  1. I filed the I-129f before my wife changed her daughter's last name. (I don't know if my wife took the name change documents to the fiance interview or not .... my guess is that she did) Her daughter did not interview because we had her follow to join about 6 months later. When we applied for her 2yr green card, we sent the name change documents along with her birth certificate.

Great Thank you for your reply. Best to you and your family..

  2. Hello,

? I did a k1 visa for my wife and a follow on the k2 child to follow. I named at the time of doing the orginal

129f his fathers last name which is what is on his birth cert.

My wife before she came to the Usa had his last name changed to her last name and that is what is on his passport and

what was given to the usa embassy in Thailand before he was issued his right to follow k2 visa.

I am now in the process of getting his green card and sent in his birth paper which is required and got an rfe in the mail asking for another copy of his birth cert and a copy of my wifes 129 I-797 (notice of action).

I sense that since I already gave a copy of his birth paper that they might see a problem because his last name now doesn't match what was on his I-129f? I have a certified copy of his name change in Thai and english which now has his mothers last name and I have a copy of his bith paper which has his fathers last name.

Can any of this be a problem or if I send the name change and an explation all will be ok?

    Thanks

  3. Its common for this to happen if you didnt have the boys name on the Post office list or in your mail box. Check with the Post office to see that all names at the residence are on file. Make sure all names are inside mail box.

USCIS will attempt to resend the RFE automaticaly. If you want to take action rather than wait use USCIS web site to make INFO PASS appointment to go see them in person. They will make sure the RFE is re-sent. You may be able to submit the required info at thier office so take it with you.

Thanks for the reply. I dont know what information they need because I haven't seen the Rfe request that was sent back to the Uscis from the Postal service. I called the Uscis and they said I cant make an info pass till I receive the Rfe? I dont understand today is April 1st and I called on March 15th to have sent back out that they say they haven't sent it back to me yet. I guess it is all in there hands and if I miss the deadline to return the information I will have to find further action to take. I just cant believe I got all the other papers including the biometrics appointment and that the Rfe is the one that gets returned!!

It really doesnt sound to automatic that it is sent back out.

  4. Question

The post office returned my sons rfe's as undeliverable back to the USCIS and I called them to verify my address and

this was on March 15th. The Uscis said they cant give me anymore updates for another 45 days.

Has anyone had this happen before to them?

I am worried because these are time sensitive and you only have 87 days to send bank the information that they need.

Does it really take 45days for the uscis to send you back out the documents needed?

    Thanks

  5. NEED HELP PLEASE

I am in Thailand now and need some input. We met with our attorney and he said the guy cannot come to the interview and it is actually recommend. This is where I need help! He says that my girls english is poor and the current Co is very strict and he will more than likely deny my interview based on english skills? Can this be true?

He says she will more than likely have to wait for a second interview! Right now I am already heartbroken.. We have done everything correct and to based on poor english I am in shock! I think she speaks english ok I understand her but the attorney says the co is very impatient and is mean!! What are your thoughts??? Thank you

She can request the interview be conducted in Thai. The only issue would be if he asked the language in which the two of you communicate. If it is english and her english is very limited, it may raise the question in the CO's mind as to whether or not the relationship is bonafide.

I was able to attend the interview with Rin, but have seen on here recently that it is no longer possible to attend.

John raises a valid point on communication. The CO has to be sure the relationship in "bonafide", and in order to have a bonafide relationship, there needs to be communication. The stronger the better, otherwise it raises doubts.

I too attended my fiancee's interview, but that policy has obviously changed.

Wouldn't an extensive record of phone calls answer this concern? After all, if anything it's more difficult to communicate that way and if you have phone calls that last more than a few minutes, one could surmise you're actually talking to each other, no?

Couple more comments what if yo chose you spoke in thai together and you wernt at the interview? How could the fact of not knowing english well be proven? Could it by emails? We have over 300 emails in english and 6 months of phone records with many many calls per month?

Also is it true the Co is a total jerk? and very impatient with the women that are slow in there english response? I am slowly turning into a very hateful person(never have been) and becoming very frustated with the process. You can not really say that having 60 plus pictures and 300 emails and 6 months of phone records and a lot of receipts of the two of you spending time at locations ie: plane tickets etc.. In addition comilng to Thailand twice to visit is not enough to prove the realtionship is strong and sincere!!!

And the fact that she might be denied because her english is not well is a #######!! However it is not my decision and I guess up to someone that has never been involved in our lives and never will be.

