    About the "copy paste" it turns out she made the hardship letter, the lawyer translated and sent the I601 without giving her a copy of that form filled out according to her. That's the first thing I thought on doing to make it easy to elaborate.

    So for the $5K question, DID your friend know of the RISK? Did attorney advise her ? 

     

    In either case , she can ask for a complete I-601 A filing copy ( including brief/exhibits/ evidence ) add an updated doctors letters ( see what was sent and get new one)  AND she can DIY the I-601. 

    Only thing in the brief that will change is ref to I-601 ( not I-601 A ) and ref ULP / unlawful presence and current inadmissibility .

     

    After filing, call in to USCIS for expedite and have husband reach out to congressman for help
     

    She knew about the posibility of having to submit another waiver after interviewing because she started to get information on immigration forums but I guess she had hope I would not be her case... Thank you for the advise I'm trying to help her to the best of my understanding. 

  3. Hello, my brother mentioned to me somebody told him about a visa he could apply for to accompany/help my elderly parents whenever they travel to US for medical appointments and to visit family. I just don't seem to find the information on the type of visa he is talking  about. Will that be B1/B2? 

    As a side note he could be petitioned by my parents but it takes 15 years or more for a visa for Mexican 🇲🇽 citizens. He has a petition through my sister but his priority date is still far away.

    Was her I-601 A expedited ? ( all such waivers are based on hardship). If yes then likely expedite four I-601 will be granted at filing.  
     

    If I-601 A was not expedited, then file I.601 , get receipt and prepare some updated medical treatment/conditions to show need to expedite and call it in 

    I601A was not expedited but was approved before she went out for interview.

  5. Hello. My friend had her appointment this morning in Cd Juarez Mexico and she's devastated because she was asked to submit I-601 waiver regardless having I-601A approved. The basis of denial are 212(a)(6) (E)- for aiding the illegal entry of another foreigner (her baby at that time). My question is how can she apply to get her application expedited? It seems that she'll  qualify because her husband and kid have medical issues that were proven/submitted with I601a. Thank you 

  6. Are you sure about this? Section 212a(5) of the INA is about aliens entering to work in the US and who need a labor certification.

    If they had never had a visa and never had any previous problems with US immigration then they should be able to adjust status through marriage to a US citizen. Many people get humanitarian parole because it's the only way they can get into the US, usually because they've had a previous overstay or deportation. People in that group cannot adjust status. Being paroled into the US for humanitarian reasons doesn't make the previous inadmissibility go away.

    Sorry the letter is actually a d 212(d)5, it is actually weird. They said they have never applied for any kind of visa before... I've been searching on the web but there is not too much info. Thank u for your time.

  7. Got it. They (wife and children) entered on 2000, they did not apply for previous visa, not baned, not illegal/legal stay/entrances before. They did not have time to apply for a regular visa or family petition coz of the emergency. The reason they came was coz the citizen's mother hadn't met the grandchildren and she wanted to do so before she died. The visa was granted for 1 month but afterwards they applied for an extension, they got 1more month and they decided to stay. They haven't applied for AOS coz money and ignorance (the citizen "thought" it wasn't totally necessary since the wife wasn't going to work or kind of...). What do u think?

    Thank you all for helping me, it should be great if you can request the article for me. I agree, it's a shame that only certain "hosters" (I don't know if it's the right name) or databases carry this kind of articles...

    man, why getting into science has to be hard? science has to be for free!

Have you tried this? BTW, kudos to you for helping DH with his studies, what's he studying? :thumbs:
