    The clinic wants to see it to check for any drug or alcohol charges, which would be evaluated as part of the mental health/addictions component of their report. They would return the original so it could be taken to the interview.

    The London interview is all about her and her documents. All that is needed from the petitioner is your affidavit of support form I-134.

Due to the senior age, she did not work entire year and relied on my income. According to IRS portal, dependent should live with you more than 6 months to file as a head of household. Turbo tax software asked basic questions such as who and how many months lived with you till December 31 and it seems I am qualified for a head of household, but I want to confirm with those who faced the situation like mine.

    You can go through the IRS interactive assistant to see if she qualifies as your dependent.

    It was because you should have posted in the UK FORUM as a new question. This specific thread is not for questions about anything to do with London. It is supposed to be where people tell about receiving the IR1/CR1 visa interview notification from NVC. Your K1 process is different from the spouse visa process. Try starting a new topic.

    They quit asking for paper photocopies several years ago. IR1/CR1 files are all digital now. The “copy” is already in your NVC uploaded file. They will look at your original birth certificate, marriage certificate, deed poll etc then hand those back. Also London doesn’t need more relationship evidence at interview. It’s going to be easier than you are imagining.
     

    Also there is no dress code for the interview. In the summer, you would see everything from men in business suits to others in cut off jeans and tank tops (which won’t likely be worn this time of year). Dress warm and comfortable. And any long lines will be non-immigrant interviews. You skip that queue and go straight up to the security booth.  Same inside, go up to the desk (ahead of any non-immigrants queued) to get your sticker showing your call up number.

    Maybe you need to talk to them again about meaning of  foreign driver. You are a permanent resident of the US now. Wondering if that makes a difference. Try calling the general AAA customer service number and see if they give you the same info. Maybe skip the Austria stuff because you are a resident of the US and licensed to drive in CA. The person you talked to might not understand the nuances of immigration and pegged you as an Austrian driver/resident. I would get a second opinion in case the clerk got it wrong.

    I wonder if that is a California thing. State Farm in Texas told us the opposite…the car is insured, not the person. So if I allow somebody to drive my car, it is insured.

  7. TurboTax will do all it’s magic and proper calculations if you leave the SSN field blank. Ignore prompts that you haven’t entered it. It will go through your return at the end finding things that might need attention like you haven’t entered the SSN. Fix everything but the SSN. Decline e-file prompts. Go to print section and there are several choices. “Print return for filing” will print what is submitted to IRS (plus some instructions like where to mail.). In the case of an ITIN application, you should use the Austin, TX address provided on the ITIN instructions on the IRS website rather than your local filing address provided by Turbo.Tax.

     

    The above description is from using a desktop  version installed from a CD. I don’t know if online is different.

  8. W7s are not part of tax software. You won’t be efiling with an ITIN application.
     

    You have to prepare the return with any tax software, leaving the SSN/ITIN space empty. Print it.

    Prepare the W7

    Provide the ID requirements for the W7. Passport usually.

    Prepare a statement electing for the German spouse to be treated as a resident alien for tax purposes. Not part of tax software.

    Maii it all on paper to an Austin, TX IRS address. Or go to an IRS Acceptance Agent who can certify a copy of the foreign passport and send it all off for you. The German spouse must be physically present at the Acceptance Agent. There are overseas Acceptance Agents.

     And that is pretty much the exact statement I have posted many times that we created (based on Pub 519 instructions) and mailed with our tax return the year I entered the US and had no greencard or enough substantial  presence.

    There have been times when a given month seems to have been totally skipped (like last January). As much as people try to establish a pattern, (like previous “end of month” and before that “middle of month”) it sometimes just changes.

    And for the total of what the IRS says on this topic see Publication 519 US Tax Guide for Aliens by the IRS. It covers all the details of resident alien or non resident, students, exemptions, statements, etc. Dive into Chapter 1. Note that the 2021 edition is the latest published, but had anything changed, it would have been replaced. Just remember when it says 2021, read it as 2022 for your purposes.

    You have to meet one of 2 tests to already be a resident alien for tax purposes, or you may elect with you spouse to be one if you don’t pass either test. 
     Green card test—No you don’t meet this

    Substantial presence test—Work out the formula below based on days present in the US. From the IRS:

     

    You will be considered a United States resident for tax purposes if you meet the substantial presence test for the calendar year. To meet this test, you must be physically present in the United States (U.S.) on at least:

    1. 31 days during the current year, and
    2. 183 days during the 3-year period that includes the current year and the 2 years immediately before that, counting:
      • All the days you were present in the current year, and
      • 1/3 of the days you were present in the first year before the current year, and
      • 1/6 of the days you were present in the second year before the current year.

