It’s good that you are helping him prepare. In his case, no matter what he answers , it won’t impact…..BUT if you want to have a bit of fun ,..so he can relax about his interview:
tell him to listen closely to the question asked and answer short and what was asked. They will ask where his wife lives (  gives address only) . My favorite example:

Question : What day is it ? Answer : Saturday

not: Saturday, August 13, 4:30:PM on this cloudy day I thought would never end cause now I have knee ache again…

    This is true lol

  2. I think the confusion was the initial phase of the interview where they ask for your name and documents the initial phase would ask you, who does your petitioner live with. And the answer would be myself, my mom, my husband and 2 kids and misconstrue it as household for financial support purposes.

So I will just advise step dad, if ask by the initial consul officer, if they ask for household. He can answer 2. And if ask where does the petitoner live and who does she live with, then she can say with us.. right?

  3. Hello,

    f2A to Ir1

    Married 30 years

My mom (petitioner) petitioned for her husband (my stepdad) in 2019. we got DQ'd in 2020. Fast forward 2022, we submitted updated 1040 for 2021 income and W2. Her income went from 55k to 36k.

My mom lives with us (me, my husband, and my 2 kids), but we do not combine our income and we file taxes separately from her.

We put 2 as household size as the sponsor is my mom and the other household member is the intending applicant (my stepdad). Is this going to be a problem? Would the consul include us 4 in the household size? if that's the case, her 36k income will not be enough. do we ( my husband husband and I)  need to fill out i-864 and I864A)?

**or is 2 member household enough?

    Thank you,

    Micah

There’s an IRS Publication all about mortgage interest you need to study. It addresses not having a form 1098.

    Publication 936 https://www.irs.gov/pub/irs-pdf/p936.pdf

The standard deduction is $24,400 now so unless you can come up with more than that in deductions on Schedule A, you will want to take the standard deduction. Since 2018 tax year, itemizing deductions is almost a thing of the past.

yea definitely  more deductions, couple kids and and our primary home coming up aroung 35k so yes it is better to itemized. thank you though 😃

    May I ask Magknano/Pila?

    How long did you contribute?

Did they charge you a fee or penalty for early withdrawl?

Hi sorry for late reply, anyway I got about 10k pesos for 3 years contribution which is not too bad. I gave it to my mom. There could be a fee but I it probably insignificant that I do not remember. The line wasn't too bad either it's in Pampanga coz that's where I lived. As long as you have all the companies you have worked with established or your pagibig number you should be ok.

Here is how it is supposed to work. This worked for us.

As a K-1 Visa Holder you are eligible to receive a SSN upon producing a valid I-94 (unexpired). Do not wait until you only have a few weeks left until your I-94 expires to file for a SSN. Many SSA (Social Security Administration) offices will not allow you to file for a SSN if your I-94 is about to expire (generally 14 days prior to the expiration on your I-94). On the other hand, you should also not file for a SSN too soon either.

You should wait 2 weeks after you arrived in the US before applying for a SSN. UPDATE: It's been reported recently that you no longer need to wait 2 weeks till you are in the SAVE database that you can go the next business day. If you go too soon your record of arrival will not be in the SAVE-ASVI system yet (what is SAVE), and it will require manual verification from the USCIS. As this will add weeks to the period it takes to process the SSN, it is advisable to attempt to wait the two weeks to be safe. If you have waited the 2 weeks and they tell you they cannot verify your arrival record via the SAVE database, then personally return on another day to have them search again -- thus eliminating the manual verification (you don't want to do the manual verification as it adds so much more time to the process).

To apply for a SSN you will need to go to your local SSA office and bring the documents below. These documents are proof of your eligibility to file for a SSN:

The SS-5 form  download and complete the application (they have some at the office if you forget).

Your Passport (with the K-1 Visa attached)

    Your valid I-94

Another form of valid ID (birth certificate will do nicely)

You should also print and bring the document RM 10211.530 , in the event that the agent is not knowledgeable that K-1/K-2 are eligible to receive a SSN.

Make sure to bring all the documents above because some offices have staff that are not aware that a K-1 Visa Holder is eligible to file for a SSN. A friendly reminder is a nice thing to have -- if not you could be turned away incorrectly

Once you have successfully applied for your SSN, the SSN card will come in the mail in about 2 weeks.

K2 visa holders must first have a work permit (EAD) to get a social security number.

    After marriage

Carry your marriage certificate to the social security office to get the social security card in the new name. If you applied for a social security number before marriage, you can go back to the social security office after marriage and get your name changed on your social security card.

The social security card will be marked “VALID FOR WORK ONLY WITH USCIS AUTHORIZATION”.  That means, you need to get your EAD first before you can actually work.  Hopefully, when you submitted your AOS you included the EAD. If not you will now need to submit the paperwork for an EAD prior to working.

This is exactly what we did, 10 years ago. They gave me an SSN with markings and whenever i get a job, they just asked for EAD. When I finally get my naturalization, i went to back to SSA to have the markings removed.

thats the site closer to you.

i tried doing a dual citizenship derivative for both my kids, but they checked my naturalization certificate and found that my son is automatic dual, so delayed registration of birth nalang.  Just bring the documents that go have along with multiple copies the. They can tell you what else you need. New York malapit saiyo Pres.

There are lots of things I want to do that probable most Philippines houses don't have, American appliances, bathroom sizes and was thinking garage with garage door.

The coast is pretty close to the metro and my family lives about 3 hours away.

You  are right about the appliances 😭 I’m glad they have Lazada, shoppee now but man not the same quality of what we have here. I have to ave my coffee in the morning, and instant is ok, but meh.. Angeles city, Subic has 110v and my fam is from Clark :) my property on the other hand is a little south of Angeles city, so no 110v for us :( my hair iron isn’t getting hot

Getting the name fixed is possible. My wife's mother's first name was wrong on her birth certificate as well so she had to get it corrected so she could get a passport in the right name.

I don't know the process to do so myself, though. I'd have to ask her. If you can't figure it out, let me know and I'll ask her. Hank is also the unofficial PH guru. ;)

I was there last month and we went to the local civil offfice to finally get through the process, I was ready, butttttt I almost lost my when we were told my dad has to file it in cebu (his birth place) because they have no capacity for national publication. Efff me!!!! I was quoting their website that says it is impractical to go back to the birthplace but I was told of the same thing. This is in Angeles city. So now I’m sending my dad to cebu. Coz I’m rich—not!

Agreed that they should make it more clear...I shouldn't have to read through multiple pages of anything to answer a basic question about what relationships qualify.

I had to read it because I was looking for requirements for my Bio dad, as I was born out of wedlock. (They were the OG 16 and pregnant). Since I have his last name , I am considered legitimize, that is another reading for me.

My my other issue with bio dad aside from history of drug abuse was his name all his life was different from what his birth certificate says. Again more reading.... :(
