On top or a person can not work (even to care for a loved one ) on a tourist visa
marry and adjust
and so sorry for your injuries as i know how painful breaking a wrist can be / fell and broke both mine a few years back
Thank you! This has really sucked but I can't imagine breaking both sides! I'm so sorry you experienced that. I at least have one arm left!

Can I apply for the I-130 online? Or should we do both the 130 and 485 via paper? Thank you!

You guys are amazing and I appreciate you so much! And thats not just the painkillers talking! 🤣We're looking into how to get a marriage license in CT now.

Thank you all! I can't express how much I appreciate you!

Why would it be denied?
Has to be a reason and if so you have much bigger issues
I'm worried it would be denied/thought to be fraud because of the situation. Our premise for marrying and doing AOS from here is the accident and the fact that I need help at home. What if the immigration officer handling AOS thinks that my accident wasn't serious enough to need help? Or what if they ask why someone else couldn't help me, why did he have to stay and do it?
I think I'm overthinking this but I'm just so worried something will go wrong. I hope I don't sound argumentative, its not that at all. I'm just afraid haha. Thank you so much for all this help!

Adjusting seems to make sense, he is I assume not working and you would save a lot of time
I am so scared. 🤣 Isn't the penalty like a 10 year ban from the US? If his 485/AOS is denied?
We will think about it today and tomorrow! Thank you all again so much!

Intent is established by CBP at the port of entry. CBP determined that, despite the pending I-129F, he did not intend to adjust status.
Your arm was not broken before he entered the USA. So circumstances changed. You’ve plenty of evidence.
You’ve been given lemons. Time to make lemonade.
You need him and he is here. Take this gift. You will regret it otherwise.
Yes a denied B visa when one is ESTA eligible is a de-facto ban in most cases.
You’ve got today and tomorrow to consider your options. Tuesday the counties open for marriage licensing.
Tick tock.
I'll have to think about this and talk about it with him. Thank you so, so much.

You have to reapply and with a refused visa on your record you might not be approved
Thank you for telling me this!
I think I'll just have him cancel the B2. Maybe I can pack up and move there for a few months after surgery. I'm out of work anyway and its not like our toddler goes to school.
Huge thank you to everyone!! I really, really appreciate the help! We would have made some awful decisions without you!

The B visa is not a good avenue to go and I would reconsider even doing it at all because he’ll lose his Esta if the B visa gets denied. The reason for applying + having a spouse and child in the US= a very likely denial..
You can consider filing for adjustment of status or just leave it as it is, but I really don’t think you should continue the B visa..
Losing an ESTA after a denied B2 is news to me, thanks for sharing!

He is not getting a B visa and as time is of the essence no point belaboring why.
Get married this week. Thus is a case where I recommend Vegas and @Loren Y can get this done for you within minutes of arrival.
File to adjust (then cancel I-129F). Pending adjustment of status means he can stay until his case is decided and if decided as a yes, he can stay forever.
Follow the process in:
https://www.visajourney.com/guides/i130-spouse-inside-usa/
I appreciate the help! It just makes me really nervous haha. We have a pending K1 that is so close to a decision. I'm worried that they'll see the canceled K1 and think visa fraud while we file the 485. I'll have to look into it more! Thanks!

First getting a B will be challenging and B or VWP makes no difference
How long has he been here on this visit?
Yeah we figured the B chance was pretty low. This trip is about 61 days I think. Thanksgiving, Christmas, New Years. Terrible timing with everything, I know! If he hadn't been here so long I wouldn't be worrying about re-entering on an ESTA again so much.
If he just can't come back it is what it is. I'm hoping that after surgery I can manage better and I'll try to get some friends to help.
Thank you for the insight!

Hi everyone! I have a bit of a long winded question, my apologies in advance.
My name is Anna, I am a US citizen. I applied for a K1 visa in December of 2021 and my partner and I are excited about getting close to NOA2! My partner is Belgian/Dutch and has an ESTA. He is currently here in the US on his ESTA and leaves in just a few days. I had a stupid, stupid, stupid accident a few days ago. I had a nasty fall on concrete and broke my wrist, arm and elbow in more than five places. I have several surgeries ahead of me and will be out of work for many months. I need a lot of help! I can barely care for myself, much less our toddler. His flight is in a few days and I'd love for him to come right back. But, leaving on an ESTA and trying to re-enter within a week is a major no-no and we know it.
My partner has a B2 interview a few days after he returns to Brussels. I've given him all my medical paperwork, my short term disability insurance info and a ton of other supporting documents to prove what happened and why I need help. Am I totally wrong in thinking that if the B2 gets approved it'll be easier to re-enter rather than using the ESTA again so quickly? I don't want to do anything wrong but this really sucks and I'm desperate for something.
Thank you so much!

