    You file an I-864.  You leave spouse as zero, so you don't count her twice.  You include her as the intending immigrant.  Your household count is 2.
     
    Dad files an I-864 as your Joint Sponsor.  It's him and the intending immigrant for a household count of 2.  You can not combine your income with the Joint Sponsor's income.
     
    Alternatively, your dad could file an I-864a as your Household Member instead of being your Joint Sponsor.  The household count would be 3.  You and your Dad can combine income.  

    Personally, I prefer Dad filing as a Joint Sponsor.  You can do it both ways and see what the US Consulate will take.

    Unfortunately, there is nothing you can do.  This is one of the major drawbacks of adjusting status in the US.
     
    If putting an earlier date on the I-131 would cause USCIS to process it faster, then everyone would be doing this.  Your desire to travel by a certain date is not relevant to the processing of the I-131.

    Adoption would CUT OFF THE FATHER'S RIGHT TO HIS DAUGHTER.
     
    As the stepparent, you will have some rights - this will be specific according to Virginia state law.  The mother can sign legal paperwork to give you certain rights; including guardianship if she is incapacitated.  

    If something happens to the mother, the father can give you guardianship of his daughter.  

    YOU NEED TO TALK TO A FAMILY LAWYER IN VIRGINIA.  You are asking questions that NO ONE HERE IS QUALIFIED TO ANSWER since EVERYTHING WILL BE CONTROLLED BY STATE LAW.  CAN NOT EMPHASIZE THIS ENOUGH.

    A work visa requires a US employer to prove they can't find a US person who can do the job and that is why it is necessary for them to find a foreign worker.  US laws requires the US employer to pay to obtain the visa and it is illegally for the employee to pay or reimburse the employer.  The US employer will need to hire an immigration lawyer to obtain the work visa.  The suggestion above is for you to let this lawyer sort out the work visa for you.

    It's going to be next to impossible for your brother to find you a US employer who can't hire a US person for an HR position.  Sorry.

    The OP has been lurking around.  He's been here in the last hour as indicated by his profile but has not posted again.

    This is a nasty divorce involving child custody.
     
    The OP thinks he has leverage in the custody battle if he can get her deported.  The potential to abuse the immigration system to gain an advantage in a custody battle is the precise reason that his attempt to get her deported will go nowhere.  Public policy is not going to support that kind of BS.

    As a previous poster advised - move on and learn to co-parent.  She's here.  She's staying.  She's going to become a US citizen.

    You are mixing up between 1) your marriage being legal and 2) CO DMV accepting your marriage certificate as a basis for a legal name change.  The State of Colorado recognizes your marriage.  The Colorado DMV is not recognizing you've legally changed your name.
     
    You can not get "remarried" in the US because it's not a thing.  You are already married; that's why your husband was able to immigrate to the US as the spouse of a US citizen.  

    Try using your US passport to get your name changed.  Try going to another DMV office.

    The case can not be expedited.  The law does not allow anyone to get a visa before their PD becomes current.

    Google "Uniting for Ukraine."  That is the way to get your brother to the US.

    This is not a fault of the manual rules.  This is your fault for not checking the rules.
     
    This is hubris.  

    As a good Christian, you should take responsibility for your failures instead of blaming others.  Many people situated similarly to you have sought help instead of acting on their own in order to avoid your predicament.

    Average 6-12 months before COVID.    Probably longer now.
     
    After USCIS approves the I-130, it is sent to the NVC for the next set of applications and documents.  The transfer can take 2-3 months.
     
    Interview 1-2 years after sending in the I-130 if everything is done correctly.

    The consular agent is wrong.  Your daughter would not get a cert issued directly to you.  You have to pay for the N-600 Certificate of Citizenship if you want her to have one.
     
    You don't have to pay the $220 immigrant fee for a plastic green card since she automatically became a US citizen upon entering the US on her IR2 visa.

    Sorry about all of this.  

    Reapply with Poland and state the exact reason why she needs to enter.  Not tourism.  But to take her son to an immigration interview at the US Consulate/Embassy.

    If you and your wife can't go, then you have to find another adult who can take the son to his medical and interview.

    What is wrong with thinking like that?  

    The world is not new.  Whatever you think is new because you thought of it is really things that us old folks have already tried.  You ain't the first couple to want to live together and play house.  You will not be the last.  We get people like you practically every day.  I've played house, so no judgement.  

    The world is run by old people.  They made the rules.  I'm old and I have to deal with laws established by people that are long dead.  Zoomers haven't defeated the Boomers.  (GenX asked to be left alone with our latchkeys.).   

    There is nothing wrong with your way of thinking.  Unfortunately, the laws is set to keep Romeo and Juliet apart.  Old people are mean.  Boo.   We don't understand that the world is different and old people don't understand you young folks and the world you live in.  

    We're advising you to be realistic.

    Visa shopping is not going to work.  People aren't stupid.  
     
    There is an electronic record of everything you apply for.  You are so desperate.  Accept that you are not coming to the US anytime soon.  The CO told you this.  
     
    You're getting advice from a bunch of old guys.  We're trying to help you young man.  

    Wisdom cuz we're old.  Not telling you what to do.  Telling you what life experience has taught us.

    A lawyer can't do anything.  A foreigner can not sue the US for a student visa.  You don't have a right to a US student visa.
     
    You messed up.  The burden is on you to overcome the legal presumption that every visitor intends to immigrate to the US.  You didn't do that.  The burden is on you to show non immigrant intent upon entering the US.
     
    You've been told that it's too soon.  This is what is likely to happen if you apply again now.  Imagine I work with the guy that denied you.  He's my co-worker.  I'm going to overrule him and give you a visa?  Why would I do that?  Why would I question his decision, overrule it and give you a visa?  Why do that damage to myself?  When the boss asked why did I overrule my co-worker, what is going to happen?  One of us is going to look bad.  No reason for me to give you a visa and screw one of us over.  We don't know you.  We care about our jobs.  We back each other up.  Real adult life.  

    Wait a year.  Give it time.

    Or file for a K-1.

    It would illegal for you to work in the US while visiting your spouse.  It would be worse if you were working for a US company or servicing US clients. 

    Someone doesn't know US immigration laws.   Someone is suggesting you break US laws and put your immigration visa at risk.
