    My husband and I are getting a divorce. The decision was mine, and I would like for the process to be amicable. He is a decent person- just not such a great husband.

    He entered on a K1 in March of 2008. We were married and filed for AOS within 3 months. We were interviewed for the first time in January of 2009, and then heard nothing for months. After many inquiries on our part, and finally going to our local congresswoman, we were called in for a second interview in November 2009. They told us at the conclusion of that interview that they believed that our relationship was valid, but they still needed to wait on one final check. Since then, nothing. In other words, he has not yet received his green card.

    I do not want to force my husband out of the country, but I do not want to put myself in any sort of legal jeopardy for his sake. He would like to stay here for as long as he can, but does not want or intend to stay illegally.

    So the first question is, what is my legal obligation? Do I need to advise USCIS of the divorce? If so, would I do that when the papers are filed, or when the divorce is final? Do I also need to send notice of canceling his sponsorship, or would that be automatically inferred from the notice of divorce?

    Next question is, what does my husband need to do to remain here legally for as long as possible? We both know he cannot stay indefinitely and that once USCIS knows we are no longer married his visa will no longer be valid, but we're just wondering if he has some time to wrap things up and make some money before returning to his country. How would the process work for him once I (presumably) informed USCIS of the intent/finality of the divorce? Are there some sort of proceedings and/or lee time before he definitely has to leave, or is it immediate?

    Any advice would be appreciated. Thanks,

  2. Hello all, I have a question regarding my husband's green card expiration date!

    I was a little confused about something!

    I have a friend that got her permanent residency card thru marriage and K3 visa her green card expires as usual in 2 years. My hubbies green card expires on 2019. Will I still have to do the removal of conditions? how come my friends green card expires in the 2 yrs of her marriage and my hubbys expires in 10 years?!!

    Yes, only $1,010 is needed for the AOS, and it includes EAD and AP if these interim benefits are applied for at the same time as AOS. If you apply for either EAD or AP separately and before AOS, then you have to pay their fees. If you choose not to apply for EAD or AP at the same time as AOS, you can submit the applications later and they will be free if you include a copy of the NOA for the I-485.

    My husband is starting to comprehend he is ging home with me in a few weeks. I was able to book him on the same flight as me. Now he has a couple of weeks to return to his home in the jungle and say his goodbyes. He will be in shock when we get to Phoenix. From the jungle to the desert.

  5. I had read the following after checking the box on the DS-230. SO we went and filed for a SSN at the local office, received it a few days later. Yesterday (almost 2 months later) we received a second SSN card (with a new number) in the mail. I imagine it was generated from this box being checked. Has this happened to anyone here?

    I am going to call Social Security today to see what can be done....but any advise, or insite would be welcomed....

    On the visa application Form DS-230 (expires 7/31/2007), you saw the following offer:

    "Do you want the Social Security Administration to assign you an SSN (and issue a card) or issue you a new card (if you have an SSN)? You must answer "Yes" to this question and to the "Consent To Disclosure" in order to receive an SSN and/or card."

    Please note that this program is ONLY for Immigrant Visa holders (CR-1, etc). If you checked this box, a Social Security number will NOT be generated for you if you are a K-visa holder. As a K-visa holder, use the following guide to get your first, or replacement, Social Security number/card. If you have ever had a Social Security number, that is your number for life; you will need to visit your SSA office to get new card with the same number.

    The Enumeration At Entry (EAE) is supposed to only be for people age 18 or older that have been issued immigrant visas and no K visas are immigrant visas, but SSA assigns the SSN based on what the Dept of State and Homeland Security transmits to them, so I guess it could happen.

    Are either of the SSN cards unrestricted cards? The names on both cards the same?

    They can tell if the SSN was assigned through the EAE, since the SSN record will have your A#. You need to go into a SSA office and let them know. If you have been assigned 2 numbers they will be cross-referred in the system. Normally, it's up to the person which number they want to use, but in this case they might ask for the card back if it's an unrestricted card and the SSN was assigned through the EAE since you have K-1 status, even though the SSN will always be assigned to you.

