Unfortunately, your first obstacle is for your US citizen husband to want them, even if you had the funds, not only to bring them here, but also have the ability to prove you can support them. Would he even let these kids live with you?
No sense in going any further until you cross this bridge.

Could also be your name as to how common it is. Sure ran into problems with my stepdaughter with the USCIS having a very common Latin American name. Literally thousands with the same name had criminal records. The burden of proof she was not any of those was on our shoulders.
You are guilty until you prove yourself innocent.

Depends if applying for the 3 or 5 year, 3 year can take an hour. Want all that proof you are living and paying taxes and bills together.
Ha, the USCIS states the most important issue about becoming a US citizen is the right to vote. But the two parties have this situation well in hand with ID's, redistricting, and that outdated electorial college. If you live in a state with just a handful of electorial votes, don't even care how you vote. Wife's first experience in voting was for a local election where 95% of the candidates ran unopposed! Why am I even wasting my time voting was her comment.
Greatest motivation for gaining US citizenship is to finally become free of the USCIS that has been dictating your life for the last 4-6 years.

For one thing with most marriage laws, from the date you tie the knot, you both become liable for each other debts. But if one of the spouses has debts before that marriage, other spouse is also indirectly liable as that money comes out of the familly income. And how can an immigrant have previous US tax liabilities when they first came here?
One good question I can't even think of a valid answer is why her spouse insisted on filing a separate return, he is evidently supporting her and just paying a lot more taxes. Must have his reasons for doing so, but can see where the USCIS would really question this as a valid marriage.
In our experience with marriage, USCIS wasn't the bit interested in our love life, but really interested in their definition of a good marriage, we were paying taxes, bills, and owned joint property together as a valid marriage.
One option the OP has is simply wait another two years where are this marriage proof is no longer a requirement. But kind of sense they are having some marriage problems they would have to work out themselves. Or maybe her husband is dense on tax laws.

May work with an airline ticket within two weeks of travel, properly filled out DS-11 meeting all the requirements for a child under 16, bring the child and his green card with you. Being in person does make a difference, if you meet a stubborn agent politely ask to see his supervisor.
Since you have a good relationship with your ex, a notarized letter from him giving your son permission may help. Depending on whether you can prove sole custody. Your son by all definition is a US citizen. Dress nicely and be very polite.
Just got involved with my own personal problems, my stepdaughter only has one father and never blocked her from seeing him. But from what he pulled on her, she never wants to see him again. He is regretting his actions now.

NickD got a reaction from user19000 in I-751: What is the average number of pages sent in application?
I didn't count the number of pages, but recommend highly sending it overnight either USPS or FedEx with a return receipt using one of their cardboard type envelopes and with a return receipt. Also a personal check that you can print off the net or get a canceled check back as two means of proof that you have sent your application.
If the USCIS loses your application, it's your fault, not theirs, and you may need all the proof you can get that you did indeed have sent in your application in a timely manner.
Also made a complete duplicate of everything we sent in, just in case they do lose your application, can go nuts trying to remember all that stuff.
We used those folder over clips like the USCIS recommends and organized in joint, ownership, taxes, insurance, bank accounts etc., highlighting our names with the same address to make their job easy for us. Still lost our application from Nebraska to California, but with the help of our senator, they finally found it, but was asked if we had duplicates just in case. We could answer yes to that.
They want evidence, we have evidence. Nothing worse than having to make an extra 430 mile trip for an interview just to bring in another sheet of paper. That happened to friends of ours.

N-400, Part 3, box A shows your SS number, that is all they need to learn if you sent in a valid IRS form or not, one simple phone call.
My ex's crooked attorney got a court order for my tax transcripts and charged me an extra 300 bucks for that simple phone call with a court order where I could have gave them that for free. Tell me about privacy.
When my good wife hurt her knee, took her into emergency, stayed with her, but when the bill came in due to the privacy act, wasn't suppose to see that. When I was hit by that idiot kid, his insurance went back to the day I was born looking for per-conditions, have no idea how they knew I sprained my ankle playing football in high school, didn't even see a doctor about that. All of my medical records are now open to the public at the court house, so tell me about privacy again.
Living in a country loaded with hypocrites. Congress passed these laws, didn't want their wife's to learn they picked up some form of VD by playing around. We don't need leaders like this.

Was only twelve such service centers, believe they upped that to fifteen. All depends upon where you live and how difficult it is for you to get there. For us, nearest is no-parking zone downtown Chicago with a 700 mile round trip. Would be so much nicer if they moved that to O'Hare where you can actually take a plane someplace. So we planned our traveling accordingly.
We were in no rush in getting my stepdaughter's US passport, actually got far quicker service by not paying that expedient fee. Explain this!

Apparently, your wife's IO doesn't have the slightest idea how large corporations work. Wife works for a large corporation with many hospitals all over the state of Wisconsin. All of her employee records are kept in Milwaukee, the only place where the human resource and the accounting departments are located. And the only place one can call for employee verification, so that is the address we used. If they did call her actual place of employment, would have been redirected to the home office.
Not that the USCIS even looks into employment verification, does make any difference if you are working or not. More than likely, just an off the wall stupid comment made by the IO. If he really cared, would have made corrections to her N-400. With marriage, that IO also has three years of tax returns, but apparently this is a five year where tax returns are not a requirement.
Not worth making an issue out of this, just sit back and wait up to 120 days to get your oath letter. If not, then its time to contact your senators office. A lot easier and cheaper than taking the USCIS to court.
Can only imagine your actual concern is that your ten year green cards are about to expire. If they are, can make an infopass appointment to get either an I-94 or an I-551 stamp in your foreign passport. Explain you already applied for US citizenship, if they say no, then you have to apply for another green card.
Always not wise to wait to the last minute.

NickD got a reaction from Mariana2012 in After citizenship oath can you travel with foreign passport
They do take your green card away before they give you that certificate of citizenship that may lead into problems coming back. My wife to be at the time came here many times with her B1/B2 visa, but each time she came here, our POE wanted to see her return ticket to issue her an I-94 with a close time limit to her return ticket. When generous would give her an extra couple of weeks.
So it may work for you if you had a return ticket. When I checked into this, the vast majority of illegals are here with overstayed visas. So wonder if they even check those I-94's. But then in the immigration process, they do check on overstayed visas, so that wouldn't have been wise for her to do that since we were planning on getting married. When that dreadful day came, had to get her back to the airport, on time.
She was also tense concerned about if anything happened to her mom, but we hung out for eleven days with expedited processing and her US passport came in. And nothing happened to her mom.
When we got into our car after that ceremonious oath ceremony, her first comment was, I cannot travel! But already had that DOS form printed out with the check and passport photos. Took care of that the very next morning. Does put a damper on the excitement of becoming a US citizen.
Yet another damper was, she could not enter her home country until she renewed her foreign passport. I could, I was born in the USA. That crazy place of birth, something none of us as a choice of where we were born.
Then you realize this whole immigration stuff is strictly based on where you were born.

Even though in all aspects and definitions of the word, it is dual citizenship, but to be politically correct like the DOS pretends to be, should call it dual naturalization.
You are not a citizen just like you were born here when naturalized like the USCIS tells you, you are. But no longer dealing with the USCIS, but now the DOS. And they have their own set of guidelines your senator nor congressmen knows nothing about.
If they made an agreement during one of their way overpriced cocktail parties with your home country half drunk that you must maintain a passport with your home county, You have to maintain a passport with that home country to even just visit occasionally. And to do that, you have to renew your citizenship with that home country..
But can't call that dual citizenship, have to call it dual naturalization.
One reason my wife had no problem denouncing her home country, her government is corrupt and got the hell out of there as quick as she could. Only to be forced back into that corruption, we couldn't even bring in all the original documents to renew her citizenship, had to hire a crooked notary first with outrageous fees, and even had the nerve to ask for money under the table as a so-called expedient fee.
Was just reading all the BS I would have to go through to even get married in that country. Yes, her family would love to leave that hellhole, but stuck there. If I was a billionaire, would get them all out of there, and a billionaire you would have to be. This country no longer wants the poor, just the rich. Should rephrase that BS on the Statue of Liberty.
So have to live with dual naturalization.

You do make a point in a way, average IO does not like to interview a person that is obviously more intelligent than they are, and far superior in speaking the English language. Perhaps their reason is, if they make you a US citizen, you may take their job.
Is probably better to act stupid.

Gather in Texas, do not have to show either a birth certificate or a green card to get a driver's license, in Wisconsin, won't even issue one with an EAD card. And the DMV doesn't have a thing to do with voter's registration.
Voter's registration is far more lax than that, they just take your word for it, but the politicians want to change all that now with proof of US citizenship. But you do have to go out of way to register at the courthouse..
Somehow I feel that Texas is to blame. People from other very lax DMV voter's registration states had the same problem, but never came back to let us know how they made out. Feel this is an issue for a good immigration attorney.

If she is under the age of 18 and a green card holder, she will automatically become a US citizen when you do. Only catch is without any proof of that US citizenship. If you want to cut her ties with the USCIS on this issue, have to file a N-600 shortly after you receive your certificate, fee is $600.00. Or just apply for a US passport, but if under 16, will have to provide proof of full custody or get permission from the other biological parent.
If your husband can adopt, still have the USCIS procedure, N-600 should take care of that, in the long term for a family, would be the best route to take. Don't believe the USCIS knows what a family is.

How many total days did you spend outside of the United States during the past five years? Zero
How many trips of 24 hours or more have you taken outside of the United States during the past five years? None
Now this next question is tricky because it states since becoming a LPR, are they serious about going back 30 years?
List below all the trips of 24 hours or more that you have taken outside of the United States since becoming a Lawful
Permanent Resident. Begin with your most recent trip. If you need more space, use a separate sheet(s) of paper.
But was written by that Cuban refugee that was made director of the USCIS by Bush, these questions confuse many people. But you are not required to have a passport, and from the sounds of it, never made trips after becoming a LPR, so just type in N/A in those columns. Leaving this country with the military does not count with trips. Many have either lost their passports or were long expired without problems. These questions are primarily for residency requirements, like becoming a LPR less than five years ago, and being out of the country for most of that time.
Is the part you should be concerned about, hope not a dishonorable discharge. This may require some explaining.

NickD got a reaction from Azure30 in N-400 application: Renewing passport before or after
If you took trips outside of the USA over 24 hours, you need to bring your foreign passport in, expired or not, so your IO can verify those trips. You don't need a Canadian passport to visit Canada, as a matter of fact until that crazy Bush guy got into office, you didn't need any form of passport at all. Just started this nonsense with an executive order because he felt the Canadians weren't doing enough to keep out terrorists. But only if they travel by air, neglecting over 3,500 miles of unprotected border.
Company has many divisions in Canada, still easy to get into Canada but a first class pain the the butt to come back. Toronto is a key point, added over a million square feet for security and have to stand in line for hours. Ironically, any terrorist that came here, came here legally. All it takes to get a visa to come here is plenty of money and they have plenty of that. You also have to list those trips to Canada and not easy to make a daily trip in under 24 hours if you have to wait in long lines.
Johnson and Nixon could have done this back in the 60's, thousands of kids ran up to Canada to avoid the draft, as it was, gave all those draft dodgers amnesty.
Depending on what agreements our DOS made with your home country, still may be required to maintain a passport with that country if you want to visit your family. And the lying basterds call that dual naturalization, when in fact it is dual citizenship. Those corrupted countries can sure take advantage of that.
