  1. I updated my timeline :) My husband is away on vacation visiting his family for a little while, not 100% sure how long yet, but does anyone know how many months until the biometrics appointment? I was hoping it would not be until this Summer so I can make a trip up to visit also and he has time on vacation :)

  2. Hi guys, I need your help to find out this for somebody. If somebody was detained in the store for minor shoplifting but he wasn't arrested. Though, He was given a court hearing for shoplifting. As of now the case is still pending. I need your guys opinions what should he answer in part 3 and question 7? Thanks.

    I had somewhat of a similar question as you, my husband had a court date, but he just had to pay restitution and 6 months probation, then his record was clear because his case was dismissed. my thoughts to you, if he has a lawyer, ask the lawyer how to answer that question. I had my husband call his previous lawyer and he said we could answer no because of the outcome of the case being dismissed.

    I am making my final copies tomorrow, getting a stamp from the post office, and then my waiting and keeping my fingers crossed it is quick and correct :)

  4. Probably would check NO, however I would ask lawyer to either see about getting some report, or perhaps drafting a letter explaining that case, and why no was checked. In this case if the lawyer is competant you may ask them about the I-751 and what they would recommend.

    Thank you for your response. USCIS did not give me any answers at all. They told me to contact an immigration lawyer or some other people, I forgot who. I am going to have my husband call the lawyer who represented him tomorrow. Hopefully that lawyer will be able to help out.

  5. 3, 7 needs to be checked YES it says " Have you ever been ARRESTED" this is true, a person can be ARRESTED and then released, or even have charges dropped, however they were "Arrested"..

    I would attach a copy of any paperwork from the case, I would think you would have something that shows charges dropped, and no fine paid.

    My husband was not arrested though. He had two court dates. The first was to see if he was able to get a court appointed lawyer and the second was when he went with his lawyer. On the second court date, my husband had his case dismissed, but had to pay a court fee (this was not a fine) and he had to pay restitution to the company (this was not a fine either). Do you think he would be able to get a copy of the dismissed case from his lawyer? Or will he need to go to the court for this?

  6. I am in the process of starting my husband's I-751. I will be mailing the form out in March. I have a question on section 3, number 7. My husband was not arrested or detained. He however had a court case that was dismissed. My husband's lawyer told him after the case was dismissed, he would not have a criminal record. I tried asking USCIS, but they said they could not help answer this question. They gave me the run around of calling all these other people, but I don't even know where I would start to call. What I am wondering is, do I check yes or no on that question? I don't want to check no even though he does not have a record, in case USCIS looks into it and finds the dismissed case somehow. Or do I check yes and explain about the case being dropped? If anyone could help me out or knows a number I could call for help with this question, I'd appreciate that. Thank you :)

  7. any other november fillers that have gotten no2 yet, i got my no1 on feb 17, and i think they on vacations over in vermont

    I filed back in June 2007 with the Vermont service, but it took 5 days shy of a year to get my no2. I am not saying this will happen to you, but if you filed only about a month and a half ago it will take time. Just be patient and use your time line. They estimate on the bottom how long it will take for your no2 to come in. If it goes past the date then start calling uscis. I wish you luck and hope you get a response quickly!

  8. My husband comes from Canada and a few of his siblings have asked me about comming down here to work. I found out the best visa is the H2B visa. The problem is they would need a sponsor first. Does anyone know of a site that would show sponsors looking? Or if anyone knows about the H2B visa if they could give me information so I can pass along that would be great. Thanks!

    Just a funny (NOT) bit of information I got today.

    When I got the mail I saw an envelope from USCIS!!!!

    YESYESYES!!!! My Heart stopped beating, I stopped breathing while I opened it.

    And Guess what it was????

    I called the 1-800 number 2 weeks ago asking for advice on how to find out whats going on with my case, the girl told me to write to them. So I sent a short letter asking them to please just make sure that my file wasn't lost and if it was I would gladly send them a new one.

    So you know what they did????

    They wrote me back and told me to call the 1-800 number.

    How's that for a run-around!

    And they sent me back my original letter AND envelope as if they didn't even want it in their trash!!!

    I have to say your waiting time reminds me of when I filed my K1. I filed June 2007 and it took them 7 or 8 months before they sent me an ROE. It was very annoying because the ROE was just a simple yes or no question and I sent that out the very say night. From the time of the ROE it took them almost 4 months before they finally approved. I found someone on here who had to wait longer than me, but do not worry as it will happen soon for you hopefully. I just kept calling USCIS all the time asking what is going on with my case and eventually I finally got my approval. You could ask them to put in i forget what it is called, but it makes it so USCIS has to send what is going on with your case within a certain amount of time. I did that twice and the second time I got my approval within a matter of days. Good luck to you!

