Hello Guys,
I am a CONDITIONAL Permanent Resident because I was married for not even two years before I got my greencard. I can remove my conditional residency by 2009. Do you think I can petition my sister to visit me for three months? Any help will be highly appreciated.

I'm in the local area of the Charlotte NC office, so why would this be sent to DC? Does this mean I might have to drive there, 5.5hrs each way for an interview instead of the 3hrs to Charlotte?
Also comparing the numbers(that don't mean all that much) on the processing times websites, then Charlotte NC is working on cases submitted in the last 6 months while the DC office is working on 12 month old cases, should I be worried about that?

You should not worry about it too much because as what I understand there is nothing wrong with your application because if there is they should inform you. As far as I can remember I filed mine in different USCIS office but they forward it to different location but it my case, closer than what's I expected. If you have any doubts about everything better to call the nearest USCIS Office about it. I wish you all the best.

Hi,
What's the limit of the time to be spent abroad (outside the USA) on the Advanced Parole? I've heard it's up to 6 months to be abroad. Is it true?
Also, I need to know if is it up to 6 months total until I get my green card or does it count as a new period up to 6 months everytime I leave the US and return back here?

Hi,
The advance parole period should not exceed one year. In the advance parole you will find how long are you allowed to stay outside the united states and the date it will expire. I received mine last may 22, 2007 and it says here (my AP) that I should return to the US and resume the processing of my AS prior to May 21, 2008.
Don't worry, as soon as you receive your AP you will know exactly how long you are allowed to stay outside the US. I filed my AS on March 6 (if I am not mistaken) and received my green card on the first week of June 2007. I received my advance parole last week of May 2007 and I was not able to use it cause before my flight outside the US I have my greencard.

I just got ASC Appointment notice indicating my biometric schedule which is on January 4, 2008. I am wondering how I know if this is for AOS or I765? At the bottom of the notice where my application numbers for the two with barcodes.. and at the top is code 3. Please I need clarifications...

During your biometric appt. tell the lady/guy in the office where your appointment being held that you also applied for I-765, or tell her/him what other applications you have because it happened to me wherein the girl told me that if I don't inform them about other applications I have, I need to return to their office for another biometric exam for those other applications I applied. Just to be in the safe side.

I checked the web site and saw that my AP was approved. Has anyone traveled with one? Can you tell me the process, is it a letter, a pasport stamp? is it easy to get back, any problems?

I also applied for AP and was approved but it so happened that before I leave the country I received my greencard, so I haven't use it. It's a form of a letter and its good as a greencard/passport. Bring your passport and that AP because you will present it to the airline company and the Custom and Boarder Protection Inspector at a port-of-entry. Read the AP carefully. Congrats. Two questions.
1. Are money gram transfer reciepts helpful as proof of relationship or would they be more hurtful? While i was in the States a couple months ago I sent my fiance in Nicaragua several hundred dollars to apply for a visitor´s visa.
2. I´m confused as to what to use for proof of on-going relationship. We´ve got the phone records, pictures, emails, chats, plane tickets, all that for the proof for before. But how do I proove continuation? Short of a plane ticket. because honestly, i can´t afford to buy it just for the proof right now, I will eventually, but i was hoping to get this application in sooner than that. Ideas that have worked in the past?

Your recent emails, airmails, phonecalls, photos and even moneygram receipt would be enough to prove them that you build a relationship with your Fiance. Regarding the moneygram receipt, as long as the money you sent to him is not that big in just one receipt and not every other day when you sent it, it would be fine because in my case when I process my papers my fiance (who is my husband now) sent me big amount of money and everything is fine. Everything will be fine, I know you can make it.

You must inform the USCIS Office that you are going to move. They will provide the date and place where you are going to have your biometric. I have a copy in my biometric appointment last april 4, 2007 and it says here......' PLEASE APPEAR AT THE BELOW APPLICATION SUPPORT CENTER AT THE DATE AND TIME SPECIFIED. IF YOU FAIL TO APPEAR AS SCHEDULED, YOUR APPLICATION WILL BE CONSIDERED ABANDONED. I am just hoping you will receive your appointment before you move.

Is a certification from her school stating that she has still to enroll in the second semester is valid enough as a reason that she will come back home?

I got my conditional green card on July 20th
It took about 6 months from the submission of AOS application to receiving conditional green card. Do I file for removal of conditional green card within 90 days of our 2 years anniversary? I just want to make sure that I dont need to worry about anything till then. How much its going to cost to file for removal of conditional GC?
P.S. Speical thanks to all of people here who help everybody and you guys really helped me a lot with my AOS application. Without your help, I probably would spend lots of money on lawyers. Thank you very much.
Hi,
There is a expiry date found in your greencard. 90 days before that expiry date you must file to remove your conditional status (This is what the Immigration Officer told me so that they have enough time to process our papers before our greencard expire). Fee to remove conditional status or any other fee usually change from time to time. Be sure to to update yourself regarding the fee before submitting your application. You can found the fee here in visa journey, you can browse also in the USCIS website or call the nearest USCIS where you live. Congrats!

