His VD / voluntary departure became an Order of Removal when he failed to leave . Since he ultimately left in 2010 , that began his 10 year bar and he has satisfied it. No waiver ( I-212) will be needed…but until he gets in front of a consular interview and walks away with an immigrant visa approval…he won’t know for sure if they won’t find other inadmissibilities that require an I-601 waiver.

For example, CDJ Mexico slaps smuggling charges against everyone whose children or spouse EWI at same time or after.

Am assuming the attorney is preparing I-130 by your friends son/daughter..

Thanks for the response, The attorney is preparing the  I-130 based in the spouse that is an American citizen.

Possibly not. Somebody who had entered illegally and then left, were they deported?

EWI in 2004 , then was detained by ICE in 2006, faill to leave a the time (2007)Ordered by judge after a fell immigration couts, and then left on his own in Dec 30 2010.

Is out of the cUS since. The lawyer requested the FOIA and was charge: 212(a)(6)(a)(i).

Is a waiver needed for this case?

  3. Hello everyone, as an October 2021 filler I will share with you guys my experience.

We started in Potomac.  Then we got transferred to  California Center which is was the worse at the time (it was taking 24,5 months /  2021).  I wouldn’t be surprised if you guys get  transferred out without any warnings, I think its their way to share the workload between the centers.  I am seeing a lot of people being moved so I woldn't worry too much.  I started checking my account all the time and it was a huge waste of time and drove me crazy.  I was calling USCIS all the time .   It is much easier knowing you just have to wait and  focus on work or something. Our I-130 was approved in 13 months (California) we just finished NVC part,  we are waiting for the interview letter.  I know it feels like it will never happen, but it does.  Patient is a virtue.  Unfortunately I am not exactly a patient man. If you guys have any questions about the process just let me know.

California SC is messing with my anxiety level. I see one approuval a week and they are apparently still stuck with first 10 days of Sept 2021. Is they any update yet? Do you see any movement in cali sc lately for cr1 category?

No movement here for me, in 20 days will be a year since my wife send our application.

Luckly my wife and kids live here in Brazil with me, I'm trying to not check or think about the process all the time, trying to focus on work or something.

    PD Oct 4th.

    330 days on AR.(CSC)

California sc it's really taking a long time...
