    Hi

i did the same yesterday, we ended up doing one file for i765 and one file for i131 each in a separate envelope.

we put a cover letter on top of the two files and sent it to Uscis.

we put the exact same form than the first time around but also added proof of current ead, with receipt notice from Uscis. Proof of biometrics, I also put my job offer of when I was recruited.

you applied in January 2020 and are still waiting?

I am just renewing since I've hit the 180 days mark...

I sent in my AOS package last year, my priority date is for September of 2020

All you have to do is to type "live chat" (or could be "live agent" instead. has to be one of either) as soon as you open up EMMA. Then it will ask you what category and you will have to choose "Green Card". After that, you will be connected to a live agent. Just ask which service location your case is and they will answer. At least this is how I got mine...

Btw, USCIS case tracker does not show anything related to interview on my case. It's still on fingerprint taken.

    Ok mate. Thanks a lot.

This is a QUESTION not a complaint. My previous job is waiting for me to have my card so they can rehire me in their US offices and I was trying to find out what to tell them. I didn’t take your place or did anything different than you did so your anger is misplaced and jealousy is a bad thing.
Maybe if you were a nicer person you’d be luckier...

Anyway, for anyone interested in the future I found out USCIS says it takes up to a month for cards to arrive but normally arrives within 1-2 weeks.

Fam! If you wanna complain, you can complain, no one here has the right to bother/bully anyone. It's a free space and we should all respect the opinion and feelings of everyone. So please, air your thoughts, your complaints and your frustrations if you so please.

    yes you did..

Does anyone know how long it takes to receive the card since the “new card is being produced”

you are complaining about how long your card will take to get it in the mail...

you are so eager to get your card in the mail while other people are still waiting for biometric.. be grateful your AOS process is moving quicker than those whole filed BEFORE you...

Yooooooo!!!! Calm down, he isn't your problem!!! If he wants to complain, he has every right under the sun to complain, same as you fam!!! What's all this negative energy??? There are people who filed for this process and got their green cards in 3 months, should we kill them because ours is taking longer? This is actually bullying!!! If He/She wants to complain, they can complain and it's for you to either ignore it and move on or appreciate that each luck is different and offer encouragements to each other.

No come dey ginger person here.

Wife tried to give me a coronary.

I left the country a couple weeks ago to take care of some business in the Philippines and because her AOS is in process she stayed behind.  I'm actually still in quarantine until tomorrow even after a negative test a week ago.  The Philippines has been quite ridiculous on lockdowns, and rules on top of rules etc.  There's really no coordination between gov't units and each governor has to add some of their own rules to the Nat'l rules, and then the mayors add some more rules, each to flex their power.  Anyway, I get woken up about 7AM with a bunch of Messenger dings.  The wife is in a panic and says she was "DENIED" and she sent a picture of the letter.  This is particularly bad timing because yesterday marks the end of her 6 month stay on her B-2 and now she's an overstayer if not for the AOS.  The internet here is some of the worst in the world so I can't read the picture of the letter yet.  All I can see is that it's from USCIS. I check the Lawfully app and nothing has changed.  While I would think something that important would update, I don''t know how reliable the app is.

Eventually, a higher resolution version of the letter downloads and I see nothing about denial.  It's the I-693 deficiency notice I already saw online 10 days ago and warned her to expect.  Pheewww.  After she (and I) calmed down, I explained they just want her to bring her physical to the interview if she has one.  It's the sealed envelope in her packet of papers so she's already ready for it.  Hahahahaha

Man, you had me sweating there... You should write a suspense novel, lol

On the other hand, thank God it wasn't a rejection... Good luck to you both.

  6. Hi guys, I think I should update the forum with mine.

    I submitted all packages which were I-130, I-131, I-765 and I-485 together. PD 14/09/2020

    4/10/2020 I received the NOAs

30/12/2020 received RFE for public charge

10/01/2021, they confirmed receipt of RFE request

16/01/2021, biometrics schedule received, appt date was 09/02/2021

16/02/2021 it says case is ready to be scheduled for interview

18/02/2021 it says card is being produced.

Correct.  The caveat for most states is to present additional evidence to satisfy residency requirements.  In many states it is a year but it varies, and schools make the decision on a case-by-case basis.  OP did not say how long the B2 overstay was, but I assumed from the post that entry on the B2 was before the pandemic so February or March 2020, at the latest sometime in the Summer of 2020, and the master's degree program would likely begin in Fall 2021, so the one year requirement should be satisfied by then.  That's why I only focused on OP's question about documents needed to show status in the US, and no F-1 visa would be needed with a pending I-485.  Regardless of in-state vs. out-of-state tuition, OP can enroll at a US university now.  Worst case scenario, he/she may have to pay out-of-state tuition for one semester and then convert to in-state.

Your assumption was spot on, entry was Feb 2020 and the masters program is to begin in the fall as said.

Sure. But the extract quoted just said AOS pending, and AoS could be from routes other than a spouse or resident family member, or equally would apply, as stated, to someone whose spouse had just moved states. I presume there are caveats that are not in that extract.

Hi, I should have clarified that, mine is through my spouse who is a citizen. Thanks

Hello, I think you should wait for you EAD card which would work for studying.

You wouldn’t be elegible to apply for F1 status (student status) within the United States, because said status is a non-immigrant application, while the Marriage-Based Adjustment of Status process is an immigrant application.

I think you should seek a consultation with an immigration attorney who could explain you more about it ☺️☺️

Thanks a lot for the insight Jacobo. I think your view is actually spot on cos I've been doing some reading but then just decided to ask the community first. I appreciate the time taken to respond

  10. Hi guys,

I am currently out of status but I've submitted my forms I-130, I-485 and etc needed for the necessary adjustment of status. I arrived on a B1/B2 visa and since then, I've overstayed because my wife and I decided to do the AOS procedure due to the COVID-19 issue.

Now, I want to do a Masters degree program while waiting for the process to take its course but I don't know what to apply as. I don't know if I can actually apply for the Student Visa also.

I think in a nutshell, my question is, considering I want to study for a MSc program, what do I apply as and how do I go about it?

    Thanks
