I would contact immigration and let them know whats happening. To protect you from any wrong doing. let them know you feel she fraudulently married you and split once she got here. They will put that in the system and she will have to face up to it regardless. You are her sponsor I take it?

Just a update to Adam Walsh act. Me and my wife's marriage is so wonderful. We went threw a long road and have moved past this whole immigration process and also gotten past the Adam Walsh Act that nearly broke us. For those petitioners out there that experience this type of case be patient and ready to support your case with allot of evidence.
Me and my wife now have three children together in the U.S. Everything is good in Vegas.

I see several petitions posted at the USCIS website showing denial, but have yet to see any approved. Anyone ever heard of one approved?

Yes, cases do get approved. Mine was approved in 2009. It took 2 and half years. I was the first American to be approved in the Adam Walsh act. There is allot that must be done. Read my posts and time line.

Hi All,
I and my wife just got back for my CR1 visa interview in Naples and it has been a roller-coaster. During the interview I was issued a section 221(g) and told to submit additional details in the worksheet that had 5 question after which my application would be processed. They CO said that the administrative processing can take up to 60 days.
So this is what exactly happened. My wife a US national accompanied me to the consulate in Naples, Italy for the visa interview. We were the last people to be interviewed. We were very confident of getting the visa approved since we had all the documents needed as we verified on every govt website possible, checked hundreds of post on visa journey and really did our homework well.
The CO called us to the counter and told us all looks good and made me take the oath. After which we asked us how we met, when we got married, when did we meet each others parents and so on. Later he asked me what I do for a living and I told that I am a Ph.D. student at university of Rome, He asked me what department. I answered microelectronics, Then he asked me whats your research topic at that point I got really nervous since it stated to go like a job interview but I answered I work on simulation of nano electronics. He said whats nanoelectronics and whats the application. I got so nervous and could not put it in lay man's term and just told him some more technical juggle after which he said take a sit I will call you again. 2 minutes later he returned and asked me for my CV I said I don't have since its a family based visa. He said do you have any documents about your research, I showed him the university certificate that certifies me as a current PhD student in the relevant department and that also states that i get a scholarship and so on, I also showed my masters degree certificate. He took that with him and returned to his chair 2 min later and said we need to do some more administrative processing from our side and it will take another 60 days, for that you need to send us your CV with all your job titles and description. I told him that it was not written anywhere that a CV was needed for a family visa. He kept saying they need the info. I also told him all my details like work experience, studies are there in the visa application form and I don't know what new information will you get for my CV. He kept insisting that its needed. And he needs to put the application on hold for administrative processing.
At that point we got frustrated and just complied to him how we are tried and how NVC also delayed our process for silly reasons for miscommunication errors from their side. CO kept on telling us "guy you'll have come so far, most of your things are done. But we still need the CV, my travel details (business or leisure trips), all my addressees, old passport numbers, name and date of birth of my siblings and so on". But CO said he would keep my passport with him and said if I need it during the period when they are working on my case I can write to them and they can send it to my address. Finally we accepted that it wont be approved on that day, picked the additional worksheet form from him and left the consulate heartbroken, stressed and frustrated.
Me and my wife got back to the hotel and had a brain storm session and through our old emails figured out all my travels and other details and send all the needed details with my CV within the next few hours. But by then the consulate was already closed. So today morning the consulate replied to the email stating that they received our additional details and they will let us know once processing is completed.
We just want to know if anyone here has been on AP (221(g)) for any other uncommon (unexplained) reason than the most obvious one (like lack of evidence or AOS not sufficient or a police certificate missing). Have you'll any idea what administrative processing they must be doing on my case and why he insisted for my CV in a family visa case?
We are just stressed and worried, we waited for more than a year for the interview date, running around govt offices collecting the documents needed and still have been waiting with no clearly idea as to what will happen. Although he said 60 days I see on VJ that people have been waiting for even 6 months in AP mode.

Its should not be much longer. If you replied by email the next day it can be sooner then you think. Me and my wife went threw the same situation our administrative process and it took about 2 weeks. They did not request any more documents from us, they said we were chosen for AP process.

So it's bets she goes home and awaits the process. My wife is scheduled to take here citizens test in the summer time.

My wife is a green card holder and she wants to file a adjustment of status for her sister and two daughters. They are here currently visiting with a tourist visa. Can we file a adjustment of status while they are here visiting? How long does this process take?

