Filing back taxes is not hard, as mentioned by Penguin. Once she files them, I have read that you must request TAX TRANSCRIPTS from the IRS to include them in your documentation when filing. Information on the tax transcripts:
Use Form 4506-T to order a transcript or other return information free of charge. See the product list below. You can also call 1-800-829-1040 to
order a transcript. If you need a copy of your return, use Form 4506, Request for Copy of Tax Return. There is a fee to get a copy of your return.
    IRS Tax Transcripts
She must have the last 3 years of reported taxes.
In regards to demonstrating the intent to reestablish domicile, the general recommendations are that:
    - You secure a lease in writing for where you will live. It can be from family or a friend who can "rent out" space for you guys.
    - She can register to vote in the state where she last lived.
    - You can obtain quotes for moving your personal belongings to the U.S.
    - She can purchase life insurance online and include you.
    etc.
You can browse some of the threads here for more information, specifically look for anything mentioning "intent of reestablishing domicile".
    Hope it helps!

TOM&Riz reacted to housewife in Montreal filing explanation please
    Hello
I am new here. I've been researching for several hours (I've been up since 4 am) and I'm lost and confused.
Anyone who wishes to help me I would greatly appreciate it.
I am an american citizen. My hubby is canadian citizen. We have been married a long time and now want to move to the USA. I am a permanent resident of canada for a long time, (over 10 years for our marriage and my residency).
I went to Montreal. I brought all the required documents, with the exception of translations, and they accepted everything telling me to get the translations done which I already did. We paid the $355. They said we can bring the translations next time.
They said we will receive info in the mail and then we will come one more time to get the visa which is by mail.
My questions are: I did not receive a case # is this normal??
How long generally till you get stuff in the mail.???
I am assuming the stuff in the mail is the RCMP report that he talked about. My husband has never lived anywhere else than here so he only needs that one and the medical?
Can you do the medical before getting the packet in the mail to be ready??
I know they said the RCMP was good for a year so they said we could get it but to wait a bit.???
I am in the process of restablishing residency in the US. I have a place to live (lease) phone, cable, internet, cell phone, (all US), business that I am buying, and will be buying a car.
We are married for over 10 years and have lived at the same address for all of the time we are married. What is required to prove of ongoing marriage? Is a letter from the bank stating we have a joint bank account enough??
Affidavit of support can be joint finances and we are ok with that.
    What else do I need???
Any help would be most appreciated.
Thank you in advance. I'm so lost with all the abreviations and locations.

I have some questions about the affidavit of support. When they look to see if the USC can support a spouse are they looking to see that the annual income equals 125% above the poverty level or have that its all there when they check. See me and my wife currently are far from being able to do this ourselves. My wife has not worked in the states for years. So from what i understand we will need a co-sponsor, the logical ones would be my wifes parents who both reside in the states. There quite well financially right now and have sold some land that puts allot in there pocket. However this is not a job. They are both retired and most of there money right now is from selling land and inheritance, would they still be able to qualify to be a good co-sponsor. Also Is it possible to have more then one co-sponsor.

Ahhh Tommy...how many of those communicable diseases did St. Lukes check Riza for?
How about you? How many communicable diseases were you checked for when you returned from the Philippines?
How about all of the other U.S. citizens who travel overseas? Do you suppose they were checked for any diseases?
By the way, your link, and the links in your link, did not give any evidence whatsoever that illegal aliens spreading communicable diseases is a "major issue" or is "yet another disaster."
So much for reading comprehension, critical thinking, and logic.

Interesting how you sugarcoat what potentially could be a much more intrusive situation for a legal permanent resident, or even a U.S. citizen. Would you feel the same way if it happened to your loved one? How about if it happened a second time? Do you even realize that some American citizens have no ID?
Also, I have friends who have been repeated victims of racial profiling. It's a humiliating and degrading experience. Chances are pretty good that some law enforcement officers in Arizona will act no differently than some officers here. Racial profiling will happen.
In addition, the new law will not even put a dent in the number of illegals. It solves no problems.
So, the question remains: with so much downside to the "driving while brown" law, is it worth the benefit of deporting a few illegals? I think not.
However, it will be nine black robes who ultimately will decide the constitutionality of this law.