There are several consular officers, so for your lawyer to refer to the consular officer is incorrect. I don't want to suggest anything, but I wonder if your attorney isn't just trying to cover his ####### on this in case it doesn't go perfectly. When is your interview? You haven't updated your timeline.

    OK

Someone is bs ing me here? Why would the thai attorney tell me that only one officer does the interviews? Is it really true that there are more than one? Please advise for me. I would think that there is more than one but I do not know? interview is tommorrow!! very nervous and dont want to be let down....

  8. 2. They still give us better visa treatment than we give them. It's not like you have to drive to DC for an interview at the embassy and pay $130 for your visa. (And have a 50% chance of denial with no refund...)

Only 50%? For a B (tourist) visa, I think the denial rate is much higher than that -- at least in Thailand. Surely $130 + thousands of denials each year probably pays most of the consulate's bills.

HAHA... I agree... I just tossed that figure out.

Well I am leaving next week for Los for the interview the following week. I hope all goes well and I can bring my fiancee back to florida with me. I know she will like it here she is very happy to come. I am going to cambodia then on to Bangkok.

    Good luck to all.

  9. Sorry dont mean do sound dumb but I am assuming that it would be question one 1) as you say? and the surname is my last name correct? or my Fiancee?

    Thank you

Not correct. Your fiancee is the applicant and you are the petitioner.

Sorry, #1 only - I shouldn't have included the other one.

Well I got response back and have interview date on the 16th. Now I have to decide do I wait a couple days and wait to book travel to Bkk, or come through Laos or Cambodia? Very important question for all?? Can my girl leave with me out of Laos or Cambodia with no problem as long as she has Usa visa stamp?

    Thanks...

  10. Embassy lost Packet 3!

My fiancee EMSed all her documents, but now the consulate says they are missing passport photo, checklist and passport copy! If I hadn't emailed them, we would never have known they had lost this paperwork!

In our case, everything was in the same packet, but the consulate says it only received DS-230 (part I)

How do you ask about if they received the paperwork? What I mean is when writing the email what should you put in subject line case number etc?? My attorney sent in our paperwork should I have my attorney ask? I hope that this isnt common!

Does anyone know if interviews have been delayed because of the troubles in Bangkok?

    Good luck..

These are the instructions I got in an auto-reply from the consulate:

Thank you for your inquiry to the Visa Unit of the U.S. Embassy in Bangkok, please read the following carefully: Due to the large number of emails received daily, we are only able to respond to case specific questions. 12. I just bought Anna's flight from BKK-JFK. It's a one stop flight with a three hour layover and arrives at 3:15 PM.

Total cost billed to my card was: THB 19,260, which should be about 546.69 at today's rates. Not bad! I'm planning to meet her in NY and spend a few days in Manhattan before bringing her back to Florida. One ways from JFK to SRQ can be had for under $100 right now!

FYI: The other great thing about this flight is that the change fee is $35! Perfect for a visa waiter.... it's also refundable (less $35) if somehow you found a deal that was even better.

Question for you how many days after you sent packet 3 in, Did it take to hear back with an interview date?

    Thank you..

She sent it last Thursday. They called (which I don't think is normal) her the following Monday. Not sure if she got the official packet 4 yet.

    Thank you,,

My atty said they would get an email from the embassy? I dont know what is normal.

    What airline please?

  15. Is getting interviews so soon at the BKK consulate a recent trend? I was banking on it being minimum 10 weeks from embassy receipt of Packet 3.

Yes it's much faster now... you'll be in the first half of December for sure. But the visa is valid for travel for quite a while; you don't have to fly immediately.

My paperwork went today. Do you think I will get in by mid December? I hope so. I heard it is only taking about two weeks to get appt.??

    Thanks

    Good luck all

  16. Thank you for posting the sites. It seems like a one-way ticket for my fiancee from Bangkok to Washington Dulles is going to run around $1,300. I wonder if it would be worth her asking in Bangkok to see if she could get it a little cheaper.

I looked into this week about a one way to bkk and I called delta and told me since I am a usa citzen that I have to have proof of a return ticket or a forward of onward

travel. I will buy roundtrip and pay the change fee then buy a one way for my girl when she gets visa and change my ticket to her flight ie same airline that I plan on using. Any thoughts on this??

  17. Ok. Another question about medical. My tirak had her K-1 medical exam yesterday at BNH in Bangkok. First, they gave her all the vaccinations (apparently), running up the cost to more than 6,000 baht. I was a little upset about that, as she does not need to get those until later, but anyway, it's out of the way now ...