  10. hello.i have just a one simple question :blink: . once you mailed all the documents and that I-751 form to the USCIS, when did you go for the biometrics and fingerprints. i just mailed everything to the immigration sometime this week, they got it on friday the 6th of march, so i am guessing i might be going for the biometrics sometime in april??? well, i am just being curious, we have a 2 week vacation planned, leaving the last week of april, so i am just hoping i will be done with the biometrics by then.thanks :lol:

    It shouldn't be to long. I sent out my husbands paper work February 3, then my NOA February 10 and a few days later i got a letter in the mail saying he had a biometrics appointment for March 4. So it was just about three weeks from the time they sent out my NOA. I think you should have an appointment the last week in March to the first week in April. Probably no later than the second week in April.

  11. It is stated that for me and my co-sponsor that all supporting tax documentation (W-2s, 1099s, ect) are needed. My co-sponsor is retired and I do not know if I have my W-2s from my previous tax years. I submitted copies of both mine and my co-sponsors tax returns. What else do they want? They also checked that join sponsor must be a U.S. citizen in which he is and has been his whole life. This was stated with his SSN and birthplace. What am I suppose to send them? Like what else do they want? This whole process is such bullshit and I have had nothing, but problems with USCIS since I started almost 2 years ago! Can anyone please help me out? Thanx!

  12. Why do you want to use a money order?

    Many applicants prefer to use a personal check because they can see when it cleared their back - thus confirming the application has been received.

    USCIS is perfectly happy to accept personal checks.

    I have always used money orders and that is how I pay for things. I have good luck with a money order for one, and for two I don't have any personal checks and don't plan on opening an account. They are perfectly happy with any way of getting money as long as they get it to be straight out honest. Like the saying says "to each their own"

    I CANNOT find any places where I can buy a money order for $1010. The maximum amount they sell is $1000. I know that we have to pay $930 for the I-485 application fees and $80 biometric fees. Is it ok if I buy one for $930 and one for $80??? Would that matter?

    OR can I get a casheir check instead? It doesnt say in the instruction that I can use a casheir check so I am not sure.

    P.S. Writing a check is not our option.

    I get a money order from my bank. If you have a bank account put the $1,010 into it and then withdraw it and just tell the bank teller you want a money order for that amount. It takes only a matter of minutes to do and works very well! hope that helps some!

    I see the part that says: A certified copy of your marriage certificate. (If filing for your spouse) (Does this mean I can make a photocopy of my marriage certificate I picked up? Or do I have to give them the certificate that I had to pay for that was stamped? Could someone please let me know ASAP!! thanx!

    Another question I have is regarding the vaccination supplement (I-693A). My husband had his medical exam only a few months ago so he does not need it again. What I am confused on though is he needs to submit the I-693A? I called USCIS and she said that I did not need the I-693 appendix A. Which is the I-693A. She said I just copy my husband's shot records he has in his book and that is all they need. Is this correct? Someone please help me on this too? Thanx!

  18. My husband came over on a k1 visa and we are now trying to fill out for his AOS. I filled out the I-864, but do not meet the poverty line. My father is my co-sponsor. He does not live with me. What I am confused on is, is my father filling out form I-864 too? or does he fill out I-864 A? I tried calling USCIS, but can not figure how to get through to a represenative. Can someone please help me out on which form I fill out for my father? Thank you!

    If your father lives separately, Form I-864 must be used. Also, you need to submit one affidavit of support as a petitioner of your husband. In this case, two affidavit of support must be submitted at the time of filing. Anyways, I've read somewhere else a suggestion how to get hold to a representative and which I did...it works...after you dialed the USCIS contact number, it will tell you press 1 for english....right after you pressed 1 enter 123 it will direct you to a representative.

    I got a hold of USCIS by going into a different option. I asked the woman I spoke with and she told me my father fills out I-864 a and I fill the I-864. That is the first way I did it, but thanx for your help!

    We don't call it the misinformation line for nothing. Unless you live with your father, you both us the I-864.

    ya the lady i talked to was not right haha i called back again to double check. now my question is what evidence do i send with the I-864's? my father has 3 years of income tax and i believe it said they need a copy of his most recent. i have 2 years of income tax so they want both copies for both years. is that all i need to send with it? they don't specify very well on the form. please let me know. thanx!
