    Just another quick update...

Our case had unsolicited updates on March 20 and 21, and then silence. Today (still early in the morning) we got another unsolicited updated case date. Status is still "refused".

We were not asked a DS-5535, just a CV, but officially at 5 months since interview today.

I believe so as well, this is the typical pattern of Visas Clearing before they are ready to be sent to the embassy and onward home (To the US)

I'm absolutely floooooored how it seems visa processing has stopped for K1's and IR1's it seems under 221(G) / DS-5535 cases that have been submitted. What possible reason could there be for such a delay?! its time to start cases again. Its been ELEVEN MONTHS for my fiance and we havent heard a thing. What possible reason could there be at this point

Part of me wants to believe that this will all result in a bunch of cases being approved at once but I dont know if im deluding myself or if this process is so broken that this is just a result of somebody breaking something and now nobodys cases are being processed.

Just want to vent. Spouse interviewed in mid Dec. got DS5535. CEAC had not had any updates since Dec 22. At time of interview VO asked us to submit her unexpired visa from old third country passport. Then when we emailed them to clarify whether to send in the unexpired visa first, they said just wait for the visa team for further instruction. So we are not sure whether to send in the old unexpired US visa or just wait. worried that if we don’t send it in and a year passes by and then they’ll have an excuse to screw us over saying we didn’t follow 221g.

Tired of this bullshit. As an American my country has only disappointed me again and again.

also who should I vote for in president election to fight this immigration BS?

I saw that your interview was around Mid-December (23'), based one everyone's experiences here, it appears as if youre only about 15% - 20% of the way there on how everything is looking for the rest of us. Hopefully for March this was just an unlucky month (or an off month where they just stopped processing K1's and CR'1'S and focused on J1, F1 visas) and they get back to their regularly scheduled routine by the time April swings around. We can only guess as to why March has been so dry though but from what I have seen, processing around the world has just been reliant on J1/F1 (and sometimes B1's here and there) cases and they might have switched the routines to process those types and switch back and fourth every month or so. This is just my assessment from what I have seen. If you look at those other telegram groups, people are being cleared left and right it seems but we seem to be the unlucky ones.

I’m hoping someone can shed light on this if you file a WOM and the government does not respond within 60 days. What happens then? I read somewhere on Reddit that if they do not respond within 60 days, the judge can just take action based off of your request. Is this true because the government only has about five days left to respond to my WOM I have still not received anything. When reviewing other peoples timelines, I am noticing that the government has been responding within a couple of weeks.

They judge can dismiss but probably it wont get there, for our case they responded to us at midnight the day it was due for a response

I don’t understand the complete standstill with all cases since Jan 2023. Are there ppl OUTSIDE of this chat forum that is actually being cleared?? I can’t even imagine the backlog the system is facing now. I wonder does this have anything to do with changes to the system post public opinion inquest.

    Hang in there everyone!

I've looked at dozens of forums and facebook groups and online chats and international groups, and this doesnt seem to be the case. I think everyone is in the same boat. For what reason we're all stuck? That stands to be seen but hopefully we can get some answers soon

Other than 4 or 5 unsolicited updates that occurred from mid Jan to early March, nothing. Updates seem to have dried up as well. Still fighting the us attorney’s motion to dismiss; will keep the forum updated.

When did you file WOM & get your MTD? We plan on refiling a WOM at the 11 month - 11 & 1/2 month point

I have no idea how they work , but On my interview day I saw them issuing AP (to male and female) , how many of them got Ds-5535 I don't know. But I do know couple of Vo/Co are especially trigger-happy for AP (under Ds-5535 or any reason) . In a WhatsApp group I came across few female and male applicant all in immigrant category (IR1 , F21 , F4 , K1) with no travel history (never left Pakistan) got Ds-5535 , some cleared in 4 months some are waiting even after 1+ year , WoM didn't work any of them. Majority of people in that group is male , Muslims with and without travel history.

So far I haven't come across any Pakistani who got WoM worked in his Favour.

About to be 10 Months and 3 weeks soon

It is both comforting and heartbreaking to know that I have found a community of people experiencing the same emotions as my husband and I. This process is taking a toll on our mental health and marriage. Its scary because it seems like there is no end in sight. We just want to start our lives together. It angers me that the US government has no sympathy for individuals trying to legally immigrate with NO criminal record. My biggest sin is that I chose to fly back and forth throughout dating and marriage to see my husband. If i had never visited him then i would be questioned on the authenticity of our marriage. Either way we were going to be screwed. I am just praying for some positive news or change that will clear this backlog and issue me a visa.

Agreed, it seems like without this place, alot of people would have been completely lost or given up/lost hope by now. Its been 10 months and 3 weeks for my fiance and I, but it feels like we are seeing the finish line move further and further away from us as time goes on, but we are refusing to give up hope. I just hope we hear something soon because this doesnt make any sense why this is taking so long

Hmm thanks... yeah, I submitted my responses to DS5535 last year... exactly 11 months ago today, actually!

Wait if you already submitted a DS-5535 than this might be a mistake. Either that or they want to go double or nothing on security vetting. Either way I would Triple Up on your part and a legal attorney ASAP as this is LOOONNNG overdue for you.

    Hi All,

I just received this email from the MTL consulate.  Is this any different from what I've been in since being placed in AP?  Or is this the final decision by the embassy?  I'm coming up to the year mark since my interview... Being in AP is one thing but I truly have no idea why I would be denied.  If anyone has any insight it would be appreciated.

    Good afternoon,

The consular officer, after carefully considering your application and reviewing all available information, determined you have not established that you are eligible for a visa and denied your visa application under INA 221(g).  Additional security screening is being conducted.  Depending on the screening results, a consular officer may reconsider your eligibility for the visa.

Thank you for your patience and cooperation.

    Regards,

This isn't a final denial, its AP. They may or may not ask you for a 5535 at this point.

edit; I believe you are overstrength for WOM

What is your consulate?  Once you had an interview and severed with DS-5535, priority of your case does not matter. Your DS-5535 will resolved just like any other cases (CR1/IR1 etc.) by DC office.

I thought for some other cases they were solved at a faster pace like F1/J1 vs K1/CR-1.

I also heard it was nationality dependent for the quickness of completion

Hey guys, like many of you I am still waiting to hear from Montreal to send my passport back. Had my interview in May 2023, wasn't asked to leave my passport and was given the 5335 form. Does anybody know how many days do they give you to send your passport and second medicals back once they contact you?

Also had my interview May 2023. As far as the Canadian side goes I haven't heard anything with regards to if anyone has been approved for that timeframe yet and/or what the procedures are for resending the medical if you're still waiting to hear back.