My main question: I was under the impression that the doctor sent the medical report directly to the consulate. Instead, they've handed it over to my fiancee. Should she mail this to the embassy herself?

I guess it really varies because my girl went to bumrugard and the doctor told her that all was good and the report would be sent to the embassy directly. And no mention

    of vaccines?

  18. Also, are you sure you can attend the interview?

I never said the petitioner could attend the interview. What you said is accurate, the American petitioner is allowed inside the embassy, but shall not sit during the interview.

I never claimed you said the petitioner could attend the interview, although I can see why you thought that as I asked that question in response to your response to raptorea, however I was asking raptorea that question again because I had asked him previously when he first asked if it'd be better to attend the interview. I don't think he saw that question to him, and then he posted it again saying his lawyer told him it'd be better to attend, so I asked him again.

    Question about packet 4:

After fiancee receives appointment letter, is that when the I-134 (affidavit of support) should be returned to consulate?

The I-134 should be BROUGHT to the consulate WITH the beneficiary at the time of the interview.

    Question about packet 4:

After fiancee receives appointment letter, is that when the I-134 (affidavit of support) should be returned to consulate?

I-134 should have been mailed to the consulate with Packet 3. but if she didn't mail it then she can bring it along on her interview date. After she gets her Packet 4,DO NOT return anything to the consulate, all she has to do is to wait for her interview date to come. hope this help :)

This is incorrect. The I-134 should NOT have been mailed with the Packet 3. The I-134 should be brought to the consulate on the interview date.

Unless something has changed in the past few months, then this is the way it is done.

Ok I understand about interview however I will be there anyway as support. Now next to the next question Has anyone heard of the need to have 60 plus photos of the two of you for the interview process?? Thank you....

No, this isn't true either. You do NOT need 60+ photos. We had around that number but that's because we would always take lots of pictures. You'd be fine with, say, 12.

So if you don't have 60, don't worry. How many do you have?

Around 35 or so with many family members and also the two of us. Thank you.

Oh, then don't worry you have nothing to worry about. 35 is more than substantial.

Although 60 wouldn't hurt one bit, 35 is more than enough.

    Good luck.

Thank you for the replys. I guess what still amaze me is the proof that you have to go through to say you or show that you really love each other. I suppose that it is no

wonder with no disrespect that people living close to our borders choose to side track this step so to speak.

Maybe I am looking to much into it, But it seems very hard to get through this whole process. Maybe it is just missing your loved one.?

I think a movie could be made out of the process of trying to bring someone you have fallen in loved with to your country. Who knows there might be one already.!

I am already looking in hindsight and thinking about what a great feeling it must be once the airplane touches ground and the both of you are in the Usa or whatever

    country you are from.

    good luck.

  19. Also, are you sure you can attend the interview?

  21. Questions,

Does the orginial relationship letter that you sent the uscis get forwarded to the embassy in bangkok. Can you be to detailed in your writing of how you met and what you did? I was asked to write another letter for my girl to take to the embassy in bangkok and my attorney said my first letter might have been to detailed?? Can this be a problem? There was no talk of bars or sex or any thing offensive. We did go to pattaya for two days out of the two months I was there. Is this a horrible thing? We went dancing and to the beach!

I was very detailed day by day on the two months I was visiting? Has anyone heard of offering too much information? to embassy as a bad thing. I plan on being at the interview as well. I heard this helps sometimes?

I assume you mean the letter of intent when you say the relationship letter?

If so, then you CAN be as detailed as you'd like, however it's definitely not necessary, and personally I wouldn't. Why make it so detailed and long if it's not required and won't help you?

There is nothing wrong with going on vacation anywhere (Pattaya) and as long as she isn't a bar girl or anything sketchy like that then there's no problem.

    Good luck raptorea.

Oh, and about attending the interview, from what I understand this isn't even a possibility now. I forget who was talking about this on this thread a few weeks back but was saying the US embassy doesn't allow the USC to go to the window where they're being interviewed with the beneficiary.

    Thank you,

There is no sketchy business. Just the first "letter of intent" that I sent to the uscis was very detailed day by day almost. and then I got a new thai attorney and now they have me worried because they say you are too detailed and the new letter as far as continue relationship should be shorter in details. I was just wondering if the first letter of intent is sent to the embassy in bangkok? and also the thai attorney says it would be a good idea if I attend the interview? I plan on going and my hope is her and me will be on a plane back home after a couple days after the interview. I am sure all will be ok. All I know is I love my future wife very much and she loves me to to and we want to spend our lives together and want this whole waiting process over and have other people saying or not saying that we can or cannot be together.