I have a passport but the name appear in there is when I was still single. It will expire on August 2011. Me and my husband is planning to visit europe within this year. I have my greencard but it is still on conditional status. Can I still travel to europe although the name appear in my passport and greencard is different? Since I am still on a conditional status, is constant travelling outside the US will affect my application to REMOVE A CONDITIONAL STATUS? Thank you and more power!

After filing for a green card in January, and having our interview in April, we have the temp gc in hand!!!

I suggested not to visit europe in August because according to my husband and his friends, a vast majority of stores and tourist places will close in this month.

Just the green-card, unless you plan on being out of country for more than 1 year, and less than 2, you will need a re-entry permit if your trip lasts more than 1 year.
Also you wont have to go through the visitors line at the POE either, you go through the citizens/residents line.

Are there any other documents to be presented to the immigration officer after you travel outside the US beside the greencard? I will visit my family in the Philippines and my flight is tomorrow. I am afraid that when I return, the Immigration officer at the airport will ask me documents beside my greencard. Is there anyone here that already travelled outside the US and only presented their greencard as they return?

We filed the AOS and the EAD separately, so now we have two NOA's and two appointments to have biometrics, on July 13 and again on July 18. I've been unable to contact USICS by telephone, so can anyone tell me... does my wife need to go to both appointments, or is one enough to cover everything?

Go on July 13 and make sure you will bring the two biometric appointments and make sure that you will present the two appointment and let the personnel there stamp on each every appointment. I have seem situation as of yours and I went only once by presented all the biometric appointments. Good luck

My wife and I just got married and she changed her last name to my last name on our Marriage Certificate.
On the I-485 does she now use her new last name (family name) on the application?
She must use your last name and put her family name(before marriage) as other name/s used. Congrats.

is the sealed envelope given the same day or thru courier ,
n what do v have to do with that sealed envelope n what is there in that envelope ?

Hi,
In my country where I came from, the embassy there will stamp your passport and let you pay a corresponding courier fee. But it doesn't mean that you're approved or not. But if you're approved they don't give you immediately the packet that contains your documents nor let you pick it up. They will mailed it to you in your home town or to the address where you put in in the courier form to where you want it to be delivered. Don't attempt to open the sealed envelop because it will cause a HUGE problem in your port of entry in the US. Give it to the immigration officer cause he is the only one who has the authority to open it. Hope I help you.

Being a self-employed person, I can't get an employment letter, hope this is NOT a problem for the K1-visa interview. Anyone experienced or thoughts.

Employment letter is I think not necessary if your self-employed during the K-1 interview. Your income tax of the previous year is sufficient to support the document needed by the Embassy. I have same case of yours. My husband is self-employed and during the submission of documents required by the embassy for my K1 case, I just presented to them my husband's recent income tax. I suggested to send to your fiancee all documents that prove you can support her financially when she is in the US. Hope I give some insights...Good luck and god bless. hi,i'm doing the k1. i read that i need 2 passport photos , i see the place to '' staple or glue photo'' i mean in the Ds-156 form,so where to put the 2nd photo? is there place for it or i just put it with all forms when i'll show them? do i need to write my name behind the photo in case it will be dropped ? .

I suggest to write your name clearly at the back of the passport photo with a pencil. Just clip the second photo infront of all the papers you want to submit to the embassy. There are some part of the world, especially in third world countries in the remote area where they have only Grade 1 to 4 classes and thats primary school. In your #26 question, I suggested to put there that you are going to stay in the US forever because thats the purpose of fiancee visa, to get married in the US. If you want to study and work in the US, put there that you don't know any employer yet and same with school. Hope i help u. Good luck

My fiance and I entered the USA on June 28th at Detroit International Airport and the guy at immigration was very nice. I asked about the temp work authorization and he said my fiance was legally able to work with the stamp on his I-94. There IS a stamp on his I-94, but I'm worried that this was just a basic "you're in the USA" stamp and has nothing to do with work authorization, and the immigration guy had no idea what he was talking about.
What does this "temp work authorization" stamp look like, that you supposedly only get at the JFK airport? What does it SAY?

Hi Monica,
As far as I know, you can get a temp. work authorization permit by filing up a form I-765 (Application for Employment Authorization) and u need to pay 180 dollars. Then they will send you a notice of action on what the next step. I am not so sure now if the fee is still the same.

Hi, I am not really so sure about this. As far as I know if the marriage took place in the Philippines, we don't have divorce there only annulment. So, if thats the case you might be still married in the Philippines. Maybe you should check the National Statistic Office or any offices there that knows your present status. If your marriage was been terminated, you should give a copy of your divorce decree to your fiancee because the american embassy will look for it. Hope I help you in any way.
