Well the reason you didn't hear about it until now is because your file was sitting in a box somewhere waiting for it's turn to be looked at by an adjudicator. Now they finally pulled it out and dusted it off.

This is actually pretty good news. It means your case finally rose to the top of the pile. Send them what they want, and you should have an approval about 2 weeks after that. Your lawyer can't do anything for you.

Yes, every time I think about this process it pisses me off for some reason. I was talking the other day about how unfair the entire system is to honest people.
I was clueless about the whole thing. I could have done DCF, but had no idea. Getting your wife over taking a year is just wrong. The K-1 folks have it even worse. It's pretty unbeliveable.

Ok, to be honest, nothing was really thought out. That was some idea we had and I just threw it out. Found out real quick it wasn't going to happen so I let it go. It was not big deal, was brought up several weeks ago and did not know people thought it weird.
Yes, it is my time of the month. Very sensitive right now.
This whole thing is a pain in the a$$. No way around it though.

If you are posting or are sharing on an internet forum, expect to get opinions. Also I have read lots of Anya's post over the years and they can be quite helpful.
To be honest just reading what you wrote, first thing I thought was your wifes friend wants to come to the US, and stay. Why would someone quit a decent job, to come to the US with an un-certain future, at some point, the kid is going to be old enough, and she is going to be of little use. I am sure the embassy will think the same thing.

Who said anything about coming here to just help out with no pay. You obviously don't know anything about my situation and to say the least my financial situation or personal situation so please leave your "weird situation" comments off the board.
Take it easy on her. She's been around awhile. I think things are getting mixed up.

I've posted this quite a few times. My case still shows pending on the USCIS website, and my wife has been here almost 2 years now. They can't seem to figure out how to update a website, but fortunately they can can figure out how to mail a letter. Go with what you see on paper from them.

Man!! It's a website. I got kicked off of thaivisa.com for no good reason. If I got banned here, who really gives a sh!t?
This site is the best in the world when it comes to immigration to the US. All the other OT and Politics and Religion stuff is really secondary at the end of the day.

So check this out...
I call USCIS today and finally get through to customer service. Immediately the lady on the phone says, "I see on my computer that you are applying for an I29-F and that you were approved a week ago." So I get all excited, but then she starts asking me all these questions about the case as if she didn't just tell me the status. Then she says that I need to call back in one month to submit an official inquiry into the case, and that she can't give me any information at this time.
So am I approved, am I not approved. USCIS is sending me mixed messages!
I guess you gotta just laugh and the whole thing. Until you get the piece of paper in the mailbox, nothing is official. Gotta love the govt.

The card says July 2012, but the stamp on the passport says February 2011.
So no problem. He can travel freely until July 2012. Keep in mind if he stays out of the US for more than 6 months, some other things come into play. If he is staying less than 6 months there is no issue at all.

My husband came from overseas through a marriage visa. Since we haven't reached our 2 year anniversary yet he is a conditional resident. Recently we found out that his mother is in ICU and there is a 90% chance she wont make it. He wants to go back to overseas for 10 days, him and his older brother want to travel. My aunt works at the hospital his mother's in. I made an infopass appointment for him to visit the local immigration office, its Tuesday. I want to know if anyone has had this experience before? He's only been here 6 months, he has a job and everything here now. Do you think immigration will have a problem with him going since he hasn't been here too long? I mean his mom is dying.

Actually I found VJ one week before I left to meet her in person. I never subscribed to any of the other forums; I did all the homework myself, on my own.
And yes I picked my wife's profile out of a catalog and now we are happily married. Are you jealous or something? How does it matter how you meet the first time?
Isn't the long lasting love and life together the ultimate goal? Or do you need to satisfy what others think of you?

People, don't you realize that with this international relationship and your inevitable dance with USCIS you have to think and act outside your normal box.
Stay at a hotel, even for one night, just to generate that evidence. Generate the evidence. What is so hard about this concept?

I think some people that have a plan to marry a foreigner, I mean guys who go searching abroad for a wife, "bride hunters" if you will, probably visit websites like VJ long before even meeting their future spouse. The reality is, many of us do not fall into this category and are doing this on-the-fly. I suspect Baron555 was once a "bride hunter".