I'm posting this topic in regards to my family member that is here in America on a J-1 visa. My family member came here to work as an Au pair. She has been with the family for maybe 3 weeks. All of a sudden the family does not want her. Can she ask the agency to allow her more time to stay here until she can find another host family? I was reading her contract she has to pay for her own plane ticket back home. The agency does not accept any responsibility for her travels back home. I'm furious for the fact they brought my sister in law here and decide they don’t want her after all.
The agency went to the home and the family had enough nerve to question her religion, Wow she is a Jehovah Witness, how can they change her just because of that? The agent that came to the house made it clear we cannot change her just because of that. So basically she has until this weekend and her contract is voided. The agency is giving her two weeks to find another family.
Any immediate advice would be grateful.

My wife is a legal resident wanting to petition her sister and children. Can this happen and how long of a process does it take? My sister in law is from the country of Colombia. Anyone’s help would be greatly thoughtful.

My wife is already here in America with me. Angie has received her green card. We just moved, do we have to change our address with Immigration? I'm also the sponsor.

My wife is home we have gotten past all the Adam Walsh regulations, and my wife is in America. We can be a happy family. We enjoyed our new baby together on Thanksgiving day. Our first Christmas together and the New years. We just recently moved and i happen to be going threw some of our immigration paper work. I came across some Immigration information that was handed to my wife at the second interview before she left Colombia.
I was not aware of this information up until a few days ago. My wife seems to believe it was by accident the consulate passed this to her with other paper work. It was the ADAM WALSH RISK ASSESSMENT SHEET.
It contains what they are looking for to be able to determine whether to issue a approval or denial. It was in this category exactly in a check box segments.
RISK/No RISK DETERMINATIONS
1) One side was this statement- The nature and severity of the petitioners specified offense(s) against a minor. My charge and conviction at sentencing, probation etc.
2)The petitioners criminal history- No arrests since first conviction of sex offense.
3) The nature, severity, and mitigating circumstance of any arrest(s), conviction(s), or history of alcohol or substance abuse, or any violent behavior, such as domestic abuse or child abuse.- No violent behavior or abuse history
4) Will the petitioner and beneficiary be residing together.-
This next statement seems to be the most important I feel.
5) The degree of rehabilitation or behavior modification that may alleviate any risk posed by the petitioner to the beneficiary, evidenced by successful completion of appropriate counseling or rehabilitation programs and significant passage of time between incidence of violent, criminal, or abusive behavior and the submission of the petition.
comments to this question about me was this, 12 years have passed. successfully completed treatment and currently has full custody of my two sons. letters and polygraphs saying no other victims since completing probation 12 years ago.
I hope this can help others in the situations of Adam Walsh petitions. Again this is the Adam Walsh risk assessment sheet they use to grade you during the intent to deny.

Adam-Walsh is a federal statute. The states have nothing to do with it, one way or the other. It is not unconstitutional and so far no tests of it have made it to the Supreme Court.
Maybe you are referring to the way some of the states require sex offenders to register? Indeed, some have been ruled unconstitutional but no doubt they will be revised to fit the constitution. Many of our states have laws which stray from our constitutional principles -- usually they are the ones enacted in haste. Various bans on same-sex unions may end up being overturned the same way.
I am a member of the ACLU and keep pretty informed on what it's doing on behalf of individual rights.
I'm also a memeber and I feel strongly from what lawyer's resources given Adam walsh will be a law that will be uplifted. the government is not able to produce the funds for one. Also immigration has it on iy's board agenda to reconsider this Act and may up lift it depending on some certain outcomes, meaning Uncontitutional flaws.
trust me i know I worded my responce back to immigration in regards to my intent to deny underlining my rights. again after three weeks of sending my evidence back, mmmm Approved.
I will respond with the amendments it's violating on my next post.

The Adam-Walsh act is not unconstitutional. Nor are the many state laws that require sex offenders to register for the rest of their life. It is my hunch, after working with child safe environment programs, that fear of these laws keep many molesters from harming someone. Not only that, but police internet sting operations have also been a deterrent. Let's face it, there is nothing unconstitutional about marking an offender for the rest of his/her life. Actions have their consequences. Many go on with their lives and their friendships without incident, except for that cloud over their heads that won't go away.
That said, AW is being carried out more sensitively than it was at first. Some limited standards appear to have been applied to deal with exceptional cases. The law is working, at last.
Sorry you are incorrect. The act is extreamly uncontitusional ruled by many judges in fact 12 states will not adopt the new act. It's under supream court for being over turned. ACLU is fileing several law suites do to the act. Do may want to know what you are talking about before posting.