    One is unrestriced (the second one) the other (which we applied for in person) is restricted. The first one lists only Name and Paternal last name, the second lists Name, Paternal and Maternal last names. I have spoken to several agents, one who said in the system only one showed up. Another said maybe one was so he could work and then one would be permanant. I said that makes no sense and he said I agree, I was just thinking maybe, HAHA We both got a kick out of that. The hold time is usualy 30-45 minutes so it has been futile attempts. Finally today I was told to go in person to the local office. We will go tomorrow morning....

  8. Hi everybody, FYI i had my medical (dr. situ) and i think it was fine.. they nly charge me 150 soles for vaccines, they say because of my age i dont need any other vaccines like human papiloma virus, that one is up to 26 years. BTW.... one of my arms was hurting for 3 days!!!!

    Ok, lets go to the topic, i am reading the "INSTRUCCIONES PARA LOS SOLICITANTES DE VISA DE NOVIOS" sent by the Lim embassy. in the front page says i need to send the form 179 included with the package to the embassy; but at the bottom of the back of the page says "NO ENVIE NINGUN DOCUMENTO A ESTA OFICINA, UNICAMENTE ESTE FORMULARIO COMPLETO Y FIRMADO" that is, dont send any document to the office only this document filled and signed.

    for me this is contradicction, i will call the embassy and ask what they mean.

    so i wanted to know what you guys did in this case. somebody sent anything prior the interview??? or just take all docs to the interview?

    Nothing needs to be sent back early. You can just take it all to the interview on a K-1.

    And USE CAUTION if you buy from Taca.

    I purchased the ticket from Peru to JFK for Elias from Taca. Then upon receiving my email confirmation I was advised that I needed to sign the receipt when I picked up the tickets. I advised them that since I purchased I third party ticket I would not be picking them up, he would. SO after 3-4 days fighting with the I was advised that I could go to a local office in the US to sign the receipt. Only problem is the nearest local office was in Los Angeles....I am in NM. SO one road trip and almost 30 hours on the road, all was well....I will admit that the price was great (even after the cost of gas to CA) I found out later that United also sells Taca flights for them so the price should be the same....

  10. Erika and I got our approval at the US embassy in Lima today!! Other than electrifying my nerves with a death stare when she saw that my previous passport was mutilated (it went through the wash last year) and replaced, our interviewer was very cordial and friendly, telling us stories from days of yorn and about her experiences. We spent about two hours at the embassy and other than the required documents, we were only asked for pictures and emails, which were both reviewed by the interviewer and we had to answer some simple questions about them. We also had to answer questions about how we met, but those are a piece of cake, right??

    So, we are very excited and Erika is excited to be coming to New York with me for her 29th birthday this Friday!

  12. i'm about to have my interview at the embassy, on 9 days, here in peru. i lived in spain on 2003 for 12 months and don't know exactly about the police records, i'm not sure how long does it take for the embassy to give me the document that says i don't have any. i'll send a letter tomorrow but i'm worried cause i'm not sure if i'll have them in time and if that would be a problem

    i lived in USA too, for around 12 months, from 2006 till 2007 and i thought they wouldn't need the clear records from that period cause the consulate should have that info already.

    please some help! my interview is soooo soon!

    Police Certificates from Spain are available and necessary. The link Shannon gave is perfect for finding what you need

    I think if it were me I would request the Spain certificate right away and then if it is not in in time go ahead and go to the interview and let them know it has not arrived yet. It will delay a bit you but as long as everything else is in order they will just issue you a yellow slip with instructions on how to send back the certificate (and passport) to the embassy via DHL. After reviewing and finding all in order, the passport with the VISA will be sent back to the DHL office for you to retreive. Once the certificate is sent to them it is really only a matter of 2-3 additional days so while frustrating not too bad.

    We had a delayed Peru certificate, and even with 2 holidays in the week we had the VISA 7 days after the interview.

    Thanks so much for your help! David and I went to our interview and the visa was approved today! We were only there for an hour and a half and the interview was fine... No problems.

    I´ll definitely post more on this later, but I just wanted to say thank you to everyone for having me super prepared for the interview! It´s due to all of your help, I swear.

