    WIth her B2 denied already and a US spouse, it's very unlikely she will be issued a visitor visa in the short term. Because you have returned to the US its unlikely that you would be eligible for a DCF. So it looks like the chance of her coming to the US in the next year is pretty slim. If you plan on being in the us permanently you should begin the spousal visa ASAP

    OP said the American Samoan would reside in a US state; thus they'll do F2A after they marry.
    I think you are referring to Tuana v. US in the DC circuit.     If he comes to the US on a work visa with the purpose of getting married, that could be considered immigration fraud, and could result in serious consequences. The purpose of a work visa is to work, not to get married.

    I don’t think there is an alternative. They are pretty strict on client letter due to H1B abuses by the consulting companies.

    Yes.
     
    Once you have their email address you can simply send a scanned image of your withdrawal letter.  Mailing it in is a gamble with China customs.  EMS/DHL costs are close to $100 if you can find a local pickup.
     
    The key is putting your case number in the subject line.  The web mail form has no way to attach anything to it.

    You mentioned here  that he is a drug user and a cheater, well these two things are not considered abuse by the USCIS. USCIS is very clear that allegations of drug use ,alcohol,cheating,sexuality WILL NOT be considered ground  for VAWA.
     
    To prove psychological abuse you need to prove a pattern of CONTROL (checking your emails,phone,Facebook,controlling who called you and who you called,calling you all day to check your whereabouts; and/or ISOLATION (prohibiting you to talk or to see your family and friends ); and/or HUMILIATION (making remarks about your appearance , clothes, accent etc); COERCION( telling if you don’t follow What he is asking you then he will hurt you or hurt some of your family);DEGRADATION (calling you names ,humiliating you in public,making fun of your religion etc)and you need to prove that you are suffering depression  and /or PTSD due to the abuse suffered,if you are depressed because your husband uses drug or is cheating on you Uscis won’t take this  into consideration,then forget about mentioning these things to immigration.
     
    .USCIS does not accept recorded material and most States consider illegal to record someone without the person consent, plus his confession might be about cheating and drugs and as I mentioned before these things won’t get your Vawa approved .
     
    You have a disfuncional and unpleasant marriage for sure.I am not saying you are not being abused but considering what you are posting here I don’t see circumstances of abuse.I saw just one circumstance of abuse (you are just  eating noodles), will Uscis approve  your Vawa because of this?NO,noodles won’t get your Vawa approved.

    is possible to do this, at China Embassy/Consulate in USA - but - is it worth it? hard to say...
    can carry (in the airports)
    --passport (tickets must be purchased in passport name)
    --greencard (allows her to re-enter usa)
    --certified marriage document (shows married and single name, linking up the passport and greencard)
    then will have no problems at the POE in USA.

    Must talk to a human at the POE, tell the human to change the designation from CR-1 to IR-1, show the marriage certificate. Then wait for the human to do it, asking human to show you the change on the screen.
    Sure, it's a few extra minutes at the POE - but who cares? trade this for doing it again in 2 years - who wants that?

    I'm not suggesting you ever initiate a service request.
    Instead, the ISO can LOOK at the computer, tell you many things about what was received, and when.
    But you must ask the right questions, also.
    A short list for you:
    1. Was the RFE Material received? If so, on what date?
    2. What happened to the physical casefile after the adjudicator added my rfe materials into the casefile?
    3. Has that adjudicator processed any casefiles past mine, in the queue , or no ?
    4. I'm concerned that my casefile is lost. I've had a service request in, and the service request was supposed to locate the casefile. I've heard nothing back on this service request. Please look on your computer, scroll down a bit, and tell me the last action you have on my casefile.
    5. Any returned mail pieces on me? (if yes, go over the correct address again, ask that all returned mail pieces be sent to you)

    IME, yes. A Tier 2 Supervisor. I talked with 1, one time, when the I-130 was with USCIS.
    Tier 1
    Tier 2
    Tier 2 Supervisor...
    I was on hold almost 2 hours, waiting for that human, after talking with a Tier 2, so hopefully you won't have the same hold time.
    Must to ask, though, of a Tier 2, to be transferred to a Tier 2 Supervisor. I not know of this level, until that phone call.

    It's possible it was done in error.
    Get an ISO at USCIS, and give them an earful (whilst being polite)
    mentioning that the casefile was misrouted and it's on USCIS to request it transits to NVC.

    The medical is valid for one year, 
    so getting it done right prior to interview day is better. 
     
    She has to go to Guangzhou anyway - the medical exam service there has next day turnaround for the medical packet - 
    to get it done in BeiJing might actually be a waste of time and money for yer lass ... 
     
    Now - the timeticks between NVC-OUT and GUZ-IV-Open vary widely, based on casefile transmittal method.  No One Knows which method HER casefile will utilize.   Could be 2 days - could be 5 months, between those two timeticks - and no one can accurately forecast because it's NVC's choice on how it goes out to GUZ-IV. 
     
    So - with that said - the BEST window that I would suggest to you - is that you suggest her to get the medical exam done no more than a week before the scheduled interview.   Guangzhou is better, IMO, than any thing to get done in BeiJing.   This actually helps a lot - as later on in the process, the date of medical exam determines whether or not she needs another medical exam for any adjustment of status process.
