Good luck Carmen & Aldo for today!
-
map1map, i totally agree. knowing what we need to do and crossing it off the list when it's done is wonderful
cassi i didnt know about it either until right before we sent in our AOS packet. i just assumed the doctors all knew what they were supposed to do
-
looks like we are the lucky ones then lol
i guess i just have to focus on worrying about one thing at a time...first is figuring out how to file our taxes and THEN i can worry about the interview.
I don't think we will have any problems with it and at least I know it isnt sitting someplace on someone's desk or stuck in a corner somewhere, right?
-
Since my husband didn't submit the i-693 with the AOS package, do you think maybe that is why they are making us have an interview?
All we did was submit a copy of his DS3025 with a letter saying that everything else should have been submitted by the doctor who did his K-1 medical in the sealed envelope and that we'd provide more information upon request.
That is one of the things listed on his interview letter, so I guess now we have to find a civil surgeon who won't charge us an arm and a leg for this and hope they also won't make him do a full medical exam over again. It is so frustrating having to call around to those people. Last time I called a bunch of the local CS offices, the majority of the people I spoke with on the phone were very rude to me and acted like I didnt know what I was talking about. So frustrating
-
thank you
I think we will have to go now to a civil surgeon and get his DS 3025 transcribed. Hopefully I can find one who won't charge such an unreasonable amount as they were asking last I checked.
I should also add that my case wasn't updated online before I got this letter, even though both the EAD & AP were.

Today we got a letter in the mail with an interview date for April 29th
I'm nervous now and wondering why they decided to give us an interview rather than send our case to CSC
Took the last posted timeline and updated my info. Hopefully the rest of it is correct too.

yes I agree with Gary and Alla about filing for SSN as soon as possible. If you wait until after you send in your AOS stuff, she will have to wait until she receives her EAD card (which could take up to 90 days). If possible, go on Tuesday (since they are closed on Monday due to the holiday) and file for her card. Then, after you get married and after she receives her card in the mail (7-10 days usually), go back and have her name changed to her married name. Then at least she will have her SSN and you can go about doing things that require an SSN like opening a joint bank account and whatnot
-
I'm not entirely sure, since I wasn't with my now-husband when he arrived...so I didn't see how they did it. Maybe you could try calling the Customs & Border Patrol at your fiancee's POE?
I hope it all works out for you cause really...paying ~$300 seems unnecessary for something they should know to check. They probably do it hundreds of times a day, you know?
Good luck.

The I-485 instructions http://www.uscis.gov/files/form/i-485instr.pdf
Page 5, #15 "Evidence of Eligibility":
B. Based on admission as the K-1 fiancé(e) of a U.S. citizen and subsequent marriage to that citizen
Attach a copy of the fiancé(e) petition approval notice, a copy of your marriage certificate, and your Form I-94
-
1. On the step-by-step guide, it says to send in a copy of her I-94. What is an I-94? I'm a little concerned b/c we didn't receive anything when we arrived in the US except a stamp on her passport. I got the feeling that the admitting officer at the airport was fairly new about the whole process b/c he was asking me questions about what forms my fiance needed to submit. Should we have received something at the US point of entry? The I-94 is a white form that should have been filled out on the plane and stamped by the Border Patrol or IO upon entry to the US. The stub should be stapled in her passport.
2. We're getting married in a four days, but I'm unsure about the correct names to put on the forms for my fiance. We haven't filed for her SSN yet so is it okay for her to just put her name (as it appears on her passport) and then she'll change her name later? When are you going to file for the SSN? If it is after you get married you will have to wait until she receives her EAD. Then you can go and get it in her married name.
3. On the 485 form, it asks for current USCIS status - Is 'K-1 Visa' appropriate for this question Yep, my husband put K-1 Visa Holder, but it shouldn't really make a difference
4. On the 485 form, it asks what status did you last enter with several options (visitor, exchange student, etc.), for K-1 Visa holders, can they list 'K-1 Visa?' yes that's fine for this one also
-
Nich-Nick, for the Form 4852, line 4 it says "I have been unable to obtain Form W-2. I have notified the IRS of this fact. The amounts on Line 7 or Line 8 are my best estimates" blah blah....
Do we have to notify the IRS that my husband doesn't have a W-2 for his UK income prior to filing? Or do we just send in the paperwork
-
Congrats to everyone who has had their interviews and come out successful!
I am hoping my husband's I-485 will be transferred to CSC soon, we haven't had anything since his biometrics touch in December.
It's hard waiting when you see soooo many people getting interviews and being approved. But at least he has his EAD now
-
my husband applied for his SSN 10 days after he came here.
It may be different for women vs men since many women choose to change their name after marriage, but the only problem my husband had was the guy at the window didn't realize that K-1s are allowed to get SSN. Thankfully due to the guides here on VJ, we had the SS Manual that shows who is and isn't allowed an SSN and we showed him our copy and then he looked at his own and asked a co-worker who also looked in her manual and it proved us right.
I don't think the Social Security rules are different in each state because it is a federal administration and all should be the same, but I guess it will depend on where you are getting married and if you need an SSN for marriage (some places require it).
He applied for his card and received it in the mail about a week later. It does have the words stamped on it that say it isnt valid for work without authorisation, but those can be removed after you get the green card.
Oh and yes it is true that if you wait till after, you can't get it until you have your EAD
-
-
it depends on what you are adjusting from
most who are adjusting from k-1 will not have an interview and it will be sent to CSC to be approved from there, some will get an interview. And then others adjusting from other things like vwp or tourist visas will get interviews
-
My hubby just called me @ work to let me know his EAD came in the mail today!

