    Wasted effort.  He was seen as a risk for illegal stay. Nothing he can do except apply for a visa.

    Girlfriend in the US posting about boyfriend's turnaround - boyfriend who doesn't seem to hold a job (200 weekly from whom?) and has a WIFE back in Australia? A group of people took collection for his flights and accommodations? 
     
    What was his real reason to coming to the US? Doesn't sound like tourism in this instance.
     
    No wonder he was turned around.

    My friend from Australia was detained for 7/8 hours and then flown out because he didn't have enough cash on hand.  (he had 100 Australian dollars which is wort about 165 in current USD)  He ha the tickets for his return flight,  he was staying with "family"  so no hotel needed, we were gonna provide his food cause staying in family home, plus he was gonna receive $200 a week.  None of that was good enough---

    Today was supposed to be the most amazing early start to my birthday month.
    My amazing boyfriend flew from Sydney, Aus. and was supposed to meet me in Dallas this morning at 4:35am. He made it to LAX at about 4pm yesterday, and was supposed to have an approixmately 7 hour layover. He was detained by US CBP (customs and border "protection") for being poor. No I'm not joking. I wish I was joking.
    He was asked at the border how much cash he had. When he responded "none," they automatically assumed he has no money, which was far from correct. His meals, lodging, and transportation, both on the ground and to return to Australia were covered. He had money of his own to spend on anything of his choosing, as well as money coming to him weekly from home.
    US CBP decided that his money was not enough and therefore he would be at risk of "violating the terms of the visa" that he had been granted before he left Australia. They refused to contact myself, his other partner here in the US, his wife back home, anyone who could corroborate his finance situation. They also refused to allow him to call or text any of us who love him, so we knew what was going on. "No phones or smart devices in the customs area." He was detained for over 7 hours. One he was out of the detainment area, he was seated in an area with no access to wifi, so he had to purchase internet on the airplane, to let us know what had happened.
    Between the group of us, we spent over $2000 USD on this trip in the last month, yet our funds were not good enough for US CBP. Every single one of us involved are low income people, who pooled our resources and were able to make this happen. It was my birthday gifts, as well as Christmas for the entire group of us. All now ruined.
    He traveled 6000 miles over 30 hours via car, train and airplane, to get here. He had a valid Australian passport and US issued visa. He followed all the rules to enter this country lawfully. He had his tickets to go home already paid for, within the parameters of his visa. There was absolutely no reason he should have been detained at all, let alone refused entry at LAX.
    We plan to take this as high as possible. We'll be contacting many people over the next few days and weeks. This post is public so please feel free to share.

    If you're travelling overseas on US passport to a country not requiring visa, I don't see how it would be a problem?

    Are you trying to go to a country that requires a visa? If so, it is up to them to issue you one.

    Your SSN doesn't change, your DHS authorization is the EAD card. You can start working as soon as you get hired.

    I don't see the reason to renew Pakistani's passport in this case unless you have other reasons doing it.

    Citizenship does not stop with expired passport. Many Americans (and I'm sure many Pakistanis) do not have passports of their countries, though they're citizens.
    Some countries require their citizens to enter and leave the country on their passport. E.g. USA requires US citizens to enter and leave USA on US passport even if they have other citizenships. I'm not sure if Pakistan requires their citizens to enter Pakistan on Pakistan's passport. You may need to research it.

    I am sorry your case is taking way longer than normal. If you don't know of any possible issues that could be dragging it for so long I think you are a prime candidate for filing a WOM and getting your answer as soon as possible.

    I applied online and as everyone else has stated, I found the process to be very simple. However, it is worth checking out this thread.
    In short, if your window for applying were to open tomorrow, don't submit tomorrow. Instead wait an additional couple of days before pressing that submit button.

    I think it was a mistake filing under 3 year rule given shaky marriage with cheating, abusing and addicted person. There's a chance you're going to be grilled about your relationship even at N-400 based on 5 year rule. But should you continue with application filed under 3 year rule? I don't think so.
     
    Sorry you're going through this. I think it's time to get the life sorted. Immigration can be put on back burner.

    For me personally I put the notice date of when we got the text message update that it was received, although our actual notice date on the form is one day earlier. Nothing too scientific here! 😛

    @Nelly_M IMHO it's easier to file and move forward. If you ever want to naturalize, there's a question on N-400:
     
    " Have you EVER not filed a Federal, state, or local tax return since you became a lawful permanent resident?"
     
    If you don't file it, you'd have to say "Yes" and explain why you didn't file.
    My personal choice would be to pick the path of least resistance and file. That way you can say "No".

    I personally don't have experience with this, maybe it's OK? Based on what I see, USCIS generally has higher standards for a lot of things that a regular US person has to deal with: tax filings, criminal records etc.
     
    How can you prove to USCIS that you and your US spouse aren't evading taxes? Transcript from USCIS with 0 income is the best proof IMHO.
     
    Also, AFAIK, GC holder is should have reported world wide taxes in 2021, even if they came to the US on December 31st, 2021 on CR-1 visa. Are you sure you didn't have to report your income from elsewhere?
     
    I'm not a tax specialist or immigration lawyer, just throwing some ideas.

    That is not going to be a pleasant interview.  I tend to agree with the others here.  Wait and apply under the 5 year rule.

    I'm going in for my combo I-751/N-400 interview next week, and I have two almost identical packages for both. The only difference is we changed our car since filing I-751, so I didn't include the co-loan of that car into my N-400. Instead, included the new car which is more relevant at this point. But yeah, both packages include evidence since 2019. Given how unpredictable USCIS I think it's better to be safe than sorry.