My wife and I are over 7 months pregnant. We had our visa expidited and she is flying next week to come home. There is no complications with most airlines to travel.
Also the mebassy rushed our visa to get her home in time. Even threw Ap process it lasted maybe three weeks.

"Sorry but Adam Walsh was beat". I'm sorry for the victims families but it has nothing to relate too as for immigration. Unfortunately it was brought into this Immigration system by some idiot politician that jumped the gun.
This law has so many unconstitutional quarks in it.
Sex offenders in treatment are painted with the same paint brush just different colors if that makes any since, according to one well know therapist.
My point is this, An Approval is a Victory. Victory is archived by defeat.
I beat Adam Walsh and I'm a sex offender from 13 years ago. Statutory rape was my conviction. A class C felony. I was approved battling this unconstitutional immigration law for almost three years. But it's now over with the right evidence and legal council.

I disagree. I think that some of the AW filers should not be allowed to do what they want.

It does only apply to certain offenders. As for proving you are not a risk. There are allot os SO's that cannot apply to beat this law. I do aggree with you on this. My point is that it can be beat depending on what type of conviction and how good your evidence can convince the CO to feel you are not a risk.
Again as far as I still know, I'm still the first approval with Adam walsh filers acroding to government staff.

Our visa was approved after a 4 week AP process. Bogota said they would send it with 5 working days. does it really take only 5 days to get to my wife? The same day the Co said me me she was approving it today. This email was sent to me on 10-5-09

You may NOT have a second interview! We didn't! We were put on AP. After we came out of AP, we needed to file an I-212 with our local USCIS office in Miami. We were told by the consulate that once we had the approval letter in hand, we should schedule an appointment to bring that letter in with a my wifes passport so that they can issue her visa.
What I'm getting at is that if the Consul kept your wife's passport from the first interview and did not return it to her, chances are that there may not be a second interview. When she left, did she pay for DOMESA (the courrier service that delivers the visa)?
I would contact the Consulate via e-mail immediately (if you haven't already done so) to clarify this issue. Who knows, if your wife gets her visa soon, we might meet you guys on the plane back to the states (LOL). I'm flying down to Bogota as soon as my wife calls me to inform me the visa has arrived (which should be early next week).
Anyhow, congrats.
Ecellent feedback. You were right, I emailed the embassy and reminded them of my wife having her passport there. they emailed me back to say never mind on the interview My wife was approved. they said they would send her passport within 5 business days.

I think I still the first guy that beat it. I have not heard of any others petitions approved. I give the advise what to do, and others do not listen specially about taking a updated Polygraph. This process has to be taken very carefully, with lots of evidence to prove one is not a risk to there spouse.
I have been here a lot of years. I saw one other person beat the walsh act other than you. I am very glad for you. It's very difficult and hard and it requires complete concentration and I applaude your efforts. Did you hire an immigration lawyer? Normally I tell people to get a lawyer for the Adam Walsh cases. I am curious.
I hired and attorney, but did 90% of everything on my own. I got most information from INFO pass appointments and second hand legal advise from consultations. One great attorney out there was Gary Bala. This attorney if fighting the Imbra act.

Today was a good day. Adam Walsh petitions can rest at ease. Our visa was approved in hand. My wife will be home Tuesday next week. No questions in regards to my past, except the court paper work from my past was handed to my wife in Spanish.
My wife's knowledge of my past left the embassy without any damage to questions to ask. Thank you for those who had helped me threw certain stages of this process. I will rest my profile her on visa journey tonight.
I will be more then happy to give advise to others in need of my same situation. God bless every one on Visa journey.

You are right. They do have our passport. This is good information there could be some mis communication, and be that they may not realize that have it until she is there. I better email them tonight.

There is no such thing as a wavier for Adam Walsh Act. Again read my forums on what is needed for evidence to prove you are not a threat to your loved one.
You need letter explaining your crime and showing remorse about it. I will Pm you a sample of what I did.

Don't mention the ticket unless they ask. a traffic infraction is not a criminal matter. It may not even come up.