How do you convince them that the situation changed & that there IS NO intent to defraud, it just is playing out this way? ( I am a retired law enforcement officer who has worked alongside ICE and have seen first hand thier Nazi techniques..)
I know a couple here. She came over on a tourist visa. They were gonna marry right when she got here and then AOS. I advised against that. Told them to wait at least a month. They did that, filed AOS and were fine. Like I said it's kinda jumping the line, but hey live and let live. If USCIS wasn't so f*cked up, people wouldn't need to do that.

I'll tell ya what, don't go helping anyone out around here. This guy PM'ed me about the police report and how to get it without going to BKK. I gave him my wifes number in Thailand to explain how she did it without actually going to BKK. I just got a ###### PM from him accusing my wife of trying to hit her up for 5k Bhat. Apparently my wife paid that to some lawyer in BKK to deal with it so she didn't have to hop on the bus and spend a few days there.
I tried to help this pr!ck out and now he is accusing my wife of trying to shake his girl down for 5k baht. No good deed goes unpunished. I hope he met her at Nana or Cowboy and she takes him for everything he's got.

The love of my life lives in Minnesota and I live in Thunder Bay, no air travel required. We frequently go back and forth with no passport stamps. What I did to help solve this problem is I kept a 'contact log' detailing each time Michael came to Thunder Bay and when I went to Minnesota. It clearly states the dates of entry, the dates of departure, who we saw etc. I was fortunate in that my daughter's friend had just been through the process so I started collecting 'evidence' as soon as we started discussing marriage. When the right time came to mail our K1 petition Michael and I both signed and dated the contact log. Our log goes back to Dec 2008. Since then we have received our NOA1. I will continue to do this until our interview in Montreal. Of course we also put in other evidence: picture (I included photos of Michael with my pets and also with my grandchildren), facebook comments of our engagement; emails etc. Also, I clearly outlined how we first met. Hope this helps future applicants who live close to each other and do not receive passport stamps.

I am married to a Thai national for the last 3+ years and have resided with her in Thailand for that period of time on a Thai retirement visa. I came back to the USA to seek employment in September and she stayed back in Thailand. She has a B1/B2 Visa which is good until 2015.
She came to visit for the holidays on 02 December via Seattle and was questioned by CBP and informed CBP that she was visiting relatives ( she also has cousins here in AZ and in TX )and her husband ( me ) The CBP officer telephoned me and asked if she was comng to visit, to which I replied in the affirmative. He allowed her 6 months entry ( which will expire on the last day of May 2011. )
I have now found employment ( as of 04 January 2011 ) and would like to see if we may be able to get a change of status for her.
My question is, is this going to be considered FRAUD? It was not our purpose to "dodge" the normal immigration system, never our intention.
Can we file the necessary paperwork while she is still within the United States and is she allowed to remain while the paperwork is in process?
I informed CBP officer while on the phone that I came back to find a job and that we still reside in Thailand, wife has a return ticket on the date he allowed her to stay until, but would possibly change and file the I-130 while in Thailand. Not an issue with the officer at all. Things have changed and I would like her to stay.
Sorry if I'm rambling..
You're going to catch hell around here asking about that. It's all about INTENT. People will seeing it as "jumping the line" Did she come here on the B1 with the intent of staying and adjusting status?
I'll go ahead and take my beating. You can adjust status and get a green card in this situation. That said, if they think she came here on the B1 to immigrate, that constitutes fraud. It's a slippery slope.
The "right" way to do it is file DCF in Thailand since you have resided there for more than 6 months. The time will be about the same, maybe even a little quicker.

Rebecca is right. I was given a 3 year work visa in canada. Took a week I think. I was given a 15 month marraige visa in Thailand in about 36 hours. I hear in the EU it takes 30 days. It took a year to get my wifes IR-1. She came here for help, not to be scolded like a child. If you don't have anything constructive to post, go and hang out in OT or P and R. I'm sure happy I didn't get responses like that when we got 221g. Everyone helped out a lot here. Even those here I had issues with in the past.

If this was shot down before it ever got out of USCIS, best bet is to get the information they want and start over. Also, if you get approved they will be asking for much more proof at the consular interview.

Looks like you would have been approved it not for this RFE. It's really not a big deal. Give them what they are asking for, and you'll more than likely be approved in the next 2 weeks