    Last night I was talking to my fiancee about the possibility he could be here in Lima - Peru the day I will have the interview, but for deciding it we need to know what happens after the interview on USA embassy? If they aprove the Visa, they give inmediately the passport stamped with it? Or they say that we should leave my passport on the embassy and then they will send that to our home with the visa stamped on it? Or we have to pick it up from the embassy some days after the interview? If we have to wait for some days, how long is it?

    Please, peruvian guys or girls, give me an answer.... I will appreciate it so much...

    Ours took just at a week. We had to send back papers to the embassy after the interview.

  15. Hi people! This is an exciting month, several interviews! yay, good luck to you all! I have really grown fond of all the patient fiances and fiancess I came across here. :)

    Well, just a few things to tell. This Monday, I had to return to Dr Oscar Situ's office, to pick up my results, pay the rest of the money I had to, and get the Hepatitis A + B shot.

    I went to see the secretary, who is in charged of the vaccines and their prices. I told her my fiance and I checked the government's and embassy's web site, and they listed an approximate price for the HPV vaccine, which is just given to young women, and it was $120. I also told her I had called the other 2 doctors, and they charged 490 soles for that vaccine. And actually, even less for the others. Finally, I kind of threaten her, telling her I didn't want to but I was going to report this to the embassy. She started to be super nice to me, and the negotiation started. She said that she'd reduce the price!!! Yeah, believe it or not, but I have the receipt to prove it, and the initial price written down on the medical appointment letter. :angry: First she said, Ok, I guess the vaccine should be less, you'll pay $10 less. After I said it was not possible, since the other docs charged a lot less, she said $20, then $30 and then a bit more. As you all know, the initial total price was over 1000 soles, which was outrageous to me, then I got it down to 930, after arguing, and this time, after I told the secretary all this, I got it reduced to 840 soles (+$150). LOL. I have basically saved about 400 soles. What do you think about this? :wow: Particularly, I feel indignation. :ot2: But this is how it was. I didn't haggle with a street vendor or at a store. It just tells me 2 things: They have overpriced the vaccines, trying to get as much as they can, otherwise they wouldn't have been nice and then tell me I'd pay less after what I said. And also, that everything seems to be negotiable... there's always a chance to try, no matter whom you deal with or where. I don't like it when people are dishonest or unfair. Sad but true.

    AFTER I POST THE PAST TOPIC I CALLED THE EMBASSY TO FIND OUT IF THEY HAVE THE CERTIFICATE IN HANDS AND THEY SURPRISED ME WITH THE NEWS THAT IT HAS ALREADY BEEN APPROVED AND IT WILL BE ISSUED!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! :dance::dance::dance::dance::rofl:(L)

    He will be coming at the end of the month!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    My K1 Petition was approved today.

    10/18/07 USCIS received my K1 application

    02/27/08 USCIS responded with RFE

    03/20/08 USCIS signed my fedex package with RFE

    04/03/08 USCIS approved

    I am very happy that things are moving well and thought I would share these dates with people.

    What do I need to do next? I would appreciate all your input.

    My fiancee is from Peru and any Peru specific input would be greatly appreciated.

  18. Sam, please let me know how much Elias paid. I'm guessing it must have been more or less 400 soles, since he doesn't have to have that vaccine that is meant just for young women.

    Btw, Jared did some research about this vaccine on the government's web site and the embassy's site and also over the internet, and it says that its price after taxes is $120, so I'm really mad Dr. Oscar Situ even had the guts to assure it was over $240, or 650 soles. I paid almost half of all I have to pay for the vaccines, and after getting the hepatitis ones this Monday I'll have to pay the rest. What I am thinking of doing, seriously, is to threaten them, by telling them I found out this and I was initially given a different price by another secretary, also tell them I might report them. Muy indignada! Hugs.

  19. Hi there! I had my medical exam in Peru, yesterday, and would like to share that experience with you, it might be helpful for people that haven't gone through it yet.

    I went there in the morning, had an appointment with Dr. Oscar Situ. In the morning, I got x-rays taken and also blood samples. It was pretty fast. I was told to return in the afternoon, with certain amount of money for the vaccines, my vaccinations record card, apart from the money or fee to see the doctor.

