@kate777 hi just curious how long did it take between the documents submission and the visa issuance? Did you have updates in between? Ours got sent on 18th Jan 2023 and since then few updates but it still says ‘Refused’ btw we are K1 visa too

That sucks I’m sorry, that’s longer than us and I thought we had to wait a long time! His medical was submitted 1/30, and he mailed his pics on 2/1 so they got there in the next day or two. We then had case updates on 2/7 and 2/23, before it said application received on 3/7.

Hey, congrats!! We’re almost there too, they requested the medical. I’m curious, it seems they want them delivered via courier, and not electronically. Do you remember if you sent your medical via courier or did the physician send them for you electronically?

Congrats! There's a light at the end of the tunnel!!

The physician sent them electronically. We also had to send passport pics so those were sent by courier, but the medical was handled same as the first time. Maybe that's generic language they use in the email, about logging into the system for instructions on how to send requested docs?

    Congrats!

May I ask what happened the first time that you had to refile? Did your attorney summon the State Department? Did they respond to the court? Or there were clerical issues?

My understanding is that they originally filed the lawsuit with the DC courts, summons were issued, defendants served, but there was no movement from the US attorney. I don’t know why— not sure if anyone even looked at it as there were no case updates, so it may have just been the high volume of lawsuits filed in DC. But I have no idea.

My lawyer and the defendants then agreed the best course of action would be to refile the case in my state, which was known to move faster. They handled that all on their end, and as soon as they did our case started to get touched and then we got the 2nd medical request within a month.

wow congrats! 10 months later - so long 🥴 I thought the "extension" they can request was up to 90 days in total, disheartening to see that they can go 90 days and then ask for an additional 4 months

SO long! yeah on Dec 15, when they refiled for us, we were told that the new deadline would be 45 days out. and then at the end of that they asked for an additional 45 days. so it was 60 days (they must have served the defendants in Oct) and then two 45 day extensions

which honestly doesn’t seem to quite add up based on the dates provided, but that was what we were told? can’t tell if was 45 calendar days or 45 business days because neither match exactly

  5. We got the DS 5535 today. My fiance's interview was yesterday (May 4) and they emailed him today (May 5). Just adding info in relation to convos here, he has extensive travel history between the US and Canada but he's never left North America and doesn't have any ties to any other countries. Both his parents are Canadian citizens as is he.

Joining you all in the wait...

Here's the weekly round up: some good news finally - they've processed ~4x as many I-129F cases per day this week compared to last (last week's avg. was 11 cases per day)!

Also, I was made aware that October filers have receipt numbers through 27000, so I've added an additional 10,000 cases to the total range. Hopefully, everyone from our month is captured now!

Thanks for updating! :)I'm one of the stragglers, Oct 29 and receipt number in the 23000s

Hooray! Gives us hope :) however I’m a bit annoyed they haven’t backdated it more than that...? I guess I was holding hope that they would date the NOA1 to when it would normally have been issued ie in your case somewhere around mid-November.

oh well, at least they seem to be trying hard to get through the backlog!

Yeah. Interestingly, so the paper NoA1 I received had the notice date of Jan 18, but when I checked my case status online it said it was received Oct 29 and if I don't receive my receipt notice by Nov 28 to contact them. But when I called in Jan they had said I wasn't in the system and didn't have a case number. So not sure what that means for backdating.

Either way, it seems like they just kind of stopped for awhile in Oct, it wasn't that they were adding extra people in front of us. So I'm thinking when they finish processing the people who got their NoAs on time, we should still be next in line. Without the same 3 month gap.

Fingers crossed. Hope yours comes soon!

Just curious how did you get passed the automation to talk to a representative? I have tried many times and eventually the automated system just says "We can't help you thanks for calling" and hangs up on me. I haven't been able to talk to anyone since September.

I think I started by saying I wanted a case status, and it asked for the receipt number to which I said I don't have one, and it asked if the application was sent to a lockbox or a service center and first I said lockbox, and it just said to email them- which I had already done. And then I had some back and forths saying it was longer than 30 days, no receipt number, variations of that. Finally when it got around to asking service center or lockbox again, I said service center, and it put me through.

People in the facebook group were saying that you could say "technical support" every time it asked a question and it would put you through.

    Good luck!

My e-mail inquiry to the lockbox facility after 30 days of filing date has just been replied :) gotta love our institutions! The standard message asks me to wait 30 additional days (business days) before contacting them again in case I don’t receive my NOA1 by then. Things could be moving faster and 13 days before the Orange baboon gets out can’t come soon enough and end the ridiculous policies this government put in place under the “professional” eyes of the best he hires LOL all acting employees put in places like USCIS to push his racist agenda. I am waiting until my 3rd month and after that I am suing the government.

Lol, I got a reply today too! My email was sent Dec 4. Sounds like the same message as you.

  10. Just adding to the convo... ours was signed for in Texas on Oct 29, still no NoA1 here on Jan 6, and my check has not been cashed. I emailed a little after 30 days and got an automated reply, nothing else, and called two days ago. She said that there was an increase in filings in Oct-Dec and that I should get the NoA1 by Jan 15. She was nice enough but I'm not sure if those were just things to say or if they were indeed based on something. Glad to know I'm not the only one waiting... (although obviously I wish none of us were waiting!)
