked for an expedite. It was approved. So it went fast from there..

I was told that all processing has been slowed down recently since the new administration took over. My friend now works in the state dept processing passports .
Nobody knows when it will pick up ...

I'd say the administration has slowed processing down on everything. I read something online about it. Sorry I can't Remember where.. Just the other day actually.  Depending on what the DACA deal turns out to be and the chain migration decision.
I think I read it on www.dmldaily.com ..you'll have to search through the articles.

They can't move AP but they can get some kind of response to your case. It really depends which office you call and if they want to help. Some send an inquiry and Leave it at that others go above and beyond. I do know there is a separate dept at the uscis that only deals with inquiries from the senator's/congressional offices. I always got a response within a few days. Sometimes I even got a timeframe and Then the senator's office would follow up for me.

My suggestion is to get a lawyer who's experienced in waivers...the last thing you want is a delay because your package isn't complete