    I got there, again, and after waiting for a while, I had my appointment with doctor Oscar. It must have lasted... 5 minutes. He just asked one or two questions about my medical history, examined me briefly, and that was it. He was nice and polite (and had lots of fake pieces of prehispanic pottery in his office) and told me what vaccines I should get, and to arrange that with the secretary, at the second level of the clinic.

    Here is when the weird part comes... I must tell, before I was called to see the doctor, I had been talking with some other people, fiancees as well, and they showed me the paper they were given, saying they had to pay outrageous sums of money for a few vaccines, even though we had all been told in the morning it would be a lot less.

    So anyway, I was prepared to pay about 850 soles for the vaccines, just as the other people did, lacking exactly the same vaccines, but when I went to see this secretary, she told me I had to pay over 1310 soles. :blink: The whole thing didn't make sense to me, she was analyzing me and my financial situation, when talking about the price. So I got mad but tried hard not to show it, and told her to explain in detail the price for every vaccine, and list it. She refused to do that, to list the prices, but told me about it orally. So I found out they were adding me charges for vaccines they knew I had had as a child, and fairly complained, telling her that. So then she said 'Ok, I guess I can cancel these 3 vaccines you had had'. But then she told me: 'let me see you, show me scares that prove you have had Varicella, why don't you have any scares in your face? ' This really annoyed me, she wasn't nice at all and the impression I got is that they try to take as much money of you as possible. :angry: One of the vaccines you have to have (human papillomavirus), if you are a woman, is 650 soles there. Well, in the end, I got the bill for the vaccines largely reduced, to 915 soles.

    I talked to another woman as I was waiting to get the shots, and she also had a different price, almost 900 soles again, except she was going to be given less vaccines than I was.

    They also do not advertise their prices for vaccines or have a list or anything like that to show, I truly disliked this, because I think it is just not fair and they get more money out of some. It's not about health or anything like that.

    So, just one piece of advice... if you want to save some money, and are just starting the K1 visa process, get some vaccines on time, since in the end, they'll require your vaccination history or card to look for it, and they are way cheaper in some other places or even free.

    It's just not true that if you got the shots somewhere else before, it would be rejected and you'd have to get all redone, what they care about is that you meet all the requirements, having all the vaccines you are asked for, not necessarily care if you had them all at the doctor's clinic.

    This is Jared, not Johana.

    I'm getting extremely worried, because the interview date is approaching, and there are all the normal stresses of getting the paperwork done in time and so on.

    The main thing worrying me right now is that I don't know how much money the people at the embassy are going to want to see in my bank account. To be totally explicit, I think I can have between $4,000 and $5,000 showing in my accounts total by the time I fly to Peru.

    Is that enough?

    Anyone who had a successful interview and was granted a visa, PLEASE respond to this...let me know how much money you displayed to them. I need to know if I'm even in the ballpark. My best friend owes me a lot of money and he is apparently going back on his word about paying me back on time as he promised, so my fears are currently being compounded.

    Hey Jared, I know you feel stressed. We all do at this time in the process. But step back and take a breath :D from the info you have listed here you are more than fine. To my knowledge the embassy did not even review my bank info and I make less than you do :lol: and had roughly the same amount in the bank. We were approved with no problems....

  22. My fiance finally got his K1 Visa approved in Ecuador on March 19th after an exhausting 8 hours spent inside the consulate, both of us, they finally called him up and approved it!!! WOOO HOOO

    My question now is this, we've decided to wait until July of this year for him to travel to the US......is this waiting too long? will the Visa be expired, is there a time limit on how fast you have to use it? If so does anyone know what it is?

    You will be fine as long as the date on the Visa does not pass (6 months from date of issuance). It is smarter to wait on the entry than to count on him having the ability to travel out of the US and actually be able to return in such a short time. Since the K-1 only allows for the initial entry. It is unlikely that he would have completed AOS or have received advanced parole in time....

  23. This is personal and really is not relevant, but none the less.... I would like to make 1 point first though. When something doesn't make sense, in many cases it is because you don't have all the facts to see the situation clearly. This is the case in this situation.

    The marriage was dead for 6 years and we remained together for the sake of our daughter. So, yes, 1 month after the legal divorce, but 6 years after the physical and emotional divorce.

    I just want to wish you a lifetime of love and hapiness with your future wifey!!