    Use the tax year so count all days 2022, 1/3 of days 2021, 1/6 of days 2020. Do you have enough days?

     

    If you have to use the election because you don’t have enough substantial presence,  you create and sign a document to go with your tax return. TurboTax has no way to submit such document with an efile. It is a software thing that the IRS has no provisions for accepting efile with such a document. You can print “tax return for filing” with TurboTax, add your statement, and mail.  It will tell you the address for mailing. 
     

    The above is how the IRS tells you to do it. It is unlikely the IRS would hunt you down and demand to count your days present if you didn’t write a statement.

    Yes that is correct where the foreign income is shown reported (1h) then a negative number showing the excluded amount (Line 8). The US earnings  reported on W2s will be shown on 1a as a total for both of you.

     

    i looked over the 1040 for 2022. It has changed from previous years. Line 1 used to be a single line. This year there are 10 parts covering Line 1.

    I pay foreign income taxes every year. I take foreign income tax credits every year.  I don’t care about paying foreign income taxes because I know I am not double taxes.

    Apologies. I didn’t really understand exactly what you were saying or how you thought she should proceed other than don’t bother choosing Form 2555. And I didn’t understand the CPA part since she wasn’t planning to use one. Sorry I misunderstood.

    You either paid Greece tax on your Greek income or you didn’t. If you did, you won’t be double taxed. 
     

    If you didn’t you will be taxed by the IRS.  
     

    How many dollars of taxes are you to save really? More or less than what you would pay a CPA.  

    If she wants to get a credit for Greek taxes paid, that is a form to fill out— Form 1116 or she can choose to exclude  the income from US taxation with Form 2555. One or the other but not both. Either one can save tax dollars. Yes one month is not going to make a huge difference, but the IRS has procedures one is to follow even if it’s only a month to report as foreign earned income.

    I will need to look at my 2022 TurboTax to review specifics for this year.  Each year things can be worded differently or the tax form slightly reorganized.  But if you wonder how to answer a specific question, just ask and I will try to help.

     They do not contact you unless something comes up that is amiss. Like if your lab results came back saying you had leprosy, they will tell you to get treatment or whatever. Except for lab results which they have to wait on, most anything else they would discuss with you while you are there. If they need further information from your GP, they will tell you and hold your result until they get it.

    Okay so you file with your husband. You have to report all his and all of your income (US and abroad) earned in 2022. Your US income is entered in TurboTax where it asks for W2 info. Foreign Income will be entered toward the end of the income questions under the section called “Less Common Income”. That’s where your January income gets entered. 
     

    TurboTax will take you through questions and do form 2555 ito exclude your Greek income. You qualify to exclude because you were a bonafide resident of Greece, allowed to work and earn money there.. It is written more for Americans working abroad so sometimes the wording is confusing. I think it asks what visa you had. That is not K1. It is asking what visa you had for Greece. Well none. You didn’t need a visa because you were citizen of Greece allowed to work there. You do absolutely qualify for the foreign earned income exclusion and if TurboTax says you don’t, then you have answered on of their questions incorrectly so back up and review what you entered.

    Everything you have written is correct. The statement you write and both sign is an election for her to be treated as a resident alien for tax purposes. There is nowhere in any of the tax softwares to include such a signed statement electronically, thus you print out a paper return and include the election statement and mail it if you want to follow IRS rules. 
     

    To be a resident alien for tax purposes she has to have a greencard or enough days present in the US. Had she arrived earlier in 2022, she would have enough days. But an August arrival doesn’t have enough days left in the year. If she visited for some long periods in 2020 and 2021, there is a formula that counts some of those days which might give her enough days present. Regardless of her days present, the IRS has a perk for those married to a USC where you can elect for her to be treated as a resident alien by writing the statement choosing for her to be. You can find all of that in Publication 519 on the IRS website. 
     

    You mentioned she has no taxable income. Did she have any income in Germany (2022) prior to her August arrival?  If so that is reportable on you joint tax return. It must include “worldwide income” for the joint filers. That income can be excluded so she wouldn’t pay taxes on the same money twice. Turbo Tax asks about foreign income in “Less Common Income” Toward the end of their Income walk-thru.  

     

    I said earlier that the signed statement has to be included if you want to follow IRS rules. If you want to cheat, then just e-file and pretend you wife qualified. The IRS doesn’t know when she arrived.  When I was a new immigrant (October arrival) we paper filed with a statement because we wanted to follow the precise written IRS tax law.

    2021 version is the latest they have. Chapter 1 covers resident or non resident as well as the statement.
