  1. The best way to do it is to file for the K-1 fiancee visa. If you adjust status on a visitor's visa, they look to see if the person entered the States with good faith and the intent to leave after 60 days (not with the intent to marry). If they suspect that he entered as a visitor with the purpose of marriage, change of status will most likely be denied. Plus if they see that his fiancee is here in the States, a tourist visa would be extremely difficult. No trickery is the best way!

    You could always have a reception in Mexico before coming to the States. But no, you can't get officially married in another country with the K-1. You can with the K-3 however.

  2. I'm sure it's not a big thing. VSC messed up on my fiancee's birth date! I would get it cleared up, though, because they base their questions on the form and you don't want any discrepancies, especially between that one and future forms. All I had to do to fix the birth date was fax a signed statement to the embassy my petition was headed to (was at NVC and they told me the same thing - that I couldn't change it there), and there was no delays at all! I didn't submit proofs either. My fiancee simply wrote, "My birth date was incorrect on the I-129F and needs to be changed to ... for case...". Signed it and that's it. Hope it helps.

  3. Ok...not quite sure how this happened. I KNOW I filled out the right birth date for my SO. I called NVC, and the person there slipped up and said they already sent it out to the embassy, but then she said whoops I have to verify the information. So I gave her the SO's DOB, but she said that's not right. Since they already sent it to the embassy, is it just a matter of calling the embassy and changing it? Or do I need to contact NVC and USCIS as well?

  4. Just got the NOA2!!!!!!!!!! Its been 6 months minus 17 days. About time. I was feeling just like its unjust blah blah nothing had even been updated since 8 22 08 even at 5 this evening...got an email at 7 15 and the website was updated. I put in a request to the congressman the week before (since the senator explained that as a state senator he doesn't deal with federal matters). About time! To all those waiting, keep in mind that the approval can come at ANY TIME

    I have been keeping up with the posts for a while and at least there were other people in the same boat :) Looks like everyone is getting approved now. I filed August 19th...and I haven't had a touch since 8/22/08. What is going on?? I called my congressman and they said they would look into it and they have called USCIS but it's been a week and USCIS hasn't gotten back to him. I called USCIS acting mad but they gave me a different answer: Some cases may not be processed in order and that I wait until 6 months have passed. What do you guys recommend?? Can someone approved recently perhaps send me a case number since I heard the case numbers are processed in order...I was doing ok during the wait because I knew everyone else is waiting, now that it seems the day has passed, it's nuts.......thoughts?

  6. Hi everyone.

    I'm new to the forums.

    I know this question has probably been answered a lot, but maybe I'm not searching right, or I want clarification for a specific scenario, so I would greatly appreciate your guys' help.

    My fiancee and I recently got engaged, and I sent in the I-129F for the K-1 visa. We were talking and think it would be better if I saved up some money and we could get married there, then come back on a K-3. My two big questions are these:

    Do I have to decide now between a K-3 and a CR-1? Or can I start one and then pick whatever's faster? I'm getting confused on the difference between them, and if the I-129F is required in both cases.

    If I lived down there, I, of course, couldn't prove an affidavit of support, just my tax returns and such for the year before (since I am not working in the US...living there). Is this possible? I would really like to get married, and then try not to separate after that. Is this possible by having my parents sponsor? If so, when do I put this down, when starting the visa process, or at the time of filing for the aff.?
