My husband has moved several times, but I have not updated those addresses with USCIS. We are no longer together, but not divorced. He will go for citizenship on his own after 5 years. Should I submit all of the past addresses to USCIS or is it sufficient to just submit his current address?

I bit surprised your husband takes this so lightly, but really don't know anything about Brazil, certainly there is a court order requiring him to make those payments. This is giving his ex the privilege of taking him to court for not making those payments. In my case in Wisconsin, they just set up a new government agency where I would send my checks to them and not to my ex. Before, if a spouse did not make those payments, the recipient spouse had to take that ex to court to demand those payments. Now the state would take that ex to court. It was that plus I knew however my ex received those monthly funds, my kids wouldn't see a dime of it. Used that as a strong argument in a court and received full physical custody of my kids. And won.
My wife in Venezuela was awarded child support payments, but her ex was refusing to give his permission for her daughter to leave the country. She countered by forgiving those payments in exchange for his permission to bring her daughter over here. He was already six years in arrears, so either had to come up with a small fortuned or go to jail. Just seems to me your husbands ex is in the same position, can claim donations from the grandmother, but your husband doesn't have any proof he is sending those payments. Would consider that more hazardous than dealing with the USCIS.
Really no qualified attorney on this matter, but seems like you need a letter of affidavit from the ex that those payments have been received on behalf of your husbands mother for child support payments. But suggest you see an attorney on this matter.
Thanks for your response. I discovered that his mother has every receipt of every payment made and the receipts are in my husband's name so seems everything will be fine regarding documentation.

After reading through the list of documents to send with the application, the one thing that might be an issue for my husband is the proof of child support. His mother pays and has always paid it. She has every receipt, but will that be an issue that my husband isn't actually paying? The child still lives in Brazil.

No problem. I have not had a job since coming to the USA (stay-at-home-mom), and my USC husband has been mostly unemployed for a year. They didn't even ask about jobs at the interview.
Thanks so much for responding. What was your interview like? What do they focus on? Since this is the last step of the immigration process, I just want to get it over and be done with it all.

I hope you're correct. Financially we're fine as my salary pays everything. Hopefully, that's enough for them to approve him.

My husband will be applying for citizenship in March of next year, but currently has no job. Worst case scenario, if he is still without a job in March, will that affect him being approved for citizenship?

I think he meant that if you did have financial problems (lets be clear, you CANNOT SELF-SPONSOR under any circumstances- It must be a USC that sponsors you) you would be denied for that reason regardless of which visa path you took. The requirements are the same for all visas.
And for the record, do NOT do K-3. From the posts ive seen from you two you guys still have ALOT of research left to be done, so get studying, and study hard. Read the same stuff not once, not twice, but at least 3 TIMES, if not more. For me i often found stuff i missed the 1st/2nd times around.
Besides, last i heard the K-3 was being phased out- i bet you heard K-3 is faster than CR-1 eh? WRONG, that information is old. Now Cr-1s are making it out FASTER (not to mention ALOT cheaper/easier) than K-3s, so it may or may not even be an option anymore. A person in their right mind WILL want to go CR-1, rather than K-3.
Since only the USC can self-sponsor, is it an option to have the $28K transferred to her bank account for the purpose of sponsoring him?

OK, I might be a stupid idiot, but this just stinks like a skunk. If she is truly his best friend, then he should be glad for both of you to go see her for a visit. Going alone, geeze, #######???? Someone told me, "Don't put yourself in a situation where there might be trouble," and if this isn't, what is???? You had better get this mapped out before he gets here. I have the feeling this woman isn't married either. I can't think of any of my married friends who would go along with this. Of course, if you call him on it, he will put the blame back on you. But you have a right to your feelings, also. Or, why don't you go spend a week with your best male friend? I'm betting he would have a couple of things to say about that---IF he truly cares about you. Good luck on this!

Is his best friend married? I doubt she is. If she were married, would she and her husband allow him to come visit so often and without his spouse? Nothing about this makes sense regardless of the country he is from. His best friend is American and she should know better than to even allow him to come to her place without you.
Do what's best for you and good luck with this one. It bothers you so you shouldn't make the decision to settle and accept this. This will eat you up down the road. Just wait until the first time he leaves to go be with her and you're home alone laying in bed at night wondering why he would choose to be with her instead of home with you.

