I just received my permanent residency here in Brasil where I live with my husband. I've been living here for over a year now and I emailed the consulate asking if I could go ahead and petition for my husbands CR-1 visa now instead of waiting the six months of legal residency they say they require on their site. I also asked if we could turn in the required docs for the visa the same day we file the I-130 and for a list of those docs. Basically I want to make this process go as fast as possible.
The response I recieved back from them was vague. It wasnt really the yes/no, here you go type answer that I was expecting. The email simply said find the attatched instructions (which there was no attatchment) and provide us with your husbands full name and contact number so we can set up the appointment. Thats it.
I emailed them back with the name and contact numbers and mentioned there was no attatchment.
But does this mean that we can file striaght away?

You should try bonding with her. Spend some 1 on 1 time with her. Take her shopping or something. Maybe if you start a relationship with her you wont feel so uncomfortable having her around. But for sure you need to remember that she'll always be a part of your future husbands life so you need to accept her into yours.
I know it was strange when i was a child and my mom brought a new guy into our lives. But he was cool and put a lot of effort into having an relationship with me and eventually we formed a father-daughter bond. I keep in touch with him to this day even though he and my mother split up years ago.
It's strange at first but eventually, if you are willing to do what it takes, you become a family. GL

Getting a tourist visa in Brasil is not easy at all, it requires very strong ties, If you have your own house and dont rent that is a great thing because that shows strong ties, a nice amount in your bank account helps too. Letters from his employers stating how long he has been working there and that his position is a much needed one and that his job will still be there when he comes back after a couple of weeks vacation will help too. Its all about being able to prove that he will not stay in america and since you are american and he is your husband you will need to really prove those strong ties. I have known of people that are very well off in Brasil that were not able to get their tourist visa. It happens but like i said their requirements are stern, and as far as I know as long as you can show that you have been in Brasil for 6 months that is good enough to start DCF filing, double check with the embassy but I dont think you have to wait an additional 6 months of being a resident.

I am American and my husband is Brasilian. We live in Brasil where I just got my permanent residence. Now I have to reside in Brasil for 6 more months before we can do DCF for my husband.
We want to spend Christmas in the states this year, which is about the same time we'll be filling. I was wondering if we'll have any trouble getting a tourist visa for my husband. Would it be better to file after our trip? Any advice would be helpful.

I would definately talk to an immigration lawyer. These processes are very particular and when things get messy its better not to just guess and make assumptions on what to do. Get someone who knows what to do.
And I would stop talking to the guy until your divorce is finalized. For two reasons. One, it may cool your husband down and make things easier. And two, if you keep on and end up having to go home it will be difficult saying goodbye to a new boyfriend.
