    Yes, they finished that but also this past September 26, 2022 they requested me to do biometrics which I did on September 26. The letter says that a decision has been made on my case and it's a formal decision and to follow instructions in the letter that was mailed out January 13, 2023.

    However, it doesn't provide or state the status of approval/denial. Can someone explain to me what this may mean. I called USCIS three times today and the last lady told me it's not abnormal to receive a notice like this by email or text that doesn't show whether the case has been approved or denied but she said normally if it's declined that your status online would show declined but to wait for the letter to arrive by mail within two weeks and follow the instructions in the letter. So she gave me a little peace of mind bcs at first I was kind of mad or upset bcs I've never received a notice of action 2 letter from uscis that doesn't show the status right away. Pls assist me if you guys have had this happen.  The last time I filed for my ex-wife in 2010 and my case was approved they sent me a text and email as well as the noa2 in the mail stating the approval and what steps are next. 

     

     

    I checked your timeline. Is the information correct? 2020 filer that was transferred to Vermont?

    But K-1 was our best route because we will be together sooner.  We could file now, and then worry about AOS once she arrives here in the US. Yes she won't be able to work or travel (internationally), but at least we'd be together to wait it out.

    Hi! I hope this doesn't come across the wrong way, but I just wanted to share that the spousal visa is faster and cheaper at every step. In 90% of cases, the petition is approved sooner. And there is no need for AOS, the CR1 visa is a green card. The spousal service center is random, unlike the K1 that automatically goes to California. All the spousal service centers are averaging 10-12 months right now, with one exception. (The Vermont center is currently at 16 months.)

     

    The CR1 visa is better in every way, there are zero benefits to the K1 visa now. And with the AOS price hikes coming up, the spousal will be nearly $2,000 cheaper. 

     

    You're all so early in this process. If you can withdraw and file a spousal I would recommend it. Just a strangers two cents. Best of luck! 

  4. Hi everyone! I have one more (maybe stupid) question.

     

    Paperwork was sent off and we have all the NOA1s. My husband obviously has nothing to do besides be in the house with our toddler since he can't work. We enrolled him in two classes at the local community college for some intellectual stimulation and adult conversation. Was this a bad idea? My lawyer friends are saying that now it really looks like we misrepresented the ESTA if he's "settling in" so quickly. BS or genuine concern? Drop out of school?

    1. I was doing the scans for saturday but mostly its RFEs and hence i stopped doing it, besides i want to enjoy my weekend haha.

    If it gives you some peace, those denials are only for people who "misrepresent themselves." AKA lying. Its typically when someone didn't actually meet within the last two years and either passed it off like they did or tried to get a waiver. It can also occur when both parties are not legally free and able to marry. Either they are still married to an ex without an official divorce (religious divorces and annulments don't count in the eyes of the U.S.) or they are not able to marry yet due to the wait times post-divorce in their state.

     

    If you didn't miss any steps, you'll be okay!

    Just commenting to share a giggle and agree. I just filed my 130 and 485 (paper) and dropped it in the mail today. I over thought it so much I forgot how to spell "n/a" after the 200th one.

    Ask for a certified copy of marriage certificate. They can give it to you, right there for like $5. I would get 2 or 3. A friend did that and used it to file his papers. Had no problem with USCIS. USCIS accepts certified copies of marriage certificate. It's in their guides. Anyway, problem solved. 

     

    Now, for I-864, you only need your IRS transcripts of 2021, 2020 and 2019.

    I have plenty of tax transcripts, no worries there! I just obviously won’t have 2022.

  9. We’re headed to town hall tomorrow to get the marriage license. We can get married same day, no problem. But the justice of the peace we found to marry us tomorrow is saying it can take several weeks to get the actual marriage certificate in the mail. 
     

    This is obviously a problem right? I need to file everything before the 90 days are up? We’re going to ask the JotP to physically drop off our paperwork instead of mailing it to save time. And we’re going to try to go to vital records a few days later to request a copy instead of waiting for the certificate in the mail.

    Normally you would send in pay slips with the I 864 but you will not have any, well if this is recent maybe you do.

    Yes, Aflac is my disability insurance company that is covering my salary during this issue. I’m a salaried employee so I get paid once a month. The accident happened just a little while ago so I got a December paycheck pretty close to normal.

    No, through insurance. Does it matter where the money comes from? No clue on the return date just yet, depends on how surgery goes. My ortho team says maybe as soon as 12 weeks if I heal well. 
     

    The income will matter at the interview stage right? So I’ve got time to figure this out? I’m assuming it’ll be 6-12 months for the AOS interview with the way things have been going.