Hi all,
sorry for so many questions all at once! I'm wondering what kind of letter you got from your employer for the affidavit of support. I have my last 3 years of tax returns and W2s, and asked my employer business office for a generic letter that says I work there, for how long, and at what salary. do I also need a detailed letter from my department head / immediate boss in more detail about my job? (I am the petitioner, and I make above 125% of the poverty line).

I typed up my letter at work and included that it was a permanent position, my date of hire and my salary. I printed it on company letterhead, placed it in front of my manager on his desk and asked him to sign it.

What? Anyone else do this? And why?
It's not painted on, but it looks like he processed it with chemicals (perm) so that it's very straight and then he uses hair product to keep it down. It looks ridiculous.

hi! i have a k-1 visa now and about to submit my I-485 (adjust status), i'll be submitting that together with my I-131 or application for travel document, in view of making my application for travel document or advance parole, i'll be needing to submit a letter explaining why do i need to apply for such travel document, i want to ask if anyone could help me or could show me a sample of a letter of explanation for advance parole? any help would be much appreciated, thank you
I didn't include an additional sheet. I just wrote that we were visiting family in Brazil for 2 weeks and gave them a date range.

hi all
I know i just sent off my k-1 and may be a little ahead of myself, but my sister is in the air force and said she will be our co-sponsor. My confusion is does her income have to cover her and my SO and me and my kids along with my income. I hope that is not crazy sounding and someone understands what im saying. By the way she is single and has no kids. Also do i include her life insurance because i see it on the form. Ty everyone
The co-sponser only needs to count herself and your fiance. If her income is sufficient then she doesn't need to show any other assets.

my brother is leaving for pakistan in a couple of months and he is about to apply for re-entry permit.my question is should we put the receiving address some address in USA or US embassy in islamabad pakistan?since he is going to be in pakistan in a couple of months and i have heard it usually takes more than a couple of months to receive the card definitely he will be in pakistan.
is it legal if someone receives the re-entry permit on behalf of my brother and send him to pakistan via courier?
he doesnt want to go to pakistan embassy because they are so slow and he doesnt want to go through a lot of security checks and obviously waste of a full day.
so,is it possible if someone receives his permit in usa and send him to his address in pakistan through a courier?
If your brother has a green card he doesn't need to apply for a re-entry permit. The green card is what he uses to return to the US.

I am in the same boat and it really bothers me that after having the civil ceremony in the US we are required to wait till the AP document clears and then fly out to my home country to have a religious ceremony here with my family and friends. I want to follow the correct process and wait but it still bothers me as you still cant plan things properly
I just dont understand this requirement of having to be married in the US. does anyone know why you must be married in the US? I mean what does it matter to them where you actually get married?
They don't really care where you get married, that's why they have different types of visas. A fiance(e) visa is for a FIANCE(E) not a spouse. What is so hard to understand about that. If you want to be married in another country then do so and then file for one of the SPOUSE visas.

We called the Immigration couple of times regarding the application of AOS and was told there is no deadline in applying for that after getting married.It was good news for us at least we can save up for the fee,$1010 is really big money. Today as I was checking on my papers, i saw my passport with the K1 visa expiration which is on Sept 2,2009. We called the Immigration again about this and we were surprised about what they said. We needed to file it asap before my visa expires.This is ridiculous!We relied on what they told us before that there is no problem whenever we want to file the aos.And now they are saying if we apply tomorrow for the AOS and if we did not receive the receipt of our application before my visa expires then i will be forced to go back to my country.This is not a good news!!!!!
Is this true? any experience like this with you guys?or a friend of yours?what did they do?Please enlighten us.
As others have stated, your K-1 expired the moment you entered the US. However, the I-94 is what will expire and it is best to file your AOS as soon as possible before it expires. You can file afterwards as we filed 3 months after the I-94 expired and all went well. Others have done the same and adjusted status successfully.
I'm not advising you to wait, but if you can't file until later, you have no choice but to wait.

Hello everybody,
I got visa K1 in july 2009 and got US the 17 July. I came back to my country 10 August and I hear I cannot to re-enter in the US now? That is true? My fiance and I didn't apply for marriage yet. I guess it's not possible after mariage until get the Greencard?

You entered with the K-1, did not get married, then went back to your country and want to reenter again? Is that correct? If so, you will have to start the process all over again for a K-1 or if you fiance goes to your country and it's possible for the two of you to marry, then you can file the CR-1.

