You don’t need a lawyer. This from someone who hired lawyer before stumbling upon this site, and for exact same reason: not to make mistake.I do understand that lawyers can be helpful but this whole notion that they are absolutely necessary is nonsense, and greed plain and simple.

Written consent from whom? Is it necessary if she was alone with him abroad? Just curious.

My problem is that my fiancee is arriving with her 9-year-old daughter.. typically the flight from Ghana would arrive at JFK.. and there will be a 4-hour layover.
The flight would arrive at 6:am and depart around 10:0am.. my problem is that there are no arriving flights coming on the morning of the date that we choose
all other flights have her in the airport for over 6,7, and like in some cases 10 hours.. and then she would arrive in VA .. like 9:00 pm.
I don't want them in the airport for such a long period like that with a child. I can get then to DC. but there is only a 2-hour layover and that won't be enough time to catch her connecting flight.
We are snowed in again, here in NYC, and we generally act as we don’t do not live in an area with four distincive seasons, meaning snow happens every year but here it gets acted out as if it a major centenial event. Any dusting will cause flight cancelation, just something for you to bear in mind.

3 hours minimum and that is tight. Take in cosideration:
weather conditions, both from the original departure airport to the final destination.
it’s not uncommon for flights to be late from start, for no particual reason.Custom clearance at the POE.
She is with the child and she needs extra time.
Most flights start boarding an hour before.
There will be a lot of pressure on her with a trip as is, no need to add on it.

I'm in NYC! Did you go to the main office ?.
Yes. Second time I went to Stamford, also 24 hours.

What state are you in? Here in New York we have few offices that process passports in 24hours. I managed to get my passport in a day. Also for my then seven year old, since she had a baby picture in her passport😁

thank you Amunah. It says sponsors can use assets bc I live abroad and wouldn’t have a job in usa when arriving. My thai job would meet the income requirement but not sure its accepted. I still file US tax returns. Any idea how much assets I would need to disclose if income level is only $24,000 yearly to sponsor 1?
Sorry for the late response, I just saw this. I was , trying to include the USCIS link where it states it in the detail about conditions of sponsorship, joint sponsors, combining assets. It’s not a glitch, it’s as Gordon Matthew Thomas Sumner, nicely put: “ It’s probably me.”

Neither did I. I repeated her story, the situation she mentioned.

Timeline for the above statement to be true will take 6 years if all goes well:
1. Get married in Thailand via Utah Zoom marriage, January 2024
2. After marriage certificate arrives, file I-130/I-13A online from Thailand, February 2024
3. I-130 petition approval, approximately May 2025
4. NVC stage, DS-260, August 2025
5. CR-1 visa interview, approximately November 2025
6. Enter the US on CR-1, December 2025, become an LPR (legal permanent resident)
7. File I-751/ROC removal of conditions, September 2027
8. File N-400, naturalization, September 2028, request combo interview with I-751
9. Combo interview, N-400/I-751 maybe September 2029
10. Oath ceremony, receipt of naturalization certificate, November 2029
11. Apply for US passport, November 2029
12. Receipt of US passport, January 2030, then the spouse will have the same status, US citizen with a passport, free to travel/live abroad, visit, etc.
Yes, but significally shorter then k1, retrying for tourist, and transparent.

No. As stated, this just isn't true at all. Can you clarify? When she gets status as a US Citizen.

Another vote for spousal, and in your case zoom through Utah: You are the US citizen and you can use that option, no need to bother with Thailand as both of you being foreigners, also more simple than the Phillipines, since both of you are not there. So use the situation that you can already benefit from, no need for extra steps, expenses. Etc. You are together already so you can file I-130 right right after you get the certificate. The spousal will enable all the unlimited traveling and living abroad, basically your then wife will have the same status as you. Focus on a sponsor for the NVC stage, start now even if it will take a while, since you have been out of the country and confirm your residence etc.

Our first active review was once the NOA1 was finally mailed. Second one came 11 and half months later.

You will slay this because giving up is simply not an option. Never surrender. We didn’t. Keeping you in my duas.

Fresh from the local DMV ( New York) GC being delivered via priority mail with my husband’s name and our address clearly stated, social security number as well, was not sufficient proof of address, but me, scribbling his name and mailing an empty envelope through regular mail is. Just in case someone is at this step.

Spousal visa is far more superior, research it before you make a final decision. Also financial co-sponsor, start thinking and planning that out, either way you go. Best of luck
-
DV is green card on the entrance, but it’s a lottery, so you have as much chance as the other guy. Spousal is also a green card on the entrance. K1: you wait as long as for the spousal but no green card on the entrance. The waiting game starts then. No freedom to work, travel etc. Separation from your significant other is a due process in all three situations. Maybe it makes more sense laid out like this.
