    The hardship has to be with the person who is petitioner, since you do not have any children with your wife, I am not sure you can use your 6 kids as the hardship, the hardship has to be directly upon your wife, not your children

    Have you been accepted into the school yet? If that hasn't happened you can't apply for a student visa
    1st step, apply and be accepted into the school that is accredited and show you can financially support yourself (I had to show the school I had $20,000) THEN you can apply for the student visa
    The student visa is a non-immigrant visa so you'll also have to show that you intend on returning to your home country, this is where the overstay may trip you up

    Honestly, since you worked and paid taxes, they already know you were working. Might as well own up to it on the G325A and save yourself the trouble of a misrepresentation charge

    An L visa is dual intent, why did she have to lie? I don't understand
    Now, the way to fix a misrepresentation is not with MORE representation. If you try and lie to the government again, get married again when you are already married and submit it to the government, then they will likely find out and cause you heaps more trouble

    Because your visa expires in 2013 that does not mean you are authorized to stay until 2013, an F-1 student visa requires you to be A STUDENT, if you have graduated and have not extended your visa through OPT, then you must leave

    WOW, it was just an accident. Don't beat yourself up. Simply contact the consulate and see if you are still able to travel on it. If you are, then no worries. If you aren't, they will probably re-issue you a visa

    We are not here to judge what the OP did. IN fact, many people enter the US, activate their visa, then return home to complete job, family obligations, sell a home, settle debts. Many Candians do that, so do other nationals. No one is here to judge that.
    No, advanced parole has nothing to do with Cr-1 visas. You DO NOT need advanced parole to leave after you have activated your Cr-1 visa - once you enter, you receive your stamp in your passport which acts as your travel/work authorization and you can turn around and leave the next day.
    The OP's wife was never in danger of abandoning her residency EVEN IF she was allowed to enter under her CR1

    I am sorry, but it doesn't look like you'll be returning to the US. You have no basis to apply for a visa (and thus, apply for a waiver)
    You can send your son to his USC father in the US, but you would not be able to join him.
    Your son is resistant?!?!? He's 7. Of course he is resistant. My 7 year old nephew is resistant to eating broccoli, but he sits at the table until its gone.
    I know this is breaking your heart, but your son will adjust. You need to focus on making his life the best one possible and not focus on returning to the US

    You don't have to prove you entered the marriage in good faith, if you are filing jointly, you are trying to prove you are STILL IN A MARRIAGE, which you are not. Don't file jointly, you are not in a marriage although you may still be married. Especially if you haven't made a secret about moving out, your best bet would to avoid any speculation of fruad and not file jointly

    She may leave the US whenever she wants. However, to return she must have her green card or her advanced parole document. Leaving the US without one of these means you'll start from scratch with a spousal visa, new filing fee and a long wait to get her back to the US

    Actually, I'll have to disagree. My information is fine. Simply asking the OP to find out his status in the US is not a bad thing. I didn't say he WAS a deportation absconder and if you'd like to review the thread to clarify I'd enjoy that. I said he needs to find out if he is.
    If USCIS issued him anything after the denial, it is likely his family hid it from him like they did the denial. So it is not out of the realm of possibility that this has extended FAR beyond the simplicity you are suggesting. While I may be an alarmist, you are a simplist.
    The OP needs to figure out his status in the US. That's simple.
    Oh and he isn't married to a USC. that wasn't even mentioned so that path you suggested is...also wrong