I know it varies wildly now in the process time frame, but say visa journey estimates an i129f to be adjudicated ( this meaning accepted or passed uscis review?) In Dec 2022, with it already being 15 months since uscis accepted it. Does the filer get notice of its passing uscis review separately from nvc acceptance? What's the timeframe for hearing this update? If it takes until nvc has it, and I've heard that can be several months, is notice of noa2 given only then? What have others seen in this regard? I can't find any accurate information about time lengths.
When USCIS makes a decision on the I-129F, the petitioner will get an email. So you'll know when you get NOA2 and yes, it is separate from NVC. Yes, it takes around 15 months now. NVC is a whole different beast. People have been emailing NVC to find their status there. Length there varies wildly. It takes USCIS 4-12 weeks to send the case to NVC. Then it takes NVC 2-8 weeks to assign a case number. At least thats how its going these days. Who knows what it will be in a few months. Hopefully it'll go back to normal!

Weekly update ....
Nothing really happening in my December 2021 filings (2 RFEs and 1 updated file) ...
Not unusual.
As for burndown this week, only 241 cases were seen being opened (including all withdrawls)
That is a little disheartening but not unexpected as between Christmas and New Years this past week.
Here are the details
Week Was: Now: Delta: Approved: Denied: RFE:
07/23 15 15 0 0 0 0
07/30 38 37 1 0 1 0
08/06 22 22 0 0 0 0
08/13 58 56 2 0 0 2
08/20 68 63 5 0 1 4
08/27 104 101 3 3 0 0
09/03 147 116 31 24 0 7
09/10 164 154 10 9 0 0
09/17 220 205 15 14 0 1
09/24 211 197 14 8 0 6
10/01 254 235 19 15 0 4
10/08 353 295 58 38 0 19
10/15 535 469 66 42 0 24
10/22 659 648 11 8 0 2Thank you! It seems like the 14 month mark is when USCIS starts SLOWLY working on the next month. So I think December filers will start seeing a slow trickle in February. Maybe 5-10 a week to start. Then the good stuff will happen in March.
My partner and I just booked a two week trip to Portugal, Spain and the Canary Islands for the last two weeks of February. Hoping it'll help the time pass to have something to look forward to! Then when we get back December filers will be in the "any day now!" category finally! Thanks for the updates!

Hi all! Does anyone have data for last Thursday and Friday? The 22nd and 23rd? Thanks so much!

Thank you for sharing this. But a big middle finger to USCIS. This is their year end report - a major report! - and not one single mention of the I-129F or the fact that the wait time for it has literally tripled and is getting worse.

Nothing worth reporting, no. There was a problem with the system and most of the cases from Monday rolled over into Tuesday so the data was too confusing to post anyway.
Understood, thanks so much!

Does this impact how long it takes for NOA2 sometimes? I’m clueless on all of this lol just wondering
No, the country does not impact the I-129F. The I-129F is for the US sponsor, not the foreign beneficiary. Yes, Ukraine filers have been expedited. That is why those are getting done faster. The I-129F ensures that the US sponsor is actually eligible to file a K1, it doesn't really have anything to do with the beneficiary at this step.

Thats a big group! I have 194 total and 122 pending for that one.

I have 53 untouched for 132000 and 71 untouched for 132500. Overall September has about 63% of its cases untouched. I don't run it every day like Elson does so there might have been a couple of changes since mine was run on the 27th.
USCIS just updated the timeline to 15.5 months. So I'm thinking mid to end of December for most of the untouched September cases. But, you never know! There was that one good week a little while ago that I think everyone (including me) is clinging onto hope over! -

Is there an easy way to see how many cases remain untouched in a particular range of case numbers?
You can run a programming script like Elson George and I do. Or you can run the numbers by hand. Is there a certain range you were wondering about? I can pull it from my spreadsheet for now.