The behaviour of the first few respondents in this thread was inappropriate and irresponsible. To the OP, I agree with Diaddie in her post above - I think it would be very difficult for someone to keep up a false front for 8 years. I am so sorry that this has happened to you but I agree, it does appear that you had a real relationship and unfortunately, it ran into problems. I compliment you on your attitude and behaviour about not seeking 'revenge', and hope you are able to find some healing for your pains soon.

as I filed my 2008 taxes Married filing separate (Couldn't file jointly as she is not a USC yet.
I'm no expert on taxes, but I filed jointly and my husband is not a USC.

On form I 485 near the beginning of the form, it asks for the A number (if any). Maria entered on a K1, and I'm not familiar with what they are calling an A number. I just looked at the small white card stapled on her Visa in her Passport and discovered it is the I94 they refer to. On the back of the I94 there is a number written that starts with an A. Is this the A number they are referring to on the I 485?
I was a bit shocked when I looked at the instructions for the I 485 and saw a filing fee of almost one thousand dollars. I didnt misunderstand that by any chance, did I?
One place to find the A number is on the NOA2. It is typed above the beneficiary's name. It might be the number on the I-94, but I'm not certain.
Yes, you are correct. The filing fee for AOS is $1010. That includes AOS, AP and EAD. Make sure you submit all 3 at the same time.

I am US citizen currently in the USA. My fiance is an Australian citizen currently in AU. We are about to file for the k1 fiance visa so that he can come to the US and marry me here. It has been quite complicated and I have quite a few questions that I am hoping someone can help me with. I am sorry that this is so long so please bear with me, I just want to make sure I get all my facts down.
I met him on the internet 2 years ago and traveled to Australia and stayed there for 2 years on several extensions for the ETA I had. They had given me till a certain date to file for a spousal visa to stay there but , he had lost his job and my family became ill. so, I came back a few weeks ago. We are trying to get him to the US as I have to stay here for family reasons. But here are my concerns...
1. He does not have a job in australia but he is a skilled welder. He receives benefits at the moment from centrelink and is going off of it in about a week as his parents have sold their home and is giving him $10,000 to survive and come here with. He does not plan on getting a job there as he plans to come here. Do you see any problems with this?
2. I am having trouble finding work here but I am sure that I will find a job before we are ready to file for this visa. Is it going to be a problem if I have only had a job for a couple of weeks before filing? As I stated earlier, I have been with him up until a couple of weeks ago so I am hoping that won't be a problem.
3. He plans to come here with at least $5,000. And we are hoping that he will be able to apply for him to be able to work here after we get married, which will be like the following week of him arriving. Will I need to give an AOS? And is that something I need to file along with the I-129F or do I wait until they ask for it?
4. He has a bit of a criminal history. A couple of driving offenses, A couple of marijuana charges, (small amounts) and one larceny charge for taking a couple of surfboards from someone off of a beach. These have all been cleared up. He had fines for them but they have been paid for and he has not been in trouble with the law for over 5 years now. Will this stop him from getting here? Will they give him an interview and decide based off that, or will he not even get a chance to have an interview?
Anyway, thank you for taking the time to read this. Any info that anyone has is greatly appreciated and I am sorry this was so long.
I always believed that if you had a drug conviction you were banned for life from entering the US. Seems my thinking might be incorrect. I don't know a lot about waivers, but it seems like you will need one. I believe you'll have to submit an I-601 waiver. Wording from the waiver instructions read:
If you are found to be inadmissible based on criminal grounds, you make seek a waiver of inadmissibility for the following: A controlled substance violation according to the laws and regulations of any country insofar as it relates to a single offense of simple possession of thirty grams or less of marijuana.
If he had more than 30 grams then he would not be eligible for a waiver and thus inadmissible.
Maybe others who have dealt with the same issue can chime in and share their experience. As others have mentioned, it would probably be wise to consult an attorney.

Sorry havent been here. We are married now. Finally she came May 8th and its wonderful.
we got married on June 27th. we want to file our paperwork now.
i have read the step by step guides which are amazing. and i keep getting stuck
on just one thing. what and how should i assemble this cover lettter on the step by step guide. (for aos)

Thanks for the reply. I know it's his responsibility, but he has no idea he's suppose to do this as I've been doing it since he arrived. I will update his current address.
