Ekto Oktan got a reaction from OldUser in I-130 Expedite chance (Humanitarian And Financial Reasons)
After a long time I just came back for updating this post with results

We sent this Expedite Request from 3 Channels

1 ) Directly To USCIS - They even not processed it because it is not enough evidence.

2 ) Embassy (DCF) - We just ask permission to embassy for Filling Petition from Embassy Local filling. They not accepted that.

3 ) Congressman Office - We just contacted Senator office they contacted USCIS after like a 20 days USCIS rejected because they do not think it is Eligible for Expedite they directly sent Main link.

However in the end Sleeve Gastroectamy Or Other kind of bariatric surgeries are not reason for expedite as we can see if someone ever see this topic yep it is my results. However we are still on normal waiting line and in the end we got approved so I'll wait I Already got hope and it is enough Thanks Y"all

When I was going through the process to bring my husband over to the states, I applied for an expidited request with USCIS.  It took OVER 4 MONTHS for USCIS to respond back to my request, which they ultimately denied. Being that your wife's condition is not considered "life or death" you will most likely be denied.

I hate to sound harsh here, but due to the bad financial situation you and your wife are both in, I'd be in no hurry to get past the USCIS phase of the immigration process.  Once you get to the NVC part of the process, finances are going to come into play in determining if you will be issued the CR-1/IR-1 visa. You will not be granted a visa if the Department of State believes you will be a burden on US taxpayers. If your wife were to come back to the states and be put on Medicaid for her health issues, then she would be receiving tax payer funded benefits. Someone who is on tax payer funded benefits is not financially stable enough to support their immigrant spouse. She would have to get a family member to co-sponsor you which would put them on the hook to financially support you for 10 years.  That is a big thing to ask of a family member.

I have no idea about this. I know about healthcare costs in America, but I have no idea how to solve this because I've never lived in America before. If you have any suggestions, I'm open to hearing them, but I think the most logical option would be to discuss this detail with my spouse and see if she have a plan.

Good luck.  Just remember that even an expedited case is not fast...It's just faster than some others.

Yes, I am aware of that sir, but I believe that if USCIS approves, I will be able to get approval from NVC because, based on what I've read online, USCIS is stricter than NVC when it comes to expediting.

I've already tried my luck. I uploaded all the documents and necessary files. We even appealed to the Senator. I guess all I have to do now is wait and hope for a little luck.

After receiving all the responses, I agree with everyone. USCIS will probably not accept weight loss surgery as an elective and urgent condition. You are right about this, so I have decided not to submit an expedited request.

We will follow the normal process. Thanks to all again to everyone who responded ^^

If you are living together, I would have the beneficiary sign the form.

If her name is changed due to marriage then just start using it everywhere for everything.  A marriage certificate is a legal name change document.  Use her married name on the I-130 and put her maiden name as "other names used".

The visa, green card, social security card and all the other new US document that are derived from those documents will be in the name that appears in her foreign passport she brings to the embassy the day of her interview.  If she wants to changes her name, and if it is at all possible, it will save her untold hassle if she changes her foreign passport BEFORE her interview.  It costs $415 and can take a year to change the name on a green card once it has been issued.  I'm guessing(?) it is much cheaper and easier to update a Turkish passport.

Are you asking how a US citizen updates their name after marriage?

If so, they will need to make the change via local probate court and then update their name on their SSN, passport, etc. They will need to provide copies of the Turkish marriage certificate and any required translations to all of the relevant government agencies.

I could be wrong, but I don't think, unlike non-USCs marrying in the US, a USC can start using their married name legally until it's updated in the US.

The question is clear... Have you EVER previously filed a petition for this beneficiary or any other alien. If your wife filed for her parents then the answer is yes.

The answer is simple. Yes.   If you do not know exact dates etc for the i 130 submitted for parents that is not a problem. But given the information in your post , clearly your wife HAS petitioned for other aliens in the past.

Yes, you can file the I-485 and I-765 at the same time. We just got Jaycel's EAD Card in the mail in January. She entered the country on the K-1 Visa in August. It took just about 5 months from when she entered the country until she got her EAD card.