O_o i dont think thats the most recent timeline...

I'm currently at work and as such, was not able to read the whole thread so I do apologize if this question has been asked.
Since my husband came here in Sept 08, we got married in Oct 08, and we will be filing jointly (with him reporting his UK income for up until August 08)...I know the amount he made needs to be converted to USD, but is there some "official" converter or could we just use any conversion website like xe.com? And considering the big difference in the exchange rate from now vs August, does it matter which is used?
I read the official publication and it's supposed to be figured at the time the money was earned. My husband worked through August. He looked through exchange rate histories and decided a good average for Jan-Aug is 1.95 dollars/pound so is using that number. There is no official converter. The only suggestion I have is write down your salary and your conversion figures and save with your files/notes that you keep. In case you got audited by the IRS, you could at least show an explanation of how you determined his earnings.
The IRS doesn't question much unless your return looks way out of line. I don't expect them to look twice at whatever UK income we list for Nick. If we claim to have donated $250,000 to charity, that might be something to question. Or if I married David Beckham and said he earned only 20,000 pounds, that might be questioned. They only question things that are far from the norm. But you should save copies and notes in case you are the lucky person that gets a random audit.
Thank you, I figured that would be the case considering the money was earned THEN and not now
We've got a meeting with a free tax prep service next Wednesday so I just wanted to make doubly sure we aren't missing anything

it really depends. You should call the office that does the marriage licenses where you're getting married to be sure.
some places will overlook that and some won't.
I don't know when you are getting married, but when my fiance came here, we waited about 10 days and then went and filed for one. He had it in 7-10 days after that.
If you have the time to, I suggest her filing for one.

Just got the 3rd email from CRIS for my hubby's EAD saying approval notice sent.
Even though he is going crazy being at home all day, he is scared to start looking for a job here.
Hopefully he will find something.
Congrats to everyone on gettin their APs and EAD approvals & cards

We're from NJ
my husband came over in Sept on K-1 and we're married now, but i still browse the k-1 forums in case i can offer any help
-
Someone must have been working late last night..Chris got his second email for the EAD card production ordered at 10:30! Congrats to everyone that got approved yesterday!
lol I got 2nd the email for my husband's EAD at 10:31

Got my husband's AP in the mail today.
Have a few questions about it now...If we want to travel, I assume we bring both of the pieces of paper with us but do we need to bring anything else as far as NOAs or any other AOS related correspondence from the government?
And also, which line would he stand in when we get back to the US? Would he come with me or go to the other line?
hey.. congratulations on the AP....
mmmmmm i got it approved on the 15th... and havent gotten it yet..
and i look at yours .. and it says that is approved on the 21st... and you got it today..
weird huh
.......
Yeah I thought that was pretty fast too, I didn't even expect it & thought it was just going to be like an NOA or a letter or something confirming it was approved
I hope you get yours soon!
AOS FILERS: NOVEMBER 2008
in Adjustment of Status Case Filing and Progress Reports
Posted
Hey everyone, it has been a looong time since I've checked in here due to my dad getting sick in Feb and passing away 2 weeks ago.
Congrats to those of you who have been approved for your GCs! I read back a few pages and was happy to see the big fat approvals
My hubby & I have our interview at the end of this month and we really don't have that many joint bills or whatever to show. We currently live with my mom and pay her rent, but there's no official lease agreement and there are no bills for utilities in our names.
Should I have her write up a letter stating that we are living with her and paying her $xxx.xx per month and have her get it notarized?
Also, we have a joint savings account and we each have our own checking accounts. We have cell phones on a family plan, but its only in my name.
He's also on my work health insurance, but each of us have our own cards with our own names on them...I'm guessing I could get paperwork from my boss if need be showing that he's added under my insurance.
What other types of things should we have?
